`software; software downloadable via the internet or mobile phone applications for monitoring and tracking blood glucose levels,” “blood
`glucose monitors, lancets and control solutions; insulin injectors sold empty; asthma inhalers for medical and therapeutic use sold empty;
`diagnostic apparatus for medical purposes; radiological apparatus for medical purposes, radiological screens for medical purposes; surgical
`and medical apparatus and instruments in the field of ophthalmology and eye care; artificial eyes; suture materials,” “printed matter, namely,
`newsletters, magazines, journals, periodicals, pamphlets, books and posters, all related to health matters,” “business development and
`marketing services in the field of health care; organizing sales promotions and consulting in the field of sales promotions for the

`Registrant’s marks are SLEEP SOLUTIONS FROM SANOFI-SYNTHELABO and design for use in connection with “providing online
`information in the field of sleep disorders” (2914483); and SANOFI AVENTIS and design for use in connection with “chemicals for use in the
`manufacture of pharmaceuticals or cosmetics,” “non-medicated skin care preparations; body soaps; toothpaste,” “house mark for a full line of
`pharmaceuticals and pharmaceutical preparations,” “surgical and medical apparatus and instruments for use in the field of oncology and
`cardiology, namely, syringes for medical use and urethral catheters,” “electronic delivery of text, images and photographs; providing online chat
`rooms for transmission of messages among computer users in the field of pharmaceutical and medical developments,” “providing medical
`research assistance to medical researchers; rental of laboratory equipment; biological, pharmaceutical and medical research; medical and
`scientific research, namely, conducting clinical research; hosting of web sites of others on the Internet in the field of medical and pharmaceutical
`information” (3114466).

`well established that the mere deletion of wording from a registered mark may not be sufficient to overcome a likelihood of confusion.(cid:160) See In re
`Mighty Leaf Tea, 601 F.3d 1342, 94 USPQ2d 1257 (Fed. Cir. 2010); In re Optica Int’l , 196 USPQ 775, 778 (TTAB 1977); TMEP
`§1207.01(b)(ii)-(iii).(cid:160) Applicant’s mark does not create a distinct commercial impression because it contains the same common wording as
`registrant’s mark, and there is no other wording to distinguish it from registrant’s mark.

`he goods and/or services of the parties need not be identical or directly competitive to find a likelihood of confusion.(cid:160) See Safety-Kleen Corp. v.
