`Likelihood of Confusion
`
`The Examiner cites Registration No. 3295871 for EZBBQ as blocking the
`
`application to register the applicant's EAZYBBQ design mark due to a likelihood
`
`of confusion.
`
`The factors to be applied when evaluating likelihood of confusion between
`
`two trademarks are found in In ['5' E1. duPont de Nemours & C0., 476 F.2d 1357
`
`(CCPA 1973). Among the premier factors to be considered under dc/Pant are the
`
`similarity of the marks and of the goods and the channels of commerce in which
`
`they travel.
`
`In order to refuse registration under Section 2(d), there must be shown
`
`more than a mere possibility of confusion; instead, there must be demonstrated a
`
`probability or
`
`likelihood of confusion. See Electronic Design & Sales Inc.
`

`Electronic Data Systems Carp., 954 F.2d 713, 21 USPQ2d 1388, 1391 (Fed. Cir.
`

`application. That is, this is contrary to the principle of
`trademark law that each case must be decided on the
`basis of all relevant facts which include the marks and
`the goods as well as the marketing environment

`which in which a purchaser normally encounters them
`and the experience generated as a result of their use in
`

`the marketplace providing such use has been of
`sufficient length and depth to make an impact in the
`market.

`
`In the case at hand, the registered mark is merely descriptive of the
`
`goods claimed, as evidenced by the fact that the mark is registered on the
`
`Supplemental Register. A narrower scope of protection is due Supplemental
`
`Register registrations than for distinctive marks on the Principal Register. See
`
`Palm Bay Imports, Inc. v.
`
`i/euve C/icquot Ponsardin Mainson Fondee En 1772,
`
`396 F.3d 1369, 1373, 73 U.S.P.Q.2d 1689,1693 (Fed. Cir. 2005) and In re Hun/re
`
`&Jochheim, 185 U.S.P.Q. 188, 189 'l'l'AB 1975).
`
`By this reduced standard of protection, the marks are not confusingly
`
`similar because the applicant's mark makes a distinct commercial
`
`impression
`
`from the registered mark. Here are the marks together:
`

`Here, the applicant's mark makes a separate commercial impression from
`
`the registered mark in that: (1) it adds the letters A and Y, which do not appear
`
`in the registered mark; and (2) it has half of the mark in an orange and yellow
`
`
`
`color and features a flame design from the top of the letter "Y"; and (3) it is
`
`presented in a specific typeface featuring bold uppercase lettering.
`
`While no one of these is determinative of differences that would make
`
`confusion unlikely,
`
`taken together
`
`they add up to different commercial
`
`impressions that would make confusion unlikely.
`
`Finally, the applicant notes that the term EZ appearing in the registered
`
`mark is extremely diluted and has limited trademark value. As of this writing, there
`
`are 1,782 active registered marks containing the term EZ (see TESS print-out
`
`attached). These include the following three marks claiming class 4 goods similar
`
`to those in the cited mark:
`

`EASY-LITE -- Reg. No. 3748194

`
`These three marks have been deemed sufficiently distinctive from one
`
`another to co—exist on the registry for similar goods.
`
`Third-party registrations may be probative of a lack of distinctiveness of a
`
`mark or an element of a mark. See Tektronic, Inc. v. Daktronics, inc., 534 F.2d 915,
`
`189 USPQ 693 (CCPA 1976) and Conde Nast Publications, Inc. v. Miss Quality,
`
`Inc., 507 F.2d 140, 184 USPQ 422 (CCPA 1975).
`
`The large number of E2 marks on the registry simply means that each of
`
`them is given a narrow ambit of protection. The Board in In re Broadway Chicken
`
`Inc., 38 USPQ2d 1565-66 (TTAB 1996), citing In re Bed & Breakfast Registry, 791
`
`F.2d 157, 229 USPQ 818 (Fed. Cir. 1986), stated:
`
`Evidence of widespread third-party use, in a particular field, of marks
`containing a certain shared term is competent
`to suggest
`that
`purchasers have been conditioned to look to other elements of the
`marks as a means of distinguishing the source of goods or services in
`the field.
`
`In these cases, buyers differentiate between the various marks by looking at
`
`the mark as a whole. Buyers do not assume that the maker of one EZ product
`
`
`
`makes a different product. The applicant submits that just as the registered marks
`
`co-exist on the registry for specific goods, the applicant’s mark may similarly co-
`
`exist. Specifically, if EZLIGHT CHARCOAL can co-exist on the Principal Register
`
`with EASY LITE charcoal, surely EZBBQ can co-exist on the Supplemental
`
`Register with EASYBBQ.
`
`Likelihood of confusion is reduced when the common element of conflicting
`
`marks is a word or phrase that is "weak," in re America's Best Chocolate, Inc., 169
`
`USPQ 53 (TTAB 1971),
`
`i.e., “when it
`
`is descriptive, highly suggestive, or in
`
`common use by many other sellers in the market." [Emphasis added.] Colgate-
`
`Palmolive Co. v. Carter-Wallace, Inc, 432 F.2d 1400, 167 USPQ 529 (CCPA
`
`1970). For this reason, the Applicant’s distinctive EASYBBQ design mark should
`
`be able to co-exist in this crowded field just as the marks cited above already do.
`
`As stated by the Board in Keebler Company v. Associated Biscuits Ltd., 207
`
`USPQ 1034, 1039 ('l'|'AB 1980), in such circumstances: “[|]t is now far too late for
`
`any one party to claim a right to exclusive use extending beyond a specific mark for
`
`specific goods.” The cited mark is clearly subject to this rule and the rights to which
`
`this mark is are entitled do not extend to bar the registration of applicant’s mark for
`
`the goods identified in its application.
`
`In conclusion, the differences in the marks assure that there will be no
`
`likelihood of confusion as to the source of the Applicant's goods. Accordingly,
`
`there should be no refusal to register under Section 2(d).
`
`Descriptiveness
`
`In order to overcome the refusal to register under Section 2(e)(1), the
`
`applicant
`
`intends to seek transfer of this application to the Supplemental
`
`Register. The applicant submits that the subject design mark is capable of
`
`distinguishing the applicant's goods and thus is eligible for registration on the
`
`Supplemental Register as per Section 23 of the Lanham Act.
`
