`Claims 1-11 are pending in this application. Upon entry of this Amendment, claims 1, 3-
`
`5, 8, and 10 are amended, claims 2, 6-7, 9 and 11 are cancelled, and claim 12 is added. Support
`
`for the amendments may be found throughout the specification, for example in paragraphs
`
`[0033], [0037]-[0038], [0065]-[0070], [0083], [0092], and [0098]-[0099] of the published
`
`application, FIG. 7, and the originally-filed claims. Thus, Applicant respectfully submits that no
`
`new matter is being added by the Amendments to the Claims.
`
`Rejection of Claim 5 under 35 U.S.C. § 112
`
`The Examiner rejected Claim 5 under 35 U.S.C. 112 for using relative terms. Applicant
`
`respectfully disagrees with the Examiner. However, to expedite prosecution of the application,
`
`Applicant has amended Claim 5 to address this rejection and respectfully requests the Examiner
`
`to withdraw this rejection.
`
`Rejection of Claims 1, 3-5, 8, and 10 under 35 U.S.C. § 103(a)
`
`Claims 1-4 and 8 are rejected under 35 U.S.C. § 103(a) as being unpatentable over US
`
`2010/0144275 (Satou), in view of US 2011/0086615 (Golder). Claims 5 and 9 are rejected under
`
`35 U.S.C. § 103(a) as being unpatentable over Satou, in view of US 2011/0195665 (Friedlander).
`
`Claims 7 and 11 are rejected under 35 U.S.C. § 103(a) as being unpatentable over Satou, in view
`
`of US 2006/0128305 (Delalat).
`
`Independent claim 1 is hereby amended to recite, inter alia, the features ""wherein the
`
`control unit controls the mobile terminal to be switched from a locked state to an unlocked state
`
`under a predetermined condition when any one of the following steps is performed: performing
`

`similar features. No such configuration is disclosed or suggested by Satou, Golder, Friedlander,
`
`or Delalat, taken alone or in any combination. Satou, Golder, Friedlander, or Delalat were not
`
`cited as support for and do not disclose the above features.
`
`Accordingly, Applicant submits that the rejection of independent claims 1 and 8 under 35
`
`U.S.C. § 103(a) should be withdrawn. Applicant submits dependent claims 3-5 are allowable at
`
`least for depending from allowable independent claim 1, and dependent claims 10 and 12 are
`
`allowable at least for depending from allowable independent claim 8. Accordingly, Applicant
`
`submits that the rejection of claims 1, 3-5, 8, and 10 under 35 U.S.C. § 103(a) should be
`
`withdrawn.

`CONCLUSION
`
`On the basis of the foregoing remarks, Applicant respectfully submits that the pending

`claims of the present application are allowable over the prior art of record. Applicant thus
`
`respectfully requests the previous rejections be withdrawn, and that the pending claims be
`
`allowed by the Examiner. Favorable consideration and timely allowance of this application are
`
`respectfully requested.
`
`This Amendment is being made solely to expedite prosecution of the present application
`
`and does not constitute an acquiescence to any prior art, objections, or rejections identified by
`
`the Examiner. Applicant's silence with regard to the Examiner's rejections of the dependent
`
`claims constitutes a recognition by Applicant that the rejections are moot based on Applicant's
`

`The amendment filed on 09/11/2015 amended all claims drawn to the elected invention and presenting only claims drawn to a
`non-elected invention is non-responsive (MPEP § 821.03). The remaining claims are not readable on the elected invention
`because the newly amended claims would have been restrictable from the origianlly examined claims, applicant has now
`added a second communication unit, a display unit, a GPS system exchanging positional information between two mobile
`devices, performing an authentication of a face of a user, etc., not previously claimed and altered the asepects of the claimed
`mobile device and method to be a distinct invention from what was originally claimed.
`
`Since the above-mentioned amendment appears to be a bona fide attempt to reply, applicant is given a TIME PERIOD of
`TWO (2) MONTHS from the mailing date of this notice within which to supply the omission or correction in order to avoid
`abandonment. EXTENSIONS OF THIS TIME PERIOD UNDER 37 CFR 1.136(a) ARE AVAILABLE.

`The practice set forth in this section is not applicable where a provisional election of a single species was made in
`accordance with MPEP § 803.02 and applicant amends the claims such that the elected species is cancelled, or where
