`
`The referenced application has been reviewed by the assigned trademark examining attorney.(cid:160) Applicant must respond timely and completely to
`the issue(s) below.(cid:160) 15 U.S.C. §1062(b); 37 C.F.R. §§2.62, 2.65(a); TMEP §§711, 718.03.

`
`(cid:160)S
`
`IGNIFICANCE OF WORDING / DESCRIPTION OF MARK
`
`Applicant must specify whether “LOS DOYERS” in the mark has any meaning in a foreign language. (cid:160) See 37 C.F.R. §2.32(a)(9); TMEP §§809,
`
`814.(cid:160)(cid:160)
`If this wording has meaning in a foreign language, applicant must submit a statement translating the non-English wording in the mark.(cid:160) 37
`C.F.R. §2.32(a)(9); TMEP §809.(cid:160)(cid:160)
`
`The following format is acceptable for a translation statement:
`
`“The English translation of LOS DOYERS is The Dodgers.” (cid:160) .
`
`(cid:160)T
`
`MEP §809.03.
`
`(cid:160)I
`
`f this term has no meaning in a foreign language, applicant should provide the following statement:(cid:160) “The wording LOS DOYERS has no
`meaning in a foreign language.” (cid:160) Id.
`
`(cid:160)A
`
`pplicant must also specify whether the wording “LOS DOYERS” has any significance in the baseball sport or industry or as applied to the
`goods/services described in the application.(cid:160) See 37 C.F.R. §2.61(b); TMEP §§808.01(a), 814.(cid:160) As shown in the attached evidence, “doyers” is
`commonly used in the Hispanic community to pronounce the English word “dodgers”. (cid:160) To the extent that applicant claims that the word
`“doyers” or “los doyers” has no direct translation, then applicant must provide a description of the mark in the alternative to make clear the
`meaning.
`
`(cid:160)
`(cid:160)
`(cid:160)
`(cid:160)
`(cid:160)
`
`
`TMEP Section 808.01 sets forth guidelines for requiring a description, most relevantly, if a significant element of a mark is unclear or
`ambiguous.(cid:160) For example, this section provides that marks representing mathematical, electrical or other scientific concepts and legendary or
`historical symbols used to indicate ideas that are not well or commonly known should be described.(cid:160) Also, designs that present an object in a way
`that makes it difficult to immediately identify the object should be described.
`
`(cid:160)I
`
`n this instance, for purpose of providing public notice in the application or registration documents of the nature of the mark, where the wording
`as a whole is not immediately understood sufficiently to understand that the meaning of the term “doyers” is merely arbitrary, particularly in
`view of its conjunction with “los”, which is a foreign term with meaning, dictates that the nature of the mark must be described.
`
`(cid:160)H
`
`ence, the following is suggested:
`
`The mark consists of a phonetic hybrid of a foreign word and the pronunciation of the word “Dodgers”, in which “Los” may be
`translated to English as “the” and “Doyers” is a pronunciation of “Dodgers” in a Hispanic accent.
`
`TMEP §§808 et seq.
`
`(cid:160)I
`
`DENTIFICATION OF GOODS
`
`The identification of goods and/or services contains parentheses.(cid:160) Generally, parentheses and brackets should not be used in identifications.(cid:160)
`Parenthetical information is permitted in identifications only if it serves to explain or translate the matter immediately preceding the
`
`parenthetical phrase in such a way that it does not affect the clarity of the identification, e.g., “obi (Japanese sash).” (cid:160) TMEP §1402.12.(cid:160)(cid:160)
`
`Therefore, applicant must remove the parentheses from the identification of goods and/or services and incorporate the parenthetical information
`
`into the description.(cid:160)(cid:160)
`
`The wording “Halloween or masquerade costumes” in the identification of goods is indefinite and must be clarified because it includes “or .”
`An application must specify, in an explicit manner, the particular goods or services on or in connection with which the applicant uses, or has a
`bona fide intention to use, the mark in commerce.(cid:160) See 15 U.S.C. §1051(a)(2), (b)(2); 37 C.F.R. §2.32(a)(6); TMEP §1402.01.(cid:160) Generally, the
`terminology “and/or” and “or” is not sufficiently explicit language in identifications because it is not clear whether applicant is using the mark,
`
`or intends to use the mark, on all the identified goods or services.(cid:160) See TMEP §1402.03(a).(cid:160)(cid:160)
`
`For example, “modems and/or monitors” could be read to mean “modems or monitors” and thus it is unclear which goods applicant intends to
`identify.(cid:160) Applicant could amend the identification to “modems” alone, or “monitors” alone, or “modems and monitors” if applicable.
`Therefore, applicant should replace “and/or” with “and” in the identification of goods or services, if appropriate, or rewrite the identification
`
`with the “and/or” deleted and the goods or services specified using definite and unambiguous language. (cid:160)(cid:160)
`
`Applicant may substitute the following wording, if accurate:
`
`(cid:160)“
`
`Clothing, namely, headwear, shirts, sweaters, vests, bottoms, dresses, skirts, athletic uniforms, jerseys, underwear, undergarments, sleepwear,
`robes, swimwear, jackets, ponchos, wraps, infant wear, cloth bibs, ties, belts, footwear, socks, hosiery, scarves, gloves, mittens, and wristbands; (cid:160)
`Halloween and masquerade costumes” in International Class 25.
`
`(cid:160)T
`
`MEP §§1402.01 and 1402.03.
`
`(cid:160)A
`
`n applicant may amend an identification of goods only to clarify or limit the goods; adding to or broadening the scope of the goods is not
`
`permitted.(cid:160) 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.(cid:160)(cid:160)
`
`For assistance with identifying and classifying goods and/or services in trademark applications, please see the online searchable Manual of
`Acceptable Identifications of Goods and Services at http://tess2.uspto.gov/netahtml/tidm.html.(cid:160) See TMEP §1402.04.

`
`How much do the McCourt's really want to make offL.A. Dodger fans?
`Apparently, the sky's the limit.
`After hiking parking prices, trimming player payroll and blanketing
`Chavez Ravine with advertising logos, the Dodgers have found a new
`source ofincome -- local culture.
`
`For years, Hispanic Dodger fans have fondly called their Boys in Blue
`"Ln; Days-rs,"
`The phrase may go back -- way back -- to the way legendary Dodger
`Manny Mota pronounced his "Doyers."
`To no one's surprise, local entrepreneurs jumped on Los bandwagon.
`Manny Morales, owner ofLatin Lingo Clothing near Dodger Stadium
`said, "'I..os Doyers' is the way Latinos have always said, 'Dodgers.' Ask
`your mom or your grandma. You say, 'Dodgers,' and they repeat
`ba ck, 'Doyers."'
`Salvador Fonseca, a longtime Dodger fan, said he says "Los Doyers" all
`the time.
`
`"Especially with guys at work. They don't speak English. They use ‘Los
`Doyers' all the time," Fonseca said.
`But now Morales is frustrated.
`
`At his shop "Los Doyers" T-shirts andjerseys have been a popular
`item.
`
`But now he can't sell them anymore.
`The Dodgers decided to trademark the term and sent out cease and
`desist letters to anyone selling "Los Doyers" n1e1'cl1andise.
`"I don't think it's right," said Morales. "It's not right at all. It's not their
`saying, it belongs to the Latino people, that's the way we say it, that's
`our thing."
`Despite his frustration with Dodgers management, Morales is
`maintaining a sense ofhumor: "I don't know, is Wal-Mart going to
`trademark Welmart"? That's how my grandmother says it. So are they
`going to trademark 'Welmart'? Maybe I should get on it."

`and is selling T-shirts with
`the phrase on it for $30.
`"Los Doyers" has grown in popularity in recent years into a
`popular nickname that makes light at how some Mexican-
`American fans purposefully mispronounciate the team's name.
`I‘-shirts, hats and other apparel have been sold around the Los
`Angeles area for years, and former player and coach Manny
`Mota was said to have frequently used "Los Doyers"
`
`he blog "Vin Elcully is my homeboy" found the trademark and
`author Roberto Baly seems mildly perturbed by the Dodgers
`having taken a grassroots nickname and turned it corporate --
`not that they are the first to do such a thing.
`
`"Yesterday I asked my mom to say Dodgers. She said 'Doyers.'
`I asked my dad to say Dodgers. He said 'Dogers.‘ I guess
`Mexicans say 'Doyers' and Cubans say 'Dogers.' Maybe the
`Europeans pronounce it 'Dojers.' Shoud I trademark it? :3 "

`The Dodgers have come along way since Brooklyn. Having traded the Brooklyn trolleys for tho Dodger Stadium
`Express, the only thing LA Dodgerfans may be dodging in the neartuture may be search warrants from the
`anti-counterfeiting unit.
`The Dodgers continue to tit right into LA's diverse ethnic melting pot by applying for two federal marks in their
`affectionate, Latino-inflected nickname The story about the two marks was broken overthe
`weekend by Roberto Elaly otthe Dodger networked blog Vin Scully is My Homeboy. One is a trademark for
`goods ranging from sports apparel to Halloween costumes. The other is a service mark covering entertainment,
`educational services, fantasy leagues, sports events and news The team applied for both marks on August 10,
`2010
`
`is the phonetic spelling ofhowthe team name is
`Forthose not familiar with the nickname,
`pronounced with a Latino accent. Although it started in the streets, the alternate spelling has been embraced
`by mainstream fans across the board overthe past several years, with the nickname appearing on
`E shirts, homemade signs and body-panted fans at Dodger games.
`The Dodgers are not shy about splashy publicity moves, as befits the team representing the show biz capital of
`the world. Along with moving from Ebbetts Field to Chavez Ravine in 1950, and getting their own zip code for
`Dodgertown California in 2008, the legal play is very much in characterfor the Dodger's penchant for irreverent
`publicity stunts and sawy marketing moves. Manny Ramirez a Dodgerfor a couple seasons? No problem - lefi
`field is "Mannywood " Tough to sell seats in the upper deck? lfoila "Bleacher Beach "
`Applying forfederal trademarks is also consistent with Mayor League Baseball's traditionally robust intellectual
`property protection program. Contrary to some reports, the trademarks have not actually issued - they WBI‘BjLlSl
`applied for on August 18, 2010 "The trademark otfice doesn't move that fast," said Mary L. Kevlin, the New
`York attorney who tiled the registration on behalf ofthe "Doyers" with the U.S. Patent and Trademark Office.
`Everybody loves the "Doyers" nickname, but there are a range of reactions to the club's trademark application.
`Mario Flores, Managing Director otSportivo, a sports PR agency in Los Angeles, summed up his mixed
`feelings "I have 2 views of it," Flores said. "From a professional sports marketing view, it's a brilliant move by
`the team. They see the fans wearing the t-shirts - not only Latino fans, and notiust sports fans -- it's a kitschy
`thing. Its nice."
`But the home-grown Flores also has some ambivalence about going corporate. "Growing up in
`LA, that's the way it was said in my household. The t-shirts started in the streets, and snowballed from there."
`Part ofhim would like to see the t-shirts remain a staple of street vendors in Santee Alley and elsewhere, in
`keeping with the nickname's roots.
`In fact, the LA baseball Dodgers are not the first to apply for a trademark in "E." From June 2009 to
`March 2010, a U.S.-Mexico partnership between Frank Quezada and and Jaine Delgadillo had an application
`pendingfor
`" The application apparently expired of its own accord, leaving the mark open torthe
`Dodgers to apply. Perhaps nowthat the team seems to have taken a break from trying to win the Western
`Division, they had some time to go through the Trademark Ofiice records.

`
`Trademarks can ordinarily take between SIX months and a couple of years to issue, depending on whether the
`government lawyers find the mark distinctive and from an identifiable source. However. the Dodgers have begun
`efforts to secure their rights by requesting that at least one website cease and desist from selling
`t-shirts.
`It will be up to Uncle Sam to decide ifthe franchise will have the exclusive rights to sell
`merchandise and services. (No word on whetherthe team plans to sell "Doyers" bandanas. as the Quezada-
`Delgadillo application sought the "Doyers" mark for "bandanas." whereas the Dodgers did not)
`
`mark would undoubtedly see an increase in the sales price of
`Issuance and enforcement ofthe
`such merchandise. LAist purchaseda shirt earlierthis summer in Santee Alley for $5.
`if you‘re
`interested, you better get Downtown to scoop one up before the Fashion Umpires call toul The door is still
`open. however, for |»<-town, Armenian and other Dodgertans to trademark theirway otpronouncing the team‘s
`name.
