`The Section 2(e)(1) refusal is continued and made final.
`
`Registration is refused because the applied-for mark merely describes features of applicant’s goods and/or services. Trademark Act Section
`2(e)(1), 15 U.S.C. §1052(e)(1); see TMEP §§1209.01(b), 1209.03 et seq. In addition to being merely descriptive, the applied-for mark appears to
`be generic in connection with the identified goods and/or services. “A generic mark, being the ‘ultimate in descriptiveness,’ cannot acquire
`distinctiveness” and thus is not entitled to registration on either the Principal or Supplemental Register under any circumstances. In re La. Fish
`Fry Prods., Ltd., 797 F.3d 1332, 1336, 116 USPQ2d 1262, 1264 (Fed. Cir. 2015) (quoting H. Marvin Ginn Corp. v. Int’l Ass’n of Fire Chiefs,
`Inc., 782 F.2d 987, 989, 228 USPQ 528, 530 (Fed. Cir. 1986)); see TMEP §§1209.01(c) et seq., 1209.02(a). Therefore, the trademark examining
`attorney cannot recommend that applicant amend the application to proceed under Trademark Act Section 2(f) or on the Supplemental Register
`as possible response options to this refusal. See TMEP §1209.01(c).

`A mark is merely descriptive if it describes an ingredient, quality, characteristic, function, feature, purpose, or use of an applicant’s goods and/or
`services. TMEP §1209.01(b); see, e.g., In re TriVita, Inc., 783 F.3d 872, 874, 114 USPQ2d 1574, 1575 (Fed. Cir. 2015) (quoting In re Oppedahl
`& Larson LLP, 373 F.3d 1171, 1173, 71 USPQ2d 1370, 1371 (Fed. Cir. 2004)); In re Steelbuilding.com, 415 F.3d 1293, 1297, 75 USPQ2d 1420,
`1421 (Fed. Cir. 2005) (citing Estate of P.D. Beckwith, Inc. v. Comm’r of Patents , 252 U.S. 538, 543 (1920)).

`Applicant’s mark is LACE TINT for “Cosmetics, namely, hair wig lace spray.”
`
`Generally, if the individual components of a mark retain their descriptive meaning in relation to the goods and/or services, the combination
`results in a composite mark that is itself descriptive and not registrable. In re Fat Boys Water Sports LLC, 118 USPQ2d 1511, 1516 (TTAB
`2016) (citing In re Tower Tech, Inc., 64 USPQ2d 1314, 1317-18 (TTAB 2002)); TMEP §1209.03(d); see, e.g., In re Cannon Safe, Inc., 116
`USPQ2d 1348, 1351 (TTAB 2015) (holding SMART SERIES merely descriptive of metal gun safes); In re King Koil Licensing Co., 79 USPQ2d
`
`1048, 1052 (TTAB 2006) (holding THE BREATHABLE MATTRESS merely descriptive of beds, mattresses, box springs, and pillows).
`
`Only where the combination of descriptive terms creates a unitary mark with a unique, incongruous, or otherwise nondescriptive meaning in
`relation to the goods and/or services is the combined mark registrable. See In re Colonial Stores, Inc., 394 F.2d 549, 551, 157 USPQ 382, 384
`(C.C.P.A. 1968); In re Positec Grp. Ltd., 108 USPQ2d 1161, 1162-63 (TTAB 2013). In this case, both the individual components and the
`composite result are descriptive of applicant’s goods and/or services and do not create a unique, incongruous, or nondescriptive meaning in
`relation to the goods and/or services.
`
`Based on the attached evidence from Wikipedia, “lace” is a “delicate fabric made of yarn or thread in an open weblike pattern.” Applicant’s
`identification specifically notes that the goods are a spray for “lace.” Thus, the term “lace” is descriptive of a feature of the goods.
`Additionally, the evidence from Wikipedia informs that “lace” wigs are a “special type of hairpiece or wig in which human hair or synthetic hair
`is tied by hand to a sheer lace base which goes over the scalp.” The Wikipedia article further notes that “Full lace wigs may have a base made
`entirely of lace.” The SimplyWigs webpage evidence notes the differences with lace front wigs and full lace wigs, and shows that “lace” is a
`sought after material used for wigs. The newly attached evidence shows a wide range of “lace” wigs for sale at Amazon, LaceWigsBuy, and
`Tinashe. Furthermore, in its 12/31/20 response, applicant notes that “lace” means “that the customers' strands of hair are attached to a lace base
`or natural hair. The goods give a natural look (or matching color) to the customers' hair in cosmetics or wig industry. In the simplest terms, lace
`tint is a pigmented lotion meant to make the lace wig blend in (or natural looking) with the hair of the customers.”
`
`Based on the attached dictionary evidence, “tint” refers to a “substance used for changing the colour of someone’s hair.” The term “tint” has
`
`already been disclaimed as descriptive.
`
`Taken together, the combined wording immediately conveys information about the goods. Specifically, the wording informs that applicant’s hair
`wig lace spray is used for wig “lace,” and the function or purpose of the spray is to “tint” or change the color of the wig “lace.” The evidence
`from the ThatSister webpage demonstrates that wigs of “lace” are often colored or tinted to create a better appearance. The webpage specifically
`informs that users “might need to bleach the frontal lace,” as needed. The webpage also includes a YouTube video demonstrating how the lace
`is tinted by the user using a brush apparatus (See attached at 2:06/11:50 minute mark). Thus, consumers would perceive the term “lace tint” as
`
`immediately describing information about the goods.
`
`Websites and webpages, dictionary evidence, as well applicant’s specimen and any explanatory text therein are generally a competent source for
`determining how the public perceives the mark in connection with applicant’s goods and/or services. See In re N.C. Lottery, 866 F.3d 1363,
`1367-68, 123 USPQ2d 1707, 1709-10 (Fed. Cir. 2017); In re Nett Designs, Inc., 236 F.3d 1339, 1341, 57 USPQ2d 1564, 1566 (Fed. Cir. 2001)
`(citing In re Bed & Breakfast Registry, 791 F.2d 157, 160, 229 USPQ 818, 819 (Fed. Cir. 1986)); TMEP §1209.01(b). The previously attached
`web page evidence demonstrates the widespread use of “lace tint” in the industry to convey a type of cosmetics “tint” product for use on a
`consumer’s lace wig. For example, Wig Dealer markets a lace tint product, Hair Queen offers a lace tint mousse, The Hair Diagram website
`sells a lace tint product, and Amazon lists 1st Class providing a lace tint spray. Additionally, the Stylecaster webpage describes how lace tintsare
`used for coloring or tinting around lace wigs. The previously attached evidence from applicant’s own webpage informs that the product is a
`
`“tinted spray” used to “make your lace disappear.” Thus, the wording describes features or information about applicant’s hair wig lace sprays.
`
`Applicant’s evidence that the mark is a “double entendre” is not persuasive. A “double entendre” is an expression that has a double
`connotation or significance as applied to the goods and/or services. TMEP §1213.05(c); see In re Colonial Stores Inc., 394 F.2d 549, 552-53, 157
`USPQ 382, 384-85 (C.C.P.A. 1968) (finding SUGAR & SPICE a double entendre and not descriptive for bakery products because it evokes the
`nursery rhyme “sugar and spice and everything nice”). A mark that comprises a “double entendre” will not be refused registration as merely
`descriptive if one of its meanings is not merely descriptive in relation to the goods and/or services. TMEP §1213.05(c). However, the multiple
`meanings that make an expression a “double entendre” must be well-recognized by the public and readily apparent from the mark itself in the
`context of the applied-for goods and/or services. See Robinson v. Hot Grabba Leaf, LLC, 2019 USPQ2d 149089, at *8 (TTAB 2019); In re
`Calphalon Corp., 122 USPQ2d 1153, 1163-64 (TTAB 2017) (quoting TMEP §1213.05(c)). If the alleged second meaning of the mark is only
`apparent to purchasers “after they view the mark in the context of the applicant's trade dress, advertising materials or other matter separate from
`the mark itself,” the mark is not a double entendre. In re Yarnell Ice Cream, LLC, 2019 USPQ2d 265039, at *7 (TTAB 2019) (quoting In re The
`Place, Inc., 76 USPQ2d 1467, 1470 (TTAB 2005)). In the present case, applicant has not demonstrated what the meaning or significance is of
`any purported “double entendre.”
`
`A mark is suggestive if some imagination, thought, or perception is needed to understand the nature of the goods and/or services described in the
`mark; whereas a descriptive term immediately and directly conveys some information about the goods and/or services. See Stoncor Grp., Inc. v.
`
`

`
`Specialty Coatings, Inc., 759 F.3d 1327, 1332, 111 USPQ2d 1649, 1652 (Fed. Cir. 2014) (citing DuoProSS Meditech Corp. v. Inviro Med.
`Devices, Ltd., 695 F.3d 1247, 1251-52, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012)); TMEP §1209.01(a). The foregoing evidence demonstrates
`that the proposed mark is not suggestive, but actually describes features of the goods, and that several companies use the “lace tint” wording in
`the marketplace to convey information about related goods.
`
`Two major reasons for not protecting descriptive marks are (1) to prevent the owner of a descriptive mark from inhibiting competition in the
`marketplace and (2) to avoid the possibility of costly infringement suits brought by the trademark or service mark owner. In re Abcor Dev.
`Corp., 588 F.2d 811, 813, 200 USPQ 215, 217 (C.C.P.A. 1978); TMEP §1209. Businesses and competitors should be free to use descriptive
`language when describing their own goods and/or services to the public in advertising and marketing materials. See In re Styleclick.com Inc., 58
`USPQ2d 1523, 1527 (TTAB 2001).
`
`For the reasons set forth above, the Section 2(e)(1) refusal is continued and made final.

`Wigs have been used since antiquity as hairstyles and costumes; ancient Egyptians wore wigsto shield their shaved heads
`from the sun. Wigs were kept in place by using beeswax and resin. Wigs were once made from horsehair, wool, buffalo hair

`wigs as an everyday fashion.” There was intermittent use of wigs in many cultures throughouthistory including the

`The modern wig was adopted by Louis XIIl to cover his balding head. By the late 1600s, both wigs and handmade lace
`headpieces were common with European and North American upper classes as daily fashion. Wigs were made of human,
`horse, and yak hair and sewn onto a frame with silken thread were meant to be obvious as wigs and not the wearer's actual

`Full lace wigs may have a base madeentirely of lace. Full lace wigs can be pulled into a high ponytail and up-do's, as
`opposed to lace front wigs. Full lace wigs allow for the most versatility when it comes to styling for all lace wig types. They
`allow for a natural hairline and natural looking parting areas throughoutthe wig. If a lace front wig was pulled back, it is
`usually obvious thatit is a wig.!”! In 2016, 360 Degree Lace Wigs were created allowing wig wearers to wear undetectable
`ponytail styles.

`Lace front wigs are more common and the remainderof the wig is made outof a less fragile material whichis less

`in the front half of the wig, to allow the wearer to part the hair any way they want. Modern day lace wigs can be worn while

`Thelace wig is usually attached with the assistance of glues and tapes, which are applied to the front hairline area. Once
`the glue hasdried, the front lace portion of the wig is affixed to the area where the glue has been applied on the hairline,
`creating a tight bond which keeps the lace wig in place on the head. Somelace wigs also have whatis referred to as "baby
`hair" around the temple areas whichis used to cover up anyvisible signs of lace on the forehead, and the baby hair also
`helps to create a realistic hairline. Once applied the lace or lace front wig can stay in place for weeks at a time and

`Lace wig density is measured as a percentage. The higher the percentage, the thicker the hair density on the wig. The
`popular density on the market is 130% and 150%. The higher the percentage, the higher price consumers pay. Like other
