`1.     Identification of goods: The identification of goods needs to be amended to indicate that the goods contain kratom to avoid a
`misdescriptivness refusal.  Applicant may adopt the following, if accurate:

`International Class 005:  “Herbal supplements containing kratom”

`International Class 030:  “Tea containing kratom”
`
`2.     Disclaimer of “KRATOM”: The wording “KRATOM” must be disclaimed in registering your mark as it is descriptive of the goods the
`applicant offers.
`
`In disclaiming the word “KRATOM”, the disclaimer would simply state that “No claim is made to the exclusive right to use
`“KRATOM” apart from the mark as shown.”  This will allow others to use the word in describing their goods in the marketplace
`in the future.  Importantly, a disclaimer does not affect the physical appearance of the mark, and does not have to be physically
`removed from the mark.

`3.     Mark description: The mark description needs to be amended to accurately describe all features of the mark.  Applicant may adopt the
`following, if accurate:
`
`Mark description:  The mark consists of the stylized design of a kraken being a sea creature reminiscent of an octopus in
`green, black, and red, all within a circle outlined in black.  The design is to the left of the stylized wording “KRAKEN
`KRATOM” in black.  The color white in the mark represents background and/or transparent areas and is not claimed
`as a feature of the mark.
`
`These changes can be made on my end through an Examiner’s Amendment once you confirm agreement with the above changes.
