`
`
`

`

`IPR2019-00329
`Patent 9,687,454
`In accordance with 37 C.F.R. § 42.70(a) and the Scheduling Order (Paper 22),
`
`Patent Owner’s Request for Oral Argument
`
`Patent Owner Indivior UK Limited requests the opportunity to present oral argument
`
`on all instituted grounds of unpatentability for U.S. Patent No. 9,687,454 (“the ’454
`
`patent”), relating to each of the written description and anticipation issues addressed
`
`in Petitioners’ Petition and Reply, Patent Owner’s Response and Sur-Reply, any
`
`other filings by the parties, and all exhibits thereto.
`
`Pursuant to 37 C.F.R. § 42.70, Patent Owner specifies that the issues to be
`
`argued include:
`
`(1) Whether Myers is not prior art to claims 1–5 and 7–14 of the ’454 patent
`
`(the “challenged claims”) because the challenged claims have written description
`
`support in U.S. Patent Application No. 12/537,571.
`
`(2) Rebuttal to Petitioners’ presentation on all matters, including issue (1)
`
`above; and any motion to exclude filed by Petitioners; and
`
`(3) Any other issues that the Board deems necessary for issuing a final
`
`written decision.
`
`Pursuant to the Scheduling Order (Paper 22), the oral argument is scheduled
`
`for Tuesday, March 3, 2020. Patent Owner requests a total of forty-five (45) minutes
`
`of argument time per side. Patent Owner is amenable to the hearing being held at the
`
`Alexandria, Virginia, USPTO Headquarters, or any other location that the Board
`
`deems appropriate, as set forth in the Scheduling Order.
