`he cited mark in Registration No. 3404660 is PUREDATA in stylized form with a design element for “Consultation services in the fields of
`selection, implementation and use of computer hardware and software systems for others; design, development and implementation of software”

`RGUMENTS
`
`(cid:160)T
`
`he applicant argues that there is no likelihood of confusion because the marks are used for different goods and services.(cid:160) In addition, the
`applicant asserts that the mark at issue is part of a “family of marks” with a recognizable common characteristic (the word “pure”) and thus,
`confusion by the consumer as to the source of the mark is much less likely.(cid:160) The examining attorney respectfully disagrees with these arguments.
`

`omparison of the Marks
`
`(cid:160)R
`
`egarding the first part of the test, applicant’s mark, “PUREDATA” is identical to Registration Nos. 3311693 and 3404660 (the word portion)
`and highly similar in connotation and commercial impression to Registration Nos. 3324228 and 3339601 because all are constructed with the
`dominant wording PUREDATA.” (cid:160) Regarding the issue of likelihood of confusion, applicant should consider the following:
`
`(cid:160)T
`
`he question is not whether people will confuse the marks, but whether the marks will confuse people into believing that the goods and/or
`services they identify come from the same source.(cid:160) In re West Point-Pepperell, Inc., 468 F.2d 200, 201, 175 USPQ 558, 558-59 (C.C.P.A. 1972);
`TMEP §1207.01(b).(cid:160) For that reason, the test of likelihood of confusion is not whether the marks can be distinguished when subjected to a side-
`by-side comparison.(cid:160) The question is whether the marks create the same overall impression.(cid:160) See Recot, Inc. v. M.C. Becton, 214 F.2d 1322,
`1329-30, 54 USPQ2d 1894, 1899 (Fed. Cir. 2000); Visual Info. Inst., Inc. v. Vicon Indus. Inc., 209 USPQ 179, 189 (TTAB 1980).(cid:160) The focus is
`on the recollection of the average purchaser who normally retains a general rather than specific impression of trademarks.(cid:160) Chemetron Corp. v.
`Morris Coupling & Clamp Co., 203 USPQ 537, 540-41 (TTAB 1979); Sealed Air Corp. v. Scott Paper Co., 190 USPQ 106, 108 (TTAB 1975);
`TMEP §1207.01(b).

`hen marks are otherwise virtually the same, the addition of a house mark is more likely to add to the likelihood of confusion than to
`distinguish the marks; it is likely that the two products sold under such marks would be attributed to the same source.(cid:160) In re Dennison Mfg. Co.,
`229 USPQ 141, 144 (TTAB 1986) (holding GLUE STIC for general purpose adhesive in stick form likely to be confused with UHU GLU STIC
`for adhesives for paper and stationery); Key West Fragrance & Cosmetic Factory, Inc. v. Mennen Co., 216 USPQ 168, 170 (TTAB 1982)
`(holding SKIN SAVERS for face and throat lotion likely to be confused with MENNEN SKIN SAVER for hand and body lotion); see
`Hammermill Paper Co. v. Gulf States Paper Corp., 337 F.2d 662, 663, 143 USPQ 237, 238 (C.C.P.A. 1964) (holding HAMMERMILL E-Z
`CARRY PAK and E-Z PAPER PAK for carrying cases or boxes for typewriter or duplicator paper likely to be confused with E-Z PAK and E-Z
`CARI for paper bags); TMEP §1207.01(b)(iii).(cid:160) The dominant and most significance wording of the marks creating the commercial impression
`
`is the wording “PUREDATA.” (cid:160) Applicant has simply added its house mark IBM.(cid:160)(cid:160)
`
`In addition, for a composite mark containing both words and a design, the word portion may be more likely to be impressed upon a purchaser’s
`memory and to be used when requesting the goods and/or services.(cid:160) In re Dakin’s Miniatures, Inc., 59 USPQ2d 1593, 1596 (TTAB 1999);
`TMEP §1207.01(c)(ii); see In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908, 1911 (Fed. Cir. 2012) (citing CBS Inc. v. Morrow,
`708 F. 2d 1579, 1581-82, 218 USPQ 198, 200 (Fed. Cir 1983)).(cid:160) Thus, although such marks must be compared in their entireties, the word
`portion is often considered the dominant feature and is accorded greater weight in determining whether marks are confusingly similar, even
`where the word portion has been disclaimed.(cid:160) In re Viterra Inc., 671 F.3d at 1366, 101 USPQ2d at 1911 (Fed. Cir. 2012) (citing Giant Food,
`Inc. v. Nation’s Foodservice, Inc., 710 F.2d 1565, 1570-71, 218 USPQ2d 390, 395 (Fed. Cir. 1983)). (cid:160)(cid:160)(cid:160) Accordingly, the design element and/or
`stylized form of some of the registered marks does not obviate the similarities between the marks.

`inally, although marks are compared in their entireties, one feature of a mark may be more significant or dominant in creating a commercial
`impression.(cid:160) See In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012); In re Nat’l Data Corp. , 753 F.2d 1056,
`1058, 224 USPQ 749, 751 (Fed. Cir. 1985); TMEP §1207.01(b)(viii), (c)(ii).(cid:160) Greater weight is often given to this dominant feature when
`determining whether marks are confusingly similar.(cid:160) See In re Nat’l Data Corp. , 753 F.2d at 1058, 224 USPQ at 751.(cid:160) Here, the significant or
`
`dominant portion of all the marks creating the commercial impression is the wording “PUREDATA.” (cid:160)(cid:160)
`
`Comparison of the Goods and Services
`
`
`
`(cid:160)T
`
`he applicant argues that there is no likelihood of confusion because the marks are used for different goods and services.(cid:160) Specifically, applicant
`asserts that its goods are computer hardware and software for performing data analysis on large quantities of information and registrant’s Class
`42 services are specifically for providing the service of designing and implementing hardware and software systems.(cid:160) Registrant is not offering
`
`actual hardware and software; they are merely designing and implementing information technology systems for others.(cid:160)(cid:160)
`
`Consumers are likely to be confused by the use of similar marks on or in connection with goods and with services featuring or related to those
`goods.(cid:160) TMEP §1207.01(a)(ii); see In re Hyper Shoppes (Ohio), Inc., 837 F.2d 463, 6 USPQ2d 1025 (Fed. Cir. 1988) (holding BIGG’S for retail
`grocery and general merchandise store services likely to be confused with BIGGS for furniture); In re United Serv. Distribs., Inc., 229 USPQ 237
`(TTAB 1986) (holding design for distributorship services in the field of health and beauty aids likely to be confused with design for skin cream);
`In re Phillips-Van Heusen Corp., 228 USPQ 949 (TTAB 1986) (holding 21 CLUB for various items of men’s, boys’, girls’ and women’s

`sufficiently related to computer or technology-related services such that a likelihood of confusion exists when the marks at issue are otherwise
`identical or highly similar.(cid:160) See Hewlett-Packard Co. v. Packard Press, Inc., 281 F.3d 1261, 62 USPQ2d 1001 (Fed. Cir. 2002) (holding
`“electronic transmission of data and documents via computer terminals” to be sufficiently related to facsimile machines, computers, and
`computer software such that confusion would be likely where the marks at issue convey a similar commercial impression); MSI Data Corp. v.
`Microprocessor Sys., Inc., 220 USPQ 655 (TTAB 1983) (holding MSI for “computer hardware manufacturing services to the order of or
`specification of others” likely to be confused with MSI for “electronic ordering systems for gathering and transmitting source data comprising a
`recorder-transmitter and data receiver”); Commc’ns Satellite Corp. v. Comcet, Inc. , 429 F.2d 1245, 166 USPQ 353 (4th Cir. 1970) (holding
`COMSAT for satellite services likely to be confused with COMCET for computers because computers can be used to receive data transmitted by
