`constructions and the specifications of the Asserted Patents which do not preclude the

`participants in a broadcast channel from having additional connections to other networks. For

`example, at Column 12, lines 4-6 of the ‘344 Patent, it states: “As described below, it is possible
`
`for a computer to be connected to multiple broadcast channels that are uniquely defined by
`
`channel type and channel instance.” Here a computer corresponds to a participant. If an m-
`
`regular network supporting a broadcast channel required every computer involved in the game in
`
`any way to be part of the network, then multiple broadcast channels would not be needed or
`
`available. The Asserted Patents also expressly state that broadcast channel participants can have
`
`non-broadcast connections to other computers. ‘344 Patent at 6:19-24. Similarly, the patent
`
`discusses multiple settings where newly connected participants may be ignored, or not
`
`considered part of the m-regular network, with regard to the passing of information until
`
`sufficient time has passed for it to participate suitably in delivering messages. E.g., ‘344 Patent
`
`at 8:5-67.

`I previously demonstrated that the Destiny Network is m-regular and non-

`complete. Opening Report at ¶¶ 118-155, 175-178, 361-364, 377-380. I disagree with Dr.

`Kelly’s contrary analysis and conclusions in paragraphs 816-862 of his report. Additionally, I
`
`disagree with Dr. Macedonia’s contrary analysis and conclusions in paragraphs 392-419 of his
`
`report. I also note that these sections of Dr. Kelly’s and Dr. Macedonia’s respective reports are
`
`substantially similar, and even identical in many paragraphs; therefore I address them together.

`meet these claim elements, either literally or under the DOE. Opening Report at ¶¶ 246-257.

`174. Dr. Kelly discusses Elements 19(e) and 19(f) together and contends that “Destiny
`
`does not meet Limitations 634:19(e)-(f) . . . either literally or under the doctrine of equivalents.”
`
`Kelly Rpt. at ¶¶ 1070-1082. I disagree. Dr. Kelly incorporates his discussion of Elements
`
`634:19(b), 634:19(c) and 344:12(b). Kelly Rpt. at ¶ 1071. I incorporate my discussion of
`
`Elements 634:19(b), 634:19(c) and 344:12(b) herein and in my Opening Report.
`
`175. Dr. Kelly’s additional argument is based on a claim construction theory that
`
`neither party proposed in the case. In particular, Dr. Kelly contends that this element is not
`
`satisfied because the participants communicate with
`

`participant in the broadcast channel (and Dr. Kelly does not suggest that it is). As noted
`
`previously, the claims do not preclude a participant in the broadcast channel from having
`
`additional connections to computers that are not part of the broadcast channel. See Reply
`
`Broadcast Channel Overview. With respect to the advertising participant, the incoming
`
`participant no longer communicates with the advertising process on the portal computer and,
`
`instead, can be connected to the process on that computer corresponding to the participant in the
`
`broadcast channel for gameplay data.

`176. Thus, as further explained above and in my Opening Report, Destiny meets this
`
`claim element because it provides substantially the same function, substantially the same way,
`
`and achieves substantially the same result.
