`(cid:160)

`
`(cid:160) R
`
`egistration is refused because the applied-for mark merely describes a feature and characteristic of applicant’s goods and/or services. (cid:160)
`Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1); see TMEP §§1209.01(b), 1209.03 et seq.
`
`(cid:160) T
`
`he applicant is applying to register the mark SMART SOLUTIONS in connection with software and hardware for breast pumps, feeding
`
`devices, retail services featuring medical pump technology systems, and technical adviser’s services related to such goods. (cid:160)(cid:160)(cid:160)
`
`As the attached evidence reflects, the word “smart” is defined as “(of an electronic device) using digital communication technology to provide
`many of the functions of a computer.” (cid:160) In addition, the word “solutions” has been held merely descriptive when used in connection with
`computer hardware.(cid:160) In re Box Solutions Corp., 79 USPQ2d 1953, 1956 (TTAB 2006); see TMEP §1209.03(p).
`
`Generally, if the individual components of a mark retain their descriptive meaning in relation to the goods and/or services, the combination
`results in a composite mark that is itself descriptive and not registrable.(cid:160) In re Phoseon Tech., Inc., 103 USPQ2d 1822, 1823 (TTAB 2012);
`TMEP §1209.03(d); see, e.g., In re King Koil Licensing Co., 79 USPQ2d 1048, 1052 (TTAB 2006) (holding THE BREATHABLE MATTRESS
`merely descriptive of beds, mattresses, box springs, and pillows where the evidence showed that the term “BREATHABLE” retained its
`ordinary dictionary meaning when combined with the term “MATTRESS” and the resulting combination was used in the relevant industry in a
`descriptive sense); In re Associated Theatre Clubs Co., 9 USPQ2d 1660, 1663 (TTAB 1988) (holding GROUP SALES BOX OFFICE merely
`descriptive of theater ticket sales services, because such wording “is nothing more than a combination of the two common descriptive terms
`most applicable to applicant’s services which in combination achieve no different status but remain a common descriptive compound
`
`expression”). (cid:160)(cid:160)
`
`In this case, both the individual components and the composite result are descriptive of applicant’s goods and/or services and do not create a
`unique, incongruous, or nondescriptive meaning in relation to the goods and/or services.(cid:160) Specifically, the wording indicate that the goods and
`services relate to computer hardware and digital communications technology.
`
`(cid:160) C
`
`larification of the Identification of Goods and Services
`
`(cid:160) S
`
`matter contained in the electronic media.(cid:160)(cid:160)
`
`ome of the wording in the identification of goods and services is indefinite and must be clarified because the specific nature of the goods and
`services is not clear.(cid:160) See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.(cid:160) For example, applicant must indicate if the “electronic and optical data
`media; smart cards, compact discs, diskettes, cassettes” are blank or pre-recorded. (cid:160) If they are pre-recorded, applicant must indicate the subject
`
`The following suggested identification contains further guidance in bold and/or brackets.(cid:160) Applicant may adopt any or all of the suggestions in
`bold and/or brackets so long as they are accurate. If applicant does not adopt a suggestion, then applicant must amend the identification so that it
`is as specific as the suggestions and language found in the Manual of Acceptable Identifications of Goods and Services which is located at:
`
`(cid:160) A
`
`than where specified.(cid:160)(cid:160)
`
`pplicant should note that the braces-brackets indicate where applicant must insert specific types of goods or services.(cid:160) The braces should NOT
`appear in the amended identification; only the specific goods or services inserted by applicant.(cid:160) Applicant need not amend identifications other
