` am the examining attorney reviewing the above trademark applications. I would like to discuss an
`amendment before moving the marks forward.
`
`Specifically, I am writing pursuant to TMEP § 807.03(h), which requires Examining Attorneys to
`request clarification if the font style used in the mark on the drawing does not match the font style
`used on the specimen and there is no standard character claim in the application. The mark drawing
`shows APPLERAIN in stylized text; however, the specimen of use, when showing an acceptable point
`of sale, shows APPLERAIN in what would be a standard character claim. A registration of a mark in
`standard characters affords the broadest form of coverage because it provides the registrant rights in
`the text itself in any possible depictions regardless of font style, size, or color. As such, the applicant
`may add the following statement to the records, superseding the current mark descriptions:
`
`The mark consists of standard characters without claim to any particular font style, size, or
`
`color.
`
`Alternatively, please inform me if the applicant wishes to retain the stylized text and mark description
`
`as-is in the applications.
`
`If the applicant wishes to amend the applications, I’ll make the changes via an Examiner’s
`Amendment, again pursuant to TMEP § 807.03(h). The mark should then move forward to publication
`for opposition. I look forward to hearing from you by Wednesday at 3 PM ET. Otherwise, I will act on
`
`the applications as they are.
