`
` CROSSROADS EXHIBIT 2049
`Oracle Corp., et al v. Crossroads Systems, Inc.
` IPR2014-01207 and IPR2014-1209
`
`

`

`I, Jennifer Ray Crane, state and declare as follows:
`
`1.
`
`I am an employee of Crossroads Systems, Inc., Patent Owner in this
`
`proceeding. I have been employed with Crossroads since April 2003. I am
`
`currently in the position of Chief Financial Officer (CFO). My knowledge of the
`
`facts stated here is based on my employment with Crossroads and my
`
`responsibilities as CFO.
`
`2.
`
`Attached as Exhibit A to this declaration is a spreadsheet containing a
`
`schedule of certain of Crossroads’ intellectual property settlement and license
`
`agreements. Exhibit A lists the identity of licensees of a patent or patents in the
`
`‘972 patent family. By ‘972 patent family, I mean those patents which have as their
`
`ultimate parent the same application as Patent No. 5,941,972, which was filed on
`
`December 31, 1997.
`
`3.
`
`Exhibit A shows, for each licensee, the date of the agreement or
`
`agreements, the original lump sum or paid up royalty amount, and if applicable the
`
`ongoing royalty payment. The “Litigation?” column indicates whether or not, to
`
`Crossroads’ knowledge, Crossroads or the licensee ever filed a lawsuit regarding
`
`patents in the ‘972 patent family. Exhibit A shows payments made through fiscal
`
`year 2014.

`
`

`

`4.
`
`Attached as Appendix B to my declaration is a true and correct copy
`
`of each non-confidential license agreement indicated in the schedule, as found in
`
`Crossroads’ files. Attached as Appendix C to my declaration is a true and correct
`
`copy of each confidential license agreement indicated in the schedule, as found in
`
`Crossroads’ files. The Bates numbers at the bottom of each agreement, which is
`
`indicated for reference in the schedule, are not part of the originals. As I
`
`understand it, these numbers were added during litigation.
`
`5.
`
`The information contained in Exhibit A comes from the license
`
`agreements as they exist in Crossroads’ files, and Crossroads’ records of the
`
`payments received under those agreements. Crossroads’ records were made at or
`
`near the time the recorded act, event, or condition occurred. The records were
`
`made by someone with knowledge or from information transmitted by someone
`
`with knowledge. These records were kept in the course of Crossroads’ regularly
`
`conducted business activity. It was Crossroads’ regular practice to make these
`
`records. I am qualified to testify regarding Crossroads’ record keeping practices
`
`because I am familiar with them through my employment with Crossroads.
`
`6.
`
`I declare under penalty of perjury under the laws of the United States
`
`of America that the foregoing is true and correct.
