`
`STRICT DEADLINE TO RESPOND TO THIS LETTER
`TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S
`COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW. A RESPONSE
`TRANSMITTED THROUGH THE TRADEMARK ELECTRONIC APPLICATION SYSTEM (TEAS) MUST BE RECEIVED BEFORE
`MIDNIGHT EASTERN TIME OF THE LAST DAY OF THE RESPONSE PERIOD.
`
`ISSUE/MAILING DATE: 5/29/2018
`
`The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to
`the issue below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
`
`SEARCH OF OFFICE’S DATABASE OF MARKS
`
`The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that
`would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
`
`IDENTIFICATION OF GOODS AND SERVICES
`
`CLASS 009
`
`
`
`
`
`
`
`
`
`
`
`
`
`
`
`The wording “ and making restaurant, travel, and hotel reservations” in the identification of goods for International Class 009 is indefinite
`because the nature of the goods is unclear due to indefinite punctuation. Applicant must correct the punctuation in the identification to clarify
`the individual items in the list of goods and/or services. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01(a).
`
`Next, the wording “ Near Field Communication (NFC) technology-enabled devices” in the identification of goods for International Class 009 is
`indefinite and must be clarified because Near field communication (NFC) is a type of technology that enables short-range communication
`between electronic devices which may be used in devices in multiple classes. The common name of the device featuring NFC technology must
`
`be indicated. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.
`
`Additionally, the wording “d ata processing equipment, computers” in the identification of goods is unclear because the nature of the data
`processing equipment is not clearly indicated. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01
`
`The wording “routers” is indefinite and requires clarification to specify the type of routers. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Also,
`the wording “remote controls devices” must be clarified to state the purpose of the remote control devices. Id.
`
`Next, the wording “hands-free devices” must be clarified to set forth the purpose or use of the hands-free devices. Also, the wording “headsets”,
`“chargers” “cables” and “screen protectors” in the identification of goods must be clarified to set for the nature or purpose of the headsets.
`
`CLASS 036
`
`The wording “financial affairs” in the identification of goods is indefinite and must be clarified because the nature of the financial affairs is not
`set forth. Similarly, the wording “financial transaction services” must be clarified to set for the nature of the financial transaction services being
`rendered and the wording “provision of contactless payment services” must be clarified to indicate the type of contactless processing payment
`
`services which are being performed. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.
`
`The wording “ electronic payment, namely, electronic processing and transmission of credit card transactions, wireless wallets, mobile wallets,
`electronic wallets, wireless credit, debit and prepared card transactions, credit card and transaction processing terminal services using near field
`communication (NFC) technology” in the identification of goods for International Class 036 must be clarified because it is too broad and could
`include goods in other international classes. See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03. In particular, this wording could encompass
`electronic transmission of transactions in International Class 038.
`
`CLASS 042
`
`Applicant is advised to delete or modify the duplicate entry in the identification of goods and/or services in International Class 042 for
`“provision of Internet search engines.” See generally TMEP §§1402.01, 1402.01(a). If applicant does not respond to this issue, be advised that
`the USPTO will remove duplicate entries from the identification prior to registration. If modifying one of the duplicate entries, applicant may
`amend it to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original
`application or as acceptably amended. See 37 C.F.R. §2.71(a); TMEP §1402.06. Also, generally, any deleted goods and/or services may not
`later be reinserted. TMEP §1402.07(e).
`
`Next, the wording “p roviding geographic information, interactive geographic maps, software for accessing satellite and aerial images of earth
`and space, and ocean bathymetry, via a website” in the identification of goods for International Class 042 must be clarified because it is too
`broad and could include goods
`in other
`international classes.
`See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.
`In
`particular, this wording could encompass “providing a web site and web site links to geographic information and interactive geographic maps”
`in International Class 039.
`
`Similarly, the wording “c omputer software for managing, networking, collaborating within and providing remote access to databases” must be
`clarified because it is too broad and could include goods in other international classes. See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03. It
`is unclear whether the applicant is offering goods in the nature of downloadable software in Class 009, or whether the applicant is offering
`services in the nature of providing non-downloadable computer software in Class 042.
`
`Applicant may substitute the following wording, if accurate:

`enabled digital assistant; voice recognition software; software for accessing and searching online databases and websites; software for searching
`a user's mobile phone, computer, tablet, or other electronic communication device for documents, files, and other stored information on
