`categorization methods for collected information may be utilized including at least

`categorizing by providing individual categories according to category definition entered

`by a specific user or on behalf of an enterprise. Categorization may also be done for a
`
`first plurality of persons or enterprises according to category definition entered by a
`
`second plurality of persons or enterprises, or categories are developed from information
`
`taken from communication between users and the system. Probability algorithmsimay

`also be used in developing categories.--

`REMARKS
`
`The present response is to the Office Action mailed in the above-referenced case
`on September 25, 2006, made final. Claims 1-24 are standing for examination. The
`
`Examiner states that a portion of the Information Disclosure Statement filed 12/ 1/2005
`
`fails to comply with the provisions of 37 CFR 1.97, 1.98 and MPEP §609. Claims 13, 14,
`
`16-20 and 24 remain rejected under 35 U.S.C. 101 because the claims are directed to non-
`
`statutory subject matter. Claims 1, 9-11, 13, and 21-23 are rejected under 35 U.S.C.
`
`102(b) as being anticipated by Stride et al. (US 6,792,422) hereinafier Stride. Claims 2-4,
`12, 14-16 and 24 are rejected under 35 U.S.C. 103(a) as being unpatentable over Stride in
`
`view of Schutzer et-al. (US 5,920,848) hereinafier Schutzer. Claims 5 and 17 are rejected
`under 35 U.S.C. 103(a) as being unpatentable over Stride, in view ofTriggs (US
`
`2003/0204485) hereinafier Triggs. Claims 6-8 and 18-20 are rejected under 35 U.S.C.
`
`103 (a) as being unpatentable over Stride in view of Triggs.
`
`In response to the Examiner's rejections, objections and statements, applicant
`
`herein provides a correct information disclosure statement. Applicant amends the claims
`
`as required to overcome the Examiner's 101 rejection and to overcome the art provided by
`
`the Examiner. The abstract of the specification is also herein corrected by amendment.
`
`Claims 9 and 21 are herein canceled as their limitations have been added to the base
`
`claims by amendment.
`Regarding the 102 rejection, applicant herein amends the independent claims 1
`
`and 13 to positively recite that the collection function automatically retrieves transaction
`
`information from Internet-connected Web sites on behalf of a person or enterprise.
`
`The Examiner states in the present Office Action that; “Stride discloses the system
`
`of Claim 1, wherein the system collects the information concerning transactions from
`
`Intemet-connected web sites adapted to provide account information to clients (see
`Figures 2 and 3; see Column 4, Line 19 through Column 6, Line 23) Stride discloses this
`
`limitation in that system operates on the Internet.”

`Applicant argues that the ‘system of Stride fails to teach anywhere in the portions.
`
`provided by the Examiner that the system automatically gathers information concerning
`
`transactions by a collection function of the software from Intemet-connected web sites
`
`adapted to provide account information for a particular person or enterprise. The mere
`
`existence of an Internet connection between a remote computer 100 and the system of
`
`Stride certainly carmot read on applicant’s said limitation.
`
`Applicant argues that Stride is fed the transaction information and fails to teach or
`
`suggest a sofiware gathering function as claimed. As clearly understood from the
`
`teaching of Stride, the user must collect the transaction data and feed it to the system for
`
`categorization. Therefore the reference of Stride fails to anticipate all of applicant's
`
`limitations of claims 1 and 13, as amended.
`
`Therefore, applicant believes that claims 1 and 13 are clearly patentable over the
`
`art as presented by the Examiner, as clearly argued above. Claims 2-12 and 14-24 are
`
`therefore patentable on their own merits, or at least as depended from a patentable claim.
`
`As all of applicant's claims as amended and argued above have been shown to be
`
`patentable over the combined prior art provided by the Examiner, applicant respectfully
`
`requests that this application be reconsidered, the claims be allowed, and that this case be
`
`passed quickly to issue. If there are any time extensions needed beyond any extension
`
`specifically requested with this amendment, such extension of time is hereby requested. If
`
`there are any fees due beyond any fees paid with this amendment, authorization is given to
`
`deduct such fees from deposit account 50-0534.
