`show that the applied-for mark is being used on goods in the nature of smartwatches.(cid:160) The applicant has annotated the specimens to show that the
`goods include a feature that tracks and monitors heart rate.(cid:160) However, this is not sufficient to show that the applied-for mark is being used on the
`identified goods of general wellness apparatus and devices.(cid:160) The specimen rather shows that the mark is being used on smartwatches which
`incorporate a health monitoring feature.(cid:160) The goods shown on the specimen are not in the nature of a general apparatus or device but are rather
`specific goods in the nature of smartwatches.(cid:160) Thus, the specimen fails to show the applied-for mark in use in commerce with the identified goods
`in Class 10 because it rather shows different goods in Class 9.
