`
`PRIORITY ACTION
`
`STRICT DEADLINE TO RESPOND TO THIS LETTER
`TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO
`MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS
`OF THE ISSUE/MAILING DATE BELOW.
`
`(cid:160)I
`
`SSUE/MAILING DATE: 2/6/2013
`
`(cid:160)(cid:160)
`DATABASE SEARCH:(cid:160) The trademark examining attorney has searched the USPTO’s database of
`registered and pending marks and has found no similar registered marks that would bar registration under
`Trademark Act Section 2(d).(cid:160) TMEP §704.02; see 15 U.S.C. §1052(d).(cid:160) However, a mark in a prior-filed
`pending application may present a bar to registration of applicant’s mark, as discussed in the first section
`of this letter.
`
`(cid:160)
`(cid:160)
`
`
`ISSUE(S) APPLICANT MUST ADDRESS:(cid:160) On February 6, 2013, the trademark examining attorney
`and Katharine F. Rowe discussed the issues below.(cid:160) Applicant must timely respond to the classification
`issue discussed in the second section of this letter.(cid:160) See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP
`§§708, 711.
`
`(cid:160)(cid:160)(cid:160)
`
`Potentially Conflicting Mark in Earlier-Filed Application – For Applicant’s Information At This
`Time
`
`(cid:160)I
`
`nformation regarding pending Application Serial No. 85671925 (for the mark BATH SALT LIFE for
`clothing products) is enclosed.(cid:160) The filing date of the referenced application precedes applicant’s filing
`date.(cid:160) There may be a likelihood of confusion between the two marks under Trademark Act Section 2(d),
`15 U.S.C. §1052(d).(cid:160) If the referenced application registers, registration may be refused in this case under
`Section 2(d).(cid:160) 37 C.F.R. §2.83; TMEP §§1208 et seq.(cid:160) Therefore, upon entry of a response to this Office
`action, action on this case may be suspended pending final disposition of the earlier-filed application.
`
`(cid:160)A
`
`s discussed by the parties in their telephone conference, a non-final Section 2(d) refusal has been issued
`in connection with the earlier-filed application based on applicant’s prior registrations for clothing
`products, and it is thus expected that the cited application will be abandoned.(cid:160) Applicant is encouraged to
`monitor the status of the earlier-filed application and to contact the examining attorney immediately if
`
`updated Office records indicate that it has abandoned.(cid:160)(cid:160)(cid:160)
`
`Classification of Services – Requirements for Multi-Class Application
`
`(cid:160)T
`
`he identification of services in the application currently reads as follows:(cid:160) “Online retail store services
`and retail store services featuring clothing, decals, sports and outdoor living related merchandise; social
`media services, namely, the provision of interactive forums in which users may exchange information,
`recordings, videos, and photographs about outdoor-related activities.” (cid:160) Applicant has classified these
`services in Class 35.
`
`(cid:160)T
`
`he wording in the identification is acceptably definite.(cid:160) However, the services are classified in two
`different classes – with retail store services in Class 35, while the interactive forum services are separately
`classified in Class 38 with other communications services.(cid:160) It is noted in this regard that applicant used
`the same wording to identify its services in a pending companion application for the mark LIVE THE
`SALT LIFE (Serial No. 85658203, scheduled for publication on March 5, 2013), and properly added
`
`Class 38 to cover the interactive forum services.(cid:160)(cid:160)
`
`Accordingly, applicant must either:(cid:160) (1) restrict the application to the number of classes covered by the
`
`fee(s) already paid; or (2) submit the fees for the additional class(es).(cid:160)(cid:160)
`
`For an application with more than one international class, called a “multiple-class application,” an
`applicant must meet all the requirements below for those international classes based on use in commerce:
`
`(1)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`LIST SERVICES BY INTERNATIONAL CLASS:(cid:160) Applicant must list the services by
`international class.
`
`(2)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`PROVIDE FEES FOR ALL INTERNATIONAL CLASSES:(cid:160) Applicant must submit an
`
`(cid:160)
`(cid:160)
`
`
`application filing fee for each international class of services not covered by the fee(s) already
`paid (confirm current fee information at http://www.uspto.gov/trademarks/tm_fee_info.jsp).
`
`(3)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`SUBMIT REQUIRED STATEMENTS AND EVIDENCE:(cid:160) For each international class of
`services, applicant must also submit the following:
`
`(a)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`(b)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`(c)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`(d)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`DATES OF USE:(cid:160) Dates of first use of the mark anywhere and dates of first use of the
`mark in commerce, or a statement that the dates of use in the initial application apply to
`that class.(cid:160) The dates of use, both anywhere and in commerce, must be at least as early as
`the filing date of the application.
`
`SPECIMEN:(cid:160) One specimen showing the mark in use in commerce for each international
`class of services.(cid:160) Applicant must have used the specimen in commerce at least as early as
`the filing date of the application.(cid:160) Examples of specimens for services are signs,
`photographs, brochures, website printouts, or advertisements that show the mark used in
`the actual sale or advertising of the services.(cid:160) See TMEP §§1301.04 et seq.
`
`STATEMENT:(cid:160) The following statement:(cid:160) “ The specimen was in use in commerce on
`or in connection with the services listed in the application at least as early as the
`filing date of the application.”
`
`VERIFICATION:(cid:160) Applicant must verify the statements in 3(a) and 3(c) (above) in an
`affidavit or signed declaration under 37 C.F.R. §2.20.(cid:160) Verification is not required
`where: (1) the dates of use for the added class are stated to be the same as the dates of
`use specified in the initial application; and (2) the original specimens are acceptable for
`the added class(es).
`
`(cid:160)S
`
`ee 15 U.S.C. §§1051(a), 1112, 1127; 37 C.F.R. §§2.32(a)(5), 2.34(a)(1), 2.56(a), 2.71(c), 2.86(a),
`2.193(e)(1); TMEP §§1403.01, 1403.02(c).
`
`(cid:160)W
`
`ith respect to the specimen requirement in 3(b) above in which a specimen is required for each
`international class of services, please note that the specimens of record are acceptable for
`International Class 35 only – with the website pages clearly showing use of the mark with the online
`retail store services, but containing no references to the Class 38 online forum services.(cid:160) Accordingly,
`applicant must submit an additional specimen if Class 38 is added to the application.
`
`As indicated earlier in this letter, if the earlier-filed application for the potentially conflicting mark is still
`pending when applicant responds to this Office to resolve the classification issue, then the examining
`attorney will suspend further action on this application pending the disposition of the prior application.
`
`(cid:160)T
`
`he examining attorney appreciates the applicant’s assistance in discussing the above issues. (cid:160) If applicant
`has any questions or needs assistance in responding to this Priority Office action, please telephone the
`examining attorney.(cid:160)
