`The Examiner has maintained the refusal to register the subject mark based on potential confusion with
`the marks in registration nos. 3419526 for KO PRIME for restaurant and bar services in Class 43 and
`4312271 for the mark KO JA KITCHEN for mobile restaurant services, providing food and drink and
`bar services, also in Class 43 but both owned by different entities.(cid:160)(cid:160)(cid:160) Applicant continues its
`disagreement with this refusal.(cid:160) Applicant notes that not only did the KO PRIME and KO JA KITCHEN
`both register over priority filed CHINA KO (RN 3179544 filing date 12/3/03), but that KO OLINA
`RESORT & MARINA (RN 3511155, exclusive rights to “Resort and Marina” disclaimed), PRIME
`GRILL KO ( RN 3966528, a nearly identical mark to KO PRIME for the same services owned by a
`third party), KO OLINA (RN 4153554) and most significantly MOMOFUKU KO (RN 4312535 which
`is owned by applicant MomoIP LLC) have all registered over KO PRIME.(cid:160)(cid:160) More significantly, a
`Notice of Allowance has issued for the mark UMAMI KO (SN 85/398570) and the mark MISS KO (SN
`85/848,182), both also for restaurant services, and both owned by different entities.(cid:160) A copy of each of
`the referenced registrations and applications is attached to this response.(cid:160) All of these co-allowed and
`registered marks all owned by non-related third parties leads to the conclusion that the scope of
`protection afforded to the term KO is limited and carries little trademark significance. (cid:160)
`
`Applicant wishes again to remind the Examiner that the subject mark consists primarily and most
`significantly of its registered and unique peach logo (RN 3637913) in conjunction with the small word
`KO.(cid:160) Applicant has used the peach logo consistently in connection with its restaurant for over 10 years
`since 2004.(cid:160) It appears on the homepage of applicant’s website in addition in connection with each of
`its restaurant names, even in Canada and Australia.(cid:160) It is also consistently used on applicant’s website
`header (the identity of which appears in the user’s toolbar), business cards, menus, licensed products
`and cookbook.(cid:160) [With its quarterly magazine, LUCKY PEACH, applicant also references the connection
`

`
`between it and the peach logo.](cid:160) The peach reference is inherently tied to applicant and the
`MOMOFUKU empire.(cid:160) Momofuku roughly translates into “lucky peach” which is why applicant
`claimed ownership to RN 4098985.(cid:160) Consumers have come to identify applicant as the source of its
`services through use of the peach logo alone.(cid:160) Its use with the word KO renders any confusion with the
`marks KO PRIME or KO JA KITCHEN insignificant.
`
`Due to the significant consumer recognition of the peach logo, its prominent usage in connection with
`the word KO, the other co-existing KO-combination marks and the dilution of said KO term, the refusal
`to registration based on RNs 3419526 and 4312271 should be removed and Peach Logo & KO should
`be allowed to proceed to publication
