`

`

`(cid:160)I
`
`SSUES APPLICANT MUST ADDRESS:(cid:160) On September 26, 2011, the trademark examining attorney and SUSAN UPTON DOUGLASS
`discussed the issues below.(cid:160) Applicant must timely respond to these issues.(cid:160) See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.

`
`RELIMINARY AMENDMENT
`
`(cid:160)T
`
`he Preliminary Amendment, which is a translation of the French Registration(cid:160) is acceptable and has been entered into the record.(cid:160)(cid:160)
`SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION
`
`Registration of the applied-for mark is refused because of a likelihood of confusion with the marks in U.S. Registration Nos. 2914483 and
`3114466.(cid:160) Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq.(cid:160) See the enclosed registrations.
`
`(cid:160)T
`
`rademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered mark that it is likely that a potential consumer
`would be confused or mistaken or deceived as to the source of the goods and/or services of the applicant and registrant.(cid:160) See 15 U.S.C. §1052(d).(cid:160)
`The court in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973) listed the principal factors to be considered
`when determining whether there is a likelihood of confusion under Section 2(d).(cid:160) See TMEP §1207.01.(cid:160) However, not all of the factors are
`necessarily relevant or of equal weight, and any one factor may be dominant in a given case, depending upon the evidence of record.(cid:160) In re
`Majestic Distilling Co., 315 F.3d 1311, 1315, 65 USPQ2d 1201, 1204 (Fed. Cir. 2003); see In re E. I. du Pont, 476 F.2d at 1361-62, 177 USPQ at
`567.
`
`(cid:160)I
`
`n this case, applicant seeks to register the mark SANOFI for use in connection with “non-medicated skin care preparations; cosmetics; skin
`soaps and skin cleansers,” “house mark for a full line of pharmaceuticals and healthcare preparations,” “computer software for database
`management in the field of pharmaceutical and medical developments; CD-ROMs featuring health care information; medical imaging
`software; software downloadable via the internet or mobile phone applications for monitoring and tracking blood glucose levels,” “blood
`glucose monitors, lancets and control solutions; insulin injectors sold empty; asthma inhalers for medical and therapeutic use sold empty;
`diagnostic apparatus for medical purposes; radiological apparatus for medical purposes, radiological screens for medical purposes; surgical
`and medical apparatus and instruments in the field of ophthalmology and eye care; artificial eyes; suture materials,” “printed matter, namely,
`newsletters, magazines, journals, periodicals, pamphlets, books and posters, all related to health matters,” “business development and
`marketing services in the field of health care; organizing sales promotions and consulting in the field of sales promotions for the
`pharmaceutical industry,” “educational services, namely, providing conferences, seminars and workshops in the field of health care and
`pharmaceutical developments; publishing magazines, books, guides and databases in the field of medicine and pharmaceuticals; on-line
`journals, namely, blogs in the field of health care,” “medical and scientific research, namely, conducting clinical trials; providing medical
`
`research and scientific research information in the field of pharmaceuticals,” and “providing medical information.” (cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Registrant’s marks are SLEEP SOLUTIONS FROM SANOFI-SYNTHELABO and design for use in connection with “providing online
`information in the field of sleep disorders” (2914483); and SANOFI AVENTIS and design for use in connection with “chemicals for use in the
`manufacture of pharmaceuticals or cosmetics,” “non-medicated skin care preparations; body soaps; toothpaste,” “house mark for a full line of
`pharmaceuticals and pharmaceutical preparations,” “surgical and medical apparatus and instruments for use in the field of oncology and
`cardiology, namely, syringes for medical use and urethral catheters,” “electronic delivery of text, images and photographs; providing online chat
`rooms for transmission of messages among computer users in the field of pharmaceutical and medical developments,” “providing medical
`research assistance to medical researchers; rental of laboratory equipment; biological, pharmaceutical and medical research; medical and
`scientific research, namely, conducting clinical research; hosting of web sites of others on the Internet in the field of medical and pharmaceutical
`information” (3114466).
`
`(cid:160)A
`
`s discussed below, the following factors are the most relevant here:(cid:160) similarity of the marks, similarity of the goods and/or services, and
`similarity of trade channels of the goods and/or services.(cid:160) See In re Opus One, Inc., 60 USPQ2d 1812 (TTAB 2001); In re Dakin’s Miniatures
`Inc., 59 USPQ2d 1593 (TTAB 1999); In re Azteca Rest. Enters., Inc., 50 USPQ2d 1209 (TTAB 1999); TMEP §§1207.01 et seq.
`
`(cid:160)I
`
`n a likelihood of confusion determination, the marks are compared for similarities in their appearance, sound, meaning or connotation and
`commercial impression.(cid:160) In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973); TMEP §1207.01(b).(cid:160)
`Similarity in any one of these elements may be sufficient to find a likelihood of confusion.(cid:160) In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB
`1988); In re Lamson Oil Co., 6 USPQ2d 1041, 1043 (TTAB 1987); see TMEP §1207.01(b).
`
`(cid:160)H
`
`ere, the marks share the dominant and arbitrary term SANOFI resulting in marks that are confusingly similar in commercial impression.(cid:160) It is
`well established that the mere deletion of wording from a registered mark may not be sufficient to overcome a likelihood of confusion.(cid:160) See In re
`Mighty Leaf Tea, 601 F.3d 1342, 94 USPQ2d 1257 (Fed. Cir. 2010); In re Optica Int’l , 196 USPQ 775, 778 (TTAB 1977); TMEP
`§1207.01(b)(ii)-(iii).(cid:160) Applicant’s mark does not create a distinct commercial impression because it contains the same common wording as
`registrant’s mark, and there is no other wording to distinguish it from registrant’s mark.
`
`(cid:160)T
`
`he goods and/or services of the parties need not be identical or directly competitive to find a likelihood of confusion.(cid:160) See Safety-Kleen Corp. v.
`
`

`

`Dresser Indus., Inc., 518 F.2d 1399, 1404, 186 USPQ 476, 480 (C.C.P.A. 1975); TMEP §1207.01(a)(i).(cid:160) Rather, they need only be related in
`some manner, or the conditions surrounding their marketing are such that they would be encountered by the same purchasers under
`circumstances that would give rise to the mistaken belief that the goods and/or services come from a common source.(cid:160) In re Total Quality Group,
`Inc., 51 USPQ2d 1474, 1476 (TTAB 1999); TMEP §1207.01(a)(i); see, e.g., On-line Careline Inc. v. Am. Online Inc., 229 F.3d 1080, 1086-87,
`56 USPQ2d 1471, 1475-76 (Fed. Cir. 2000); In re Martin’s Famous Pastry Shoppe, Inc. , 748 F.2d 1565, 1566-68, 223 USPQ 1289, 1290 (Fed.
`Cir. 1984).
`
`(cid:160)H
`
`ere, the goods and services are highly related, identical in part, and travel in the same trade channels.
`
`Although applicant’s mark has been refused registration, applicant may respond to the refusal(s) by submitting evidence and arguments in
`support of registration.
`
`(cid:160)I
`
`f the marks in the cited registrations have been assigned to applicant, applicant can provide evidence of ownership of the marks by satisfying one
`of the following:
`
`(1)(cid:160) Record the assignment with the Office’s Assignment Services Branch (ownership transfer documents such as assignments can be
`filed online at http://etas.uspto.gov) and promptly notify the trademark examining attorney that the assignment has been duly recorded;
`
`(2)(cid:160) Submit copies of documents evidencing the chain of title; or
`
`(3)(cid:160) Submit the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20:(cid:160) “Applicant is the owner of
`
`U.S. Registration Nos. 2914483 and 3114466.” (cid:160)(cid:160)
`
`TMEP §812.01; see 15 U.S.C. §1060; 37 C.F.R. §§2.193(e)(1), 3.25, 3.73; TMEP §502.02(a).
`
`(cid:160)M
`
`erely recording a document with the Assignment Services Branch does not constitute a response to an Office action.(cid:160) TMEP §503.01(d).
`
`Applicant must respond to the requirement(s) set forth below.
`
`(cid:160)C
`
`HANGE OF NAME DOCUMENT MUST BE TRANSLATED -- THIS PARTIAL REFUSAL APPLIES TO CLASSES 9, 10, 16, 41, 42
`AND 44 ONLY
`
`(cid:160)U
`
`nder Section 44(e), an applicant must be the owner of the foreign application or registration on the filing date of the U.S. application.(cid:160) TMEP
`§1005; see 37 C.F.R. §2.34(a)(3); In re De Luxe, N.V., 990 F.2d 607, 26 USPQ2d 1475 (Fed. Cir. 1993); In re Tong Yang Cement Corp., 19
`USPQ2d 1689 (TTAB 1991).(cid:160) However, in this case, the foreign registration specifies an owner other than the U.S. applicant.(cid:160) Specifically, the
`U.S. application specifies the owner as Sanofi, while the foreign registration specifies the owner as Sanofi-Aventis.
`
`(cid:160)I
`
`f applicant can prove the foreign registration was assigned to applicant on or before the filing date of the U.S. application, the Section 44(e)
`basis can remain in the application.(cid:160) TMEP §1005.(cid:160) Applicant has submitted a certified copy or certification from the foreign trademark office
`that reflects applicant’s ownership of the foreign registration and the date of the assignment/change of name, or evidence that the foreign
`registration was assigned to applicant on or before the filing date of the U.S. application.(cid:160) See TMEP §§1005, 1006.(cid:160) However, is not written in
`English, therefore, applicant must also provide an English translation.(cid:160) The translation should be signed by the translator.(cid:160) See TMEP
`§1004.01(b).
`
`(cid:160)I
`
`f applicant did not own the foreign registration on or before the filing date of the U.S. application, applicant may respond by substituting the
`basis for registration from Section 44(e) to Section 1(a) or 1(b), if applicant can satisfy the requirements for the new basis.(cid:160) See 15 U.S.C.
`§§1051(a)-(b), 1126(e); TMEP §806.03.(cid:160) A foreign registration certificate is not required for a Section 1(a) or 1(b) basis.(cid:160) See 15 U.S.C.
`§1051(a)-(b); TMEP §806.01(a)-(b).
`
`(cid:160)F
`
`OREIGN REGISTRATION CERTIFICATE OF RENEWAL MUST BE TRANSLATED(cid:160) -- THIS PARTIAL REQUIREMENT
`APPLIES TO CLASSES 3 AND 5 ONLY
`
`Applicant has provided a certificate of renewal or other certification from the intellectual property office of the foreign country that shows that
`the foreign registration has been renewed and will be in force at the time the registration issues in the United States.(cid:160) 37 C.F.R. §2.34(a)(3)(iii);
`TMEP §1004.01(a).(cid:160) However, the certificate of renewal is not written in English, therefore, applicant must also provide an English translation.(cid:160)
`See 37 C.F.R. §2.34(a)(3)(iii); TMEP §1004.01(a)-(b).(cid:160) The translation should be signed by the translator.(cid:160) See TMEP §1004.01(b).
`
`(cid:160)H
`
`OUSE MARK REQUEST UNACCEPTABLE -- THIS PARTIAL REQUIREMENT APPLIES TO CLASS 5 ONLY
`
`(cid:160)A
`
`pplicant’s request for registration of a “house mark” is unacceptable because it does not include evidence of use of the mark as a house mark,
`i.e., on a wide range of goods.(cid:160) See TMEP §1402.03(b).(cid:160)
`
`(cid:160)
`(cid:160)
`(cid:160)
`(cid:160)
`(cid:160)
`(cid:160)
`

`

`(cid:160)T
`
`herefore, applicant must provide evidence that shows use of the mark as a house mark.(cid:160) Such evidence may consist of product catalogs or
`
`similar evidence showing broad use of the mark.(cid:160) TMEP §1402.03(b); see 37 C.F.R. §2.61(b).(cid:160)(cid:160)
`
`If applicant is unable to provide such evidence, applicant must amend the identification to delete “house mark for” and specify the common
`commercial or generic name for each item.(cid:160) See TMEP §§1402.01, 1402.03(b).
`
`(cid:160)I
`
`DENTIFICATION OF GOODS -- THIS PARTIAL REQUIREMENT APPLIES TO CLASS 5 ONLY
`
`(cid:160)T
`
`he following wording in the identification of goods in the U.S. application is unacceptable because it exceeds the scope of the goods in the
`foreign application or registration:(cid:160) “house mark for a full line of . . . healthcare preparations.” (cid:160) See 37 C.F.R. §2.32(a)(6).(cid:160) Applicant may
`change this wording to “full line of veterinary preparations and sanitary preparations for medical use,” if accurate. (cid:160) See TMEP §1402.01.
`
`(cid:160)T
`
`herefore, applicant must either:
`
`(1)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`(2)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Amend the identification of goods and/or services in the U.S. application to correspond to the goods and/or services in the foreign
`application or registration, ensuring that all goods and/or services beyond the scope of the foreign application or registration are
`deleted from the U.S. application; or
`
`Delete the Trademark Act Section 44 basis for the goods and/or services beyond the scope of the foreign application or registration
`and substitute a basis under Section 1(a) or 1(b) for those goods and/or services.
`
`(cid:160)S
`
`ee 15 U.S.C. §§1051(a)-(b), 1126; 37 C.F.R. §§2.32(a)(6), 2.34(b), 2.35(b); Marmark Ltd. v. Nutrexpa S.A., 12 USPQ2d 1843, 1845 (TTAB
`1989); TMEP §§806.02, 806.03(h), 1402.01(b).
`
`(cid:160)A
`
`n applicant may assert more than one basis in an application, provided that the applicant satisfies all requirements for each basis claimed.(cid:160) 37
`C.F.R. §2.34(b)(1); TMEP §806.02(a).(cid:160) If applicant asserts different bases in the same application, applicant must clearly state that more than
`one basis is being claimed, and must separately list each basis, followed by the goods and/or services to which that basis applies.(cid:160) If some or all
`of the goods and/or services are covered by more than one basis, this must also be expressly stated.(cid:160) 37 C.F.R. §§2.34(b)(2), 2.35(b)(6).
`
`(cid:160)A
`
`lthough multi-basis applications are permitted, applicant may not assert both use in commerce under Section 1(a) and intent to use under
`Section 1(b) for the same goods or services.(cid:160) 37 C.F.R. §2.34(b)(1); TMEP §806.02(b).
`
`(cid:160)C
`
`LAIM OF OWNERSHIP OF REGISTRATIONS
`
`(cid:160)I
`
`f applicant is the owner of U.S. Registration Nos. 2914521, 3174254, 4011299 and others, then applicant must submit a claim of ownership.(cid:160) See
`37 C.F.R. §2.36; TMEP §812.(cid:160) The following standard format is suggested:
`
`Applicant is the owner of U.S. Registration Nos. 2914521, 3174254, 4011299 and others.
`
`(cid:160)I
