`To establish that a mark is registrable under section 2(f), Applicant may rely on

`any appropriate evidence tending to show that the mark distinguishes the Applicant's
`

`is well-established that Applicant need
`
`present only a prima facie case of acquired distinctiveness, rather than conclusive
`
`evidence, to be entitled to registration, TMEP §1212.01, and that five years‘ use in
`
`commerce may be accepted as prima facie evidence that the mark has acquired
`
`distinctiveness to satisfy 15 U.S.C. §1052(f).. TMEP §1212.05. Yamaha International
`
`Corp. v. Hoshino Gakki C0,, Ltd., 840 F.2d 1572, 1576, 6 U.S.P.Q.2d 1001, 1004 (Fed. Cir.

`Applicant has been using the applied—for YANCEY ROOFING mark for over 29
`
`years; some 24 years longer than the statutory period used as prima facie evidence
`
`that the mark has become distinctive. Stuart Hall Co. v. Ampad Corp., 51 F.3d 780, 34
`U.S.P.Q.2d 1428, 1435 (8th Cir. 1995); Sunbeam Prods. lnc. V. West Bend Co. 123 F.3d

`SURNAMES ARE ELIGIBLE FOR REGISTRATION ON THE PRINCIPAL REGISTER.
`
`A Mark that is merely a surname does qualify for registration under the
`
`Princinple Register if it has acquired inherent distinctiveness under the Lanham Act §
`
`2(f). LanhamAct§2(f), 15 U.S.C § 10520?
`
`To achieve registration on the Principal Register, evidence of a "long and
`
`exclusive use which changes its significance to the public from a surname of an
`
`individual to a Mark for particular goods or services" is necessary. Miller V Miller, 105
`
`USPQ2d 1615, 1623 (TTAB 2013). Whether a Mark is primarily merely a surname is a
`
`question of fact. In re Etablissements Darty et Flls, 759 F.2d 15, 18, 225 USPQ2d 652, 653-
`
`4 (1985). The TMEP states, for most surnames, a statement by the applicant that it
`
`has made substantially exclusive and continuous use the surname as a Mark for 5
`
`years will be sufficient to establish secondary meaning. TMEP 1'212.05(a).
`

`USE IN COMMERCE OF THE MARK FOR MORE THAN 5 YEARS CAN ESTABLISH
`

`The Applicants Mark, by reason of the applicant's substantially exclusive and
`
`continuous use of the mark in commerce for the five years before the date on which
`
`the claim of distinctiveness is made, has established acquired distinctiveness under
`
`§2(fl (37 C.F.R. §2.41(a)(2),' see TMEP §§ 7272.05—1212.05(d))
`
`Applicant's claim of distinctiveness based on more than 5 years‘ use in
`
`commerce is supported by the accompanying Declaration of Jason Grudel, Vice
`
`President of the corporation that owns the Mark, which is incorporated herein by
`this reference. The Grudel Declaration evidences that
`the mark has become
`
`distinctive of Applicant's services through Applicant's continuous use of the mark in
`
`commerce for more than 29 years preceding Applicant's execution of
`
`the
`
`Declaration. Applicant furthermore has presented evidence of the use of the Mark in
`
`commerce through Yellow Page Ads and purchasing documents. This evidence is
`
`submitted without prejudice to Applicant's right to submit further and additional
`
`evidence should the Examining Attorney continue his refusal to register Applicant's
`
`mark. Accordingly, the Examining Attorney should withdraw his refusal of registration
`
`based on descriptiveness.
