`In response to the Office Action dated October 4, 2010, Applicant respectfully submits the following.
`
`1.(cid:160)(cid:160) (cid:160) The Mark Creates a Separate Commercial Impression That Serves to Identify A Series of Creative Works
`
`(cid:160)(cid:160) (cid:160)(cid:160)(cid:160)(cid:160) The Examiner refused registration of Applicant’s G.I. JOE mark on the ground that, based on the specimen of record, the mark is used
`only as a portion of a title of a single creative work.(cid:160) In response, Applicant respectfully submits that the mark is used to identify and
`distinguish the source of a series of creative works, and as such is registrable.(cid:160) Submitted herewith as Exhibit 1 is evidence that the mark is
`used on a series of comic books.(cid:160) The evidence consists of copies of the covers of two additional comic books in the G.I. JOE series with the
`mark used in all the titles.(cid:160) TMEP § 1202.08(d)(ii).
`
`(cid:160)(cid:160) (cid:160)(cid:160)(cid:160)(cid:160) The comic book covers depicted in Exhibit 1, along with the comic book cover in the original specimen, show that the G.I. JOE portion of
`the title clearly functions as a trademark to identify and distinguish applicant’s goods and to indicate the source of applicant’s goods. The G.I.
`JOE portion of the title creates a separate commercial impression apart from the complete title.(cid:160) It is prominently displayed at the top of the
`cover, on a separate line and in a larger, bolder, and different type style than the words below it.(cid:160) The G.I. JOE portion also includes a design
`element (star and bars) that are colored red and blue, further distinguishing and separating it from either the authors’ names above, or the
`subtitle of the series below, which are in a smaller, black and white type font.(cid:160) Under the In re Scholastic Inc. decision, these differences
`clearly serve to create a separate commercial impression of the G.I. JOE mark apart from the complete title, 23 USPQ2d 1774 (TTAB 1992);
`TMEP § 1202.08(d)(iii).

`(cid:160)(cid:160) (cid:160)(cid:160)(cid:160)(cid:160) In addition to the above, Applicant also is submitting evidence that the G.I. JOE portion of the mark is promoted and recognized as a
`trademark for the series.(cid:160) This evidence consists of pages from the publisher’s and retailers websites, as well as a fan site review and a
`GOOGLE search that show that Applicant’s comic book series, regardless of the subtitles, is consistently referred to as “G.I. JOE.”
`
`(cid:160)Exhibit 2: (cid:160) Applicant’s G.I. JOE comic books series is published by IDW Publishing.(cid:160) Exhibit(cid:160) 2 consists of pages from the IDW website,

`www.idwpublishing.com,(cid:160) which show that the G.I. JOE comic book series is clearly presented and promoted as “G.I. JOE.”(cid:160) The first page of
`the exhibit shows the home screen of the IDW website.(cid:160) One of the icons/images you can click on is labeled simply “G.I. JOE,” which brings
`you to the home page devoted to G.I. JOE publications (pages two and three of Exhibit 2).(cid:160) Finally, if you click on the “Buy G.I. Joe Comics
`and Books” link, it brings you to the home page of the G.I. JOE comic book series which shows 113 comic books in the G.I. JOE series, and
`allows you to browse by “Category” (i.e. such as the “ORIGINS” or “A REAL AMERICAN HERO” sub series).(cid:160) In all cases, the G.I. JOE
`portion of the mark is promoted as the mark for the comic book series.
`
`•(cid:160)(cid:160) (cid:160) Exhibit 3:(cid:160) Webpage from the online comic book retailer Graham Crackers Comic Books(cid:160) (www.grahamcrackers.com) showing the entire
`G.I. JOE series and referring to them all as “GI JOE COMIC BOOKS available for SALE!”

`•(cid:160)(cid:160) (cid:160) Exhibit 4: Results of a GOOGLE search for “G.I. JOE Comic Books” which show that use of the G.I. JOE portion of the mark turns up
`hundreds of links and references to the series known as “G.I. JOE Comic Books,” evidencing that the series mark is consistently perceived to
`be the G.I. JOE portion of the title.

`•(cid:160)(cid:160) (cid:160) Exhibit 5:(cid:160) Webpage from the G.I. JOE fan site “The Terror Drome” showing that the overall series of comic books is referred to the
`“G.I. JOE Comic Books Category.”(cid:160) In the text of the article, the author also refers to the series using the G.I. JOE portion of the title,
`informing readers that(cid:160) ‘in May, all of IDW’s G.I. Joe titles . . . will be restarted . . .”

`(cid:160)(cid:160) (cid:160)(cid:160)(cid:160) (cid:160)Applicant respectfully submits that the evidence supports the conclusion that the(cid:160) G.I. JOE portion of the title is promoted and recognized

`as the mark for Applicant’s comic book series, and as such is registrable.

`2.(cid:160)(cid:160) (cid:160)The Mark in the Specimen Is A Substantially Exact Representation of the Mark in the Drawing
`
`The Examining Attorney rejected Applicant’s specimen on the ground that it disagreed with the mark on the drawing because “the specimen
`displays the mark as G.I.JOE (with no spaces); and the drawing shows the mark as G.I. JOE (with a space between G.I. and JOE).”(cid:160) The mark
`on Applicant’s drawing, therefore,(cid:160) was not a substantially exact representation of the mark on the specimen.(cid:160)
`
`Applicant respectfully submits that the mark in the specimen does in fact agree with the mark in the drawing because the star that appears
`between the words “G.I.” and “JOE” creates a visual break or space.(cid:160) That the star successfully acts as a space between the words is
`evidenced by the fact that the mark as shown in the specimen is perceived by consumers as, in fact, creating such a space.(cid:160) In Exhibits 2
`through 5 submitted with this response, Applicant’s G.I. JOE mark as displayed in the specimen (with the star and bars) is widely used, and all
`references to the mark, when written in standard characters, include the space between the words.
`
`While Applicant could simply amend its drawing to remove the space between “G.I.” and “JOE” (and such an amendment would not be a
`material alteration, see,(cid:160) In re Innovative Companies, LLC, 88 USPQ2d 1095 (TTAB 2008) (amendment from “FREEDOMSTONE” to
`“FREEDOM STONE” held not a material alteration); Paris Glove of Canada, Ltd. v. SBC/Sportco Corp., 84 USPQ2d 1856, 1862 (TTAB
`2007) (“AQUASTOP” depicted on one line in semicircular form not material alteration of “AQUA STOP” depicted on two lines in
`rectangular form), TMEP § 807.14(f), it prefers to maintain a consistency with all of its other G.I. JOE trademark registrations, in which the
`words “G.I.” and “JOE” are always separated by a space.
`
`For the reasons stated above, Applicant respectfully submits that its G.I. JOE mark creates a separate commercial impression apart from the
`complete title, and is used to identify and distinguish the source of a series of creative works.(cid:160) In addition, the mark as displayed on the
`specimen agrees with the G.I. JOE mark in the drawing and is a substantially exact representation.(cid:160) Therefore, Applicant respectfully requests
`that the Examining Attorney reconsider her refusal and approve the mark for publication.
