`In consideration of Applicant’s Statement of Use, dated and filed May 5, 2023 ("SOU"), the
`amendment to the limitation of goods, and specimen and specimen description contained therein, and
`the record hereof, the undersigned examining attorney has reexamined the above-referenced
`application, in accordance with section 2.61 of the Trademark Rules of Practice, 37 C.F.R. § 2.61
`(2023), and has determined that the application cannot be advanced at this time for the reasons detailed
`in this communication.

`Applicant has applied to register the mark “KYLIE BABY BY KYLIE JENNER” for use as a source
`indicator of “facial oils; body oils” as printed in the Notice of Allowance issued May 5, 2020, and
`amended by limitation in the SOU.
`

`SUBSTANTIVE REFUSAL

`SPECIMEN UNACCEPTABLE TO SHOW USE
`
`
`Specimen does not show use of identified goods in International Class 3. Registration is refused,
`pursuant to Sections 1 and 45 of the Trademark Act, 15 U.S.C. §§ 1051, 1127, because the specimen
`does not show the proposed mark as actually used
`in commerce in connection with
`the
`identified goods in this
`class.  37 C.F.R.
`§ 2.56(a),
`(b)(1);

`904.07(a).  Under Sections 1(d) and 45 of the Trademark Act and Rule 2.56, an acceptable specimen
`showing actual use “on or in connection with all the goods or services specified in the notice of
`allowance” is required in order for the mark to be registered by this Office.  37 C.F.R. § 2.88(a)(2); see
`15 U.S.C. §§ 1051(d), 1127; 37 C.F.R. §§ 2.56, 2.88(b)(2); TMEP §§ 904, 904.07(a), 1109.09(b),
`1301.04.

`In support of use for this class, Applicant has submitted a PDF file described as "photo of the goods
`bearing the mark."  However, the goods shown are a lip and cheek stick containing oils, but also
`containing ingredients that make the goods a soothing, hydrating type stick balm solid, e.g.  "candelilla
`cera/euphorbia cerifera (candelilla) wax/cire de candelilla" and "copernicia cerifera cera/copernicia
`cerifera
`(carnauba) wax/cire
`de
`carnauba,  see  https://kyliecosmetics.com/products/lip-cheek-
`stick?variant=43927620681970 (attached hereto).  The attached evidence shows that when 
`facial
`oils  and  body oils are marketed, it is understood that these goods are sold in the form of  oils and not
`solids, and that cosmetic  sticks  are solids.  See  attached evidence. 
`
`Accordingly, the specimen submission is not acceptable to show the mark as a source indicator for the
`identified goods in International Class 3.  Please note that while the identification of goods may be
`amended to clarify or limit the listed goods, adding goods and services or broadening the scope of the
`listed goods is not permitted.  37 C.F.R. § 2.71(a); TMEP § 1402.06-.07.

`Examples of specimens.  Specimens for goods include a photograph of (1) the actual goods bearing
`the mark; (2) an actual container, packaging, tag or label for the goods bearing the mark; or (3) a point-
`of-sale display showing the mark directly associated with the goods.  See 37 C.F.R. § 2.56(b)(1), (c);
`TMEP § 904.03(a)-(m).  A webpage specimen submitted as a display associated with the goods must
`show the mark in association with a picture or textual description of the goods and include information
`necessary for ordering the goods.  TMEP § 904.03(i); see 37 C.F.R. § 2.56(b)(1), (c).  Any webpage
`printout or screenshot submitted as a specimen must include the webpage’s URL and the date it was
`accessed or printed, and this information may be provided on the specimen itself, on the TEAS form in
`the description of the specimen submission, or in a verified statement under 37 C.F.R. § 2.20 or 28
`U.S.C. § 1746 in a later-filed response.  See 37 C.F.R. § 2.56(c); TMEP §§ 904.03(i), 1301.04(a).

`Response options.   Applicant may respond to this refusal by submitting, for each applicable
`international class, a different specimen (a verified  “substitute” specimen) that (a) was in actual use in
`commerce prior to the expiration of the deadline for filing the statement of use and (b) shows the mark
`in actual use in commerce for the goods and/or services identified in the statement of use.  A “verified
`substitute specimen” is a specimen that is accompanied by the following statement made in a signed
`affidavit or supported by a declaration under 37 C.F.R. § 2.20: “The substitute (or new, or originally
`submitted, if appropriate) specimen(s) was/were in use in commerce prior to expiration of the filing
`deadline for filing a statement of use.” The substitute specimen cannot be accepted without this
`statement.
