`The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to
`the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

`Section 2(d) Refusal
`
`Registration of the applied-for mark is refused because of a likelihood of confusion with the marks in U.S. Registration Nos. 2018872, 2445696,
`5110151, 2869627, and 2182721 . Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq. See the attached registrations.
`
`Trademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered mark that it is likely a potential consumer
`would be confused, mistaken, or deceived as to the source of the goods and/or services of the applicant and registrant. See 15 U.S.C. §1052(d).
`A determination of likelihood of confusion under Section 2(d) is made on a case-by-case basis and the factors set forth in In re E. I. du Pont de
`Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973) aid in this determination. Citigroup Inc. v. Capital City Bank Grp.,
`Inc., 637 F.3d 1344, 1349, 98 USPQ2d 1253, 1256 (Fed. Cir. 2011) (citing On-Line Careline, Inc. v. Am. Online, Inc., 229 F.3d 1080, 1085, 56
`USPQ2d 1471, 1474 (Fed. Cir. 2000)). Not all the du Pont factors, however, are necessarily relevant or of equal weight, and any one of the
`factors may control in a given case, depending upon the evidence of record. Citigroup Inc. v. Capital City Bank Grp., Inc., 637 F.3d at 1355, 98
`USPQ2d at 1260; In re Majestic Distilling Co., 315 F.3d 1311, 1315, 65 USPQ2d 1201, 1204 (Fed. Cir. 2003); see In re E. I. du Pont de
`Nemours & Co., 476 F.2d at 1361-62, 177 USPQ at 567.
`
`In this case, the following factors are the most relevant: similarity of the marks, similarity and nature of the goods and/or services, and
`similarity of the trade channels of the goods and/or services. See In re Viterra Inc., 671 F.3d 1358, 1361-62, 101 USPQ2d 1905, 1908 (Fed. Cir.

`Marks are compared in their entireties for similarities in appearance, sound, connotation, and commercial impression. Stone Lion Capital
`Partners, LP v. Lion Capital LLP, 746 F.3d 1317, 1321, 110 USPQ2d 1157, 1160 (Fed. Cir. 2014) (quoting Palm Bay Imps., Inc. v. Veuve
`Clicquot Ponsardin Maison Fondee En 1772, 396 F.3d 1369, 1371, 73 USPQ2d 1689, 1691 (Fed. Cir. 2005)); TMEP §1207.01(b)-(b)(v).
`“Similarity in any one of these elements may be sufficient to find the marks confusingly similar.” In re Davia, 110 USPQ2d 1810, 1812 (TTAB
`2014) (citing In re 1st USA Realty Prof’ls, Inc. , 84 USPQ2d 1581, 1586 (TTAB 2007)); In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB
`1988)); TMEP §1207.01(b).
`
`Applicant’s mark is SUNRICH with a design. The registered marks are SUN-RICH TOMATO with design, SUNRICH, SUNRICH
`NATURALS, SUNRICH NATURALS, and SUN RICH.
`
`For a composite mark containing both words and a design, the word portion may be more likely to indicate the origin of the goods and/or
`services because it is that portion of the mark that consumers use when referring to or requesting the goods and/or services. Bond v. Taylor, 119
`USPQ2d 1049, 1055 (TTAB 2016) (citing In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908, 1911 (Fed. Cir. 2012)); TMEP
`§1207.01(c)(ii). Thus, although such marks must be compared in their entireties, the word portion is often considered the dominant feature and
`is accorded greater weight in determining whether marks are confusingly similar, even where the word portion has been disclaimed. In re
`Viterra Inc., 671 F.3d at 1366-67, 101 USPQ2d at 1911 (citing Giant Food, Inc. v. Nation’s Foodservice, Inc., 710 F.2d 1565, 1570-71, 218
`USPQ2d 390, 395 (Fed. Cir. 1983)).
`
`In the present case, the sole wording in the applicant’s mark is SUNRICH. This wording is identical to the primary and dominant wording in
`each of the registered marks. The difference with other wording or spacing would not alter the consumer commercial impression that
`applicant’s mark was connected to any of the registered marks. The dominant term in the marks are essentially phonetic equivalents and thus
`sound similar. Similarity in sound alone may be sufficient to support a finding that the marks are confusingly similar. In re White Swan Ltd., 8
`USPQ2d 1534, 1535 (TTAB 1988); see In re 1st USA Realty Prof’ls, Inc., 84 USPQ2d 1581, 1586 (TTAB 2007); TMEP §1207.01(b)(iv).
`Consumers would use and recall the same sounding term, “SUNRICH,” when calling for the goods.
`
`The goods and/or services of the parties need not be identical or even competitive to find a likelihood of confusion. See On-line Careline Inc. v.
`Am. Online Inc., 229 F.3d 1080, 1086, 56 USPQ2d 1471, 1475 (Fed. Cir. 2000); Recot, Inc. v. Becton, 214 F.3d 1322, 1329, 54 USPQ2d 1894,
`1898 (Fed. Cir. 2000) (“[E]ven if the goods in question are different from, and thus not related to, one another in kind, the same goods can be
`
`related in the mind of the consuming public as to the origin of the goods.”); TMEP §1207.01(a)(i).
`
`The respective goods and/or services need only be “related in some manner and/or if the circumstances surrounding their marketing [be] such
`that they could give rise to the mistaken belief that [the goods and/or services] emanate from the same source.” Coach Servs., Inc. v. Triumph
`Learning LLC, 668 F.3d 1356, 1369, 101 USPQ2d 1713, 1722 (Fed. Cir. 2012) (quoting 7-Eleven Inc. v. Wechsler, 83 USPQ2d 1715, 1724
`(TTAB 2007)); TMEP §1207.01(a)(i).
`
`Applicant’s goods are “Grasses [plants]; seedlings; flowers [natural]; dried flowers; seeds and bulbs; bulbs; seeds of plants; seeds for
`horticultural purposes; oil seeds; vegetables [fresh].”
`
`The first registrant’s goods are “fresh produce, namely tomatoes.” The second registrant’s goods include “Unprocessed soybeans and
`specialty grains for eating,” “Dairy-based food beverages; Dairy-based beverages; Soy milk; Frozen vegetables; Nut and seed-based snack bars;
`Soy-based food bars; Vegetable-based raw food bars; Nut-based snack foods; Roasted nut and seed snacks; Roasted nuts; Broth; Mixes for
`making broth; Soups; Soup mixes;” and “frozen vegetables, namely, soybeans.” The third registrant’s goods are “fresh cut fruit and fruit
`salads, namely, fruit segments/chunks of cantaloupe, honeydew, oranges, grapefruit, pineapple, grapes and lemons packaged in bags or pails with
`or without a sugar/water solution which may contain preservatives.”
`
`With respect to applicant’s and registrant’s goods and/or services, the question of likelihood of confusion is determined based on the
`description of the goods and/or services stated in the application and registration at issue, not on extrinsic evidence of actual use. See Stone Lion
`Capital Partners, LP v. Lion Capital LLP, 746 F.3d 1317, 1323, 110 USPQ2d 1157, 1162 (Fed. Cir. 2014) (quoting Octocom Sys. Inc. v. Hous.
`
`Computers Servs. Inc., 918 F.2d 937, 942, 16 USPQ2d 1783, 1787 (Fed. Cir. 1990)).
`
`Absent restrictions in an application and/or registration, the identified goods and/or services are “presumed to travel in the same channels of
`trade to the same class of purchasers.” In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012) (quoting Hewlett-
`Packard Co. v. Packard Press, Inc., 281 F.3d 1261, 1268, 62 USPQ2d 1001, 1005 (Fed. Cir. 2002)). Additionally, unrestricted and broad
`identifications are presumed to encompass all goods and/or services of the type described. See In re Jump Designs, LLC, 80 USPQ2d 1370, 1374
`
`(TTAB 2006) (citing In re Elbaum, 211 USPQ 639, 640 (TTAB 1981)); In re Linkvest S.A., 24 USPQ2d 1716, 1716 (TTAB 1992).
`
`In this case, the identification set forth in the application and registration(s) has no restrictions as to nature, type, channels of trade, or classes of
`purchasers. Therefore, it is presumed that these goods and/or services travel in all normal channels of trade, and are available to the same class
`of purchasers. Further, the application use(s) broad wording to describe the goods and/or services and this wording is presumed to encompass all
`

`goods and/or services of the type described, including those in each registrant’s more narrow identification. Specifically, applicant’s fresh
`vegetables encompasses the first registrant’s fresh produce in the nature of tomatoes. The attached dictionary evidence informs that “soybean”
`refers to the seed of the soybean plant. Thus, applicant’s seeds and seedlings encompass the second registrant’s unprocessed soybeans.
`Applicant’s vegetables are overly broad, and thus, could encompass the second registrant’s frozen vegetables and frozen soybeans.
`Applicant’s seedlings and various seeds are related to the third registrant’s fresh fruit because applicant’s seeds could include fruit seeds for
`growing these specific fruits. Additionally, applicant’s fresh vegetables are related to the third registrant’s fresh fruits because these products
`are often produced and marketed by the same companies. The attached web page evidence shows that Dole, FreshDirect, FromtheFarmer, and
`
`Eosta market both fresh fruits and vegetables. Thus, consumers are accustomed to seeing these products offered through the same source.
`
`Where the goods and/or services of an applicant and registrant are “similar in kind and/or closely related,” the degree of similarity between the
`marks required to support a finding of likelihood of confusion is not as great as in the case of diverse goods and/or services. In re J.M. Originals
`Inc., 6 USPQ2d 1393, 1394 (TTAB 1987); see Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1242, 73 USPQ2d 1350, 1354 (Fed. Cir. 2004);
`TMEP §1207.01(b).
`
`The overriding concern is not only to prevent buyer confusion as to the source of the goods and/or services, but to protect the registrant from
`adverse commercial impact due to use of a similar mark by a newcomer. See In re Shell Oil Co., 992 F.2d 1204, 1208, 26 USPQ2d 1687, 1690
`(Fed. Cir. 1993). Therefore, any doubt regarding a likelihood of confusion determination is resolved in favor of the registrant. TMEP
`§1207.01(d)(i); see Hewlett-Packard Co. v. Packard Press, Inc., 281 F.3d 1261, 1265, 62 USPQ2d 1001, 1003 (Fed. Cir. 2002); In re Hyper
`Shoppes (Ohio), Inc., 837 F.2d 463, 464-65, 6 USPQ2d 1025, 1026 (Fed. Cir. 1988).
`
`For the reasons set forth above, registration is refused based on the Trademark Act Section 2(d).
`
`Identification
`
`The wording “ Grasses [plants]; flowers [natural]; oil seeds; vegetables [fresh].” in the identification of goods and/or services is indefinite and
`must be clarified. See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03. The identification of goods and/or services contains brackets.
`Generally, applicants should not use parentheses and brackets in identifications in their applications so as to avoid confusion with the USPTO’s
`practice of using parentheses and brackets in registrations to indicate goods and/or services that have been deleted from registrations or in an
`affidavit of incontestability to indicate goods and/or services not claimed. See TMEP §1402.12. The only exception is that parenthetical
`information is permitted in identifications in an application if it serves to explain or translate the matter immediately preceding the parenthetical
`phrase in such a way that it does not affect the clarity of the identification, e.g., “sash bands for kimono (obi).” Id. Therefore, applicant must
`remove the brackets from the identification and incorporate any parenthetical or bracketed information into the description of the goods and/or
`services.
`
`In an application filed under Trademark Act Section 66(a), an applicant may not change the classification of goods and/or services from that
`assigned by the International Bureau of the World Intellectual Property Organization (International Bureau) in the corresponding international
`registration. 37 C.F.R. §2.85(d); TMEP §§1401.03(d), 1904.02(b). Therefore, any modification to this wording must identify goods and/or
`services in International Class 31, the classification assigned by the International Bureau for these goods and/or services.
`
`The following substitute wording is suggested, if accurate:
`
`Class 31 –
`Grass seeds; seedlings; natural flowers; dried flowers; seeds and bulbs; bulbs; seeds of plants; seeds for horticultural purposes; unprocessed oil
`seeds; vegetables, fresh.
`
`Applicant’s goods and/or services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as
`acceptably narrowed. See 37 C.F.R. §2.71(a); TMEP §§1402.06, 1904.02(c)(iv). Applicant may clarify or limit the identification by inserting
`qualifying language or deleting items to result in a more specific identification; however, applicant may not substitute different goods and/or
`services or add goods and/or services not found or encompassed by those in the original application or as acceptably narrowed. See TMEP
`§1402.06(a)-(b). The scope of the goods and/or services sets the outer limit for any changes to the identification and is generally determined by
`the ordinary meaning of the wording in the identification. TMEP §§1402.06(b), 1402.07(a)-(b). Any acceptable changes to the goods and/or
`services will further limit scope, and once goods and/or services are deleted, they are not permitted to be reinserted. TMEP §1402.07(e).
`Additionally, for applications filed under Trademark Act Section 66(a), the scope of the identification for purposes of permissible amendments is
`limited by the international class assigned by the International Bureau of the World Intellectual Property Organization (International Bureau);
`and the classification of goods and/or services may not be changed from that assigned by the International Bureau. 37 C.F.R. §2.85(d); TMEP
`§§1401.03(d), 1904.02(b). Further, in a multiple-class Section 66(a) application, classes may not be added or goods and/or services transferred
`from one existing class to another. 37 C.F.R. §2.85(d); TMEP §1401.03(d).
`

`Drawing – Color Claim and Description
`
`Applicant must clarify whether color is a feature of the mark because, although the drawing shows the mark in color, the application does not
`accurately indicate the colors claimed as a feature of the mark. Applications for marks depicted in color must include not only a color drawing
`but also (1) a complete list of all the colors that are claimed as a feature of the mark and (2) a description of the literal and design elements in the
`mark that specifies where the colors appear in those elements. 37 C.F.R. §§2.37, 2.52(b)(1); see TMEP §807.07(a)-(a)(ii).
`
`Therefore, applicant must clarify whether color is claimed as a feature of the mark by satisfying one of the following:
`
`(1) If color is not a feature of the mark, applicant must submit a substitute black-and-white drawing of the mark to replace the color
`drawing of record. See TMEP §807.07(a)(i). However, any other amendments to the mark included in the substitute drawing will not be
`accepted if the changes would materially alter the mark. 37 C.F.R. §2.72; see TMEP §§807.14 et seq. Applicant must also submit an
`accurate and concise description of the literal and design elements in the mark, omitting any reference to color. 37 C.F.R. §2.37; see
`
`TMEP §§808.01, 808.02.
`(2) If color is a feature of the mark, applicant must submit both (a) a statement listing all the colors that are claimed as a feature of the
`mark and (b) a statement describing the literal and design elements in the mark that specifies where the colors appear in those elements.
`37 C.F.R. §§2.37, 2.52(b)(1); TMEP §807.07(a)-(a)(ii). Generic color names must be used to describe the colors in the mark, e.g.,
`magenta, yellow, turquoise. TMEP §807.07(a)(i)-(ii). If black, white, and/or gray are not being claimed as a color feature of the mark,
`applicant must exclude them from the color claim and include in the mark description a statement that the colors black, white, and/or
`gray represent background, outlining, shading, and/or transparent areas and are not part of the mark. See TMEP §807.07(d). The
`
`following color claim and mark description are suggested, if accurate:
`Color claim: “ The colors yellow, gold, yellowish-orange, orange, green and black are claimed as a feature of the mark.”
`
`Mark description: “ The mark consists of an orange sunflower with green stem and leaves, and it is surrounded by gold
`circle, then yellow circle, then yellowish-orange circle, then an orange circle. The wording “SUNRICH” is below the
`design in black color.”

`WHO IS PERMITTED TO RESPOND TO THIS PROVISIONAL FULL REFUSAL: Any response to this provisional refusal must be
`personally signed by an individual applicant, all joint applicants, or someone with legal authority to bind a juristic applicant (e.g., a corporate
`officer or general partner). 37 C.F.R. §§2.62(b), 2.193(e)(2)(ii); TMEP §712.01. If applicant hires a qualified U.S. attorney to respond on his or
`her behalf, then the attorney must sign the response. 37 C.F.R. §§2.193(e)(2)(i), 11.18(a); TMEP §§611.03(b), 712.01. Qualified U.S. attorneys
`include those in good standing with a bar of the highest court of any U.S. state, the District of Columbia, Puerto Rico, and other U.S.
`commonwealths or U.S. territories. See 37 C.F.R. §§2.17(a), 2.62(b), 11.1, 11.14(a); TMEP §§602, 712.01. Additionally, for all responses, the
`proper signatory must personally sign the document or personally enter his or her electronic signature on the electronic filing. See 37 C.F.R.
`§2.193(a); TMEP §§611.01(b), 611.02. The name of the signatory must also be printed or typed immediately below or adjacent to the signature,
`or identified elsewhere in the filing. 37 C.F.R. §2.193(d); TMEP §611.01(b).
