`
`
`INTERNATIONAL REGISTRATION NO. 1142702
`
`(cid:160) P
`
`LEASE NOTE: Applicant is encouraged to telephone or e-mail the assigned trademark examining attorney to resolve the issues raised in this
`Office action by examiner’s amendment.(cid:160) Although a formal response may never be submitted by e-mail, an applicant may communicate
`informally by phone or e-mail with the trademark examining attorney to agree to a proposed amendment to the application that will immediately
`place the application in condition for publication for opposition, issuance of a registration, or suspension.(cid:160) See TMEP §707.
`
`INTRODUCTION
`
`(cid:160) T
`
`his Office action is in response to applicant’s communication filed on April 10, 2013.
`
`(cid:160) I
`
`the applicant was required to satisfy the following requirement(s):(cid:160) amend the
`n a previous Office action(s) dated February 7, 2013,
`identifications of goods in International Classes 18, 25 and 26,(cid:160) claim ownership of prior registrations, clarify the mark description, and indicate
`whether the name in the mark identified a living individual
`
`(cid:160) B
`
`ased on applicant’s response, the trademark examining attorney withdraws the following: (1) prior registration requirement; (2) description of
`mark requirement; (3) living individual requirement; and (4) identification of goods in International Class 18 requirement.(cid:160) See TMEP §§713.02,
`714.04.
`
`(cid:160) F
`
`urther, the trademark examining attorney maintains and now makes FINAL the refusal(s) and/or requirement(s) in the summary of issues
`below.(cid:160) See 37 C.F.R. §2.64(a); TMEP §714.04.
`
`(cid:160) S
`
`UMMARY OF ISSUES MADE FINAL that applicant must address:
`
`Identification of goods in International Class 25 requirement
`Identification of goods in International Class 26 requirement
`
`(cid:160)(cid:160)
`
`Identification Of Goods – International Class 25
`The amended wording “dress handkerchiefs of textile” in the identification of goods is properly classified in International Class 24, and not
`International Class 25.(cid:160) See 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.(cid:160) While handkerchiefs of paper are classified in International
`Class 16 and handkerchiefs of textile are classified in International Class 24, the trademark examining attorney cannot suggest any type of
`handkerchief properly classified in International Class 25.(cid:160) Accordingly, this wording should be deleted from the identification or limited to
`goods properly classified in International Class 25.
`
`(cid:160) I
`
`n an application filed under Trademark Act Section 66(a), an applicant may not change the classification of goods and/or services from that
`assigned by the International Bureau in the corresponding international registration.(cid:160) 37 C.F.R. §2.85(d); TMEP §§1401.03(d), 1904.02(b). (cid:160)
`Further, in a multiple-class Section 66(a) application, an applicant may not transfer goods and/or services from one existing international class to
`another.(cid:160) 37 C.F.R. §2.85(d); see TMEP §§1402.07(a), 1904.02(c).
`
`(cid:160) T
`
`herefore, any modification to this wording must identify goods and/or services in International Class 25, the classification specified in the
`application for these goods and/or services.
`
`(cid:160) I
`
`dentification Of Goods – International Class 26
`
`(cid:160)(cid:160)
`(cid:160)
`
`
`The following proposed wording for goods and/or services in International Class 26 is not acceptable because it is beyond the scope of the goods
`and/or services in the application as filed:(cid:160) “belt buckles.” (cid:160) See 37 C.F.R. §2.71(a); TMEP §§1402.01(c), 1904.02(c)(iv).(cid:160) Specifically, this
`wording is beyond the scope of the identification because the good did not include belt buckles, but only shoe buckles and belt clasps, both of
`which are in the amended identification.
`
`(cid:160) T
`
`he scope of the identification for purposes of permissible amendments is limited by the international class assigned by the International Bureau
`of the World Intellectual Property Organization (International Bureau).(cid:160) 37 C.F.R. §2.85(f); TMEP §§1402.07(a), 1904.02(c).(cid:160) If an applicant
`amends the identification to a class other than that assigned by the International Bureau, the amendment will not be accepted because it will
`
`exceed the scope and those goods and/or services will no longer have a basis for registration under U.S. law.(cid:160) TMEP §§1402.01(c), 1904.02(c).(cid:160)(cid:160)(cid:160)(cid:160)
`
`Moreover, the wording “bands and cords for clothing” is repeated twice in the identification of goods and must be limited to a single time.(cid:160) See
`37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.03.
`
`In addition, in an application filed under Trademark Act Section 66(a), an applicant may not change the classification of goods and/or services
`from that assigned by the International Bureau in the corresponding international registration.(cid:160) 37 C.F.R. §2.85(d); TMEP §§1402.01(c),
`1904.02(b).(cid:160) Further, in a multiple-class Section 66(a) application, an applicant may not transfer goods and/or services from one existing
`
`international class to another.(cid:160) 37 C.F.R. §2.85(d); TMEP §§1401.03(d), 1402.01(c).(cid:160)(cid:160)
`
`Applicant must amend this wording to substitute goods and/or services in International Class 26 that are within the scope of the goods and/or
`services in the application as filed.(cid:160) See TMEP §§1402.07(a), 1904.02(c)(iv).(cid:160) In the alternative, applicant may delete the unacceptable wording
`from the identification.(cid:160) See TMEP §1904.02(c)(iv).(cid:160) However, once an application has been expressly amended to delete goods and/or services,
`those items generally may not be later re-inserted.(cid:160) TMEP §1402.07(e).
`
`Additions To Identification Not Permitted
`
`An applicant may amend an identification of goods and services only to clarify or limit the goods and services; adding to or broadening the
`scope of the goods and/or services is not permitted.(cid:160) 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.
`
`(cid:160) F
`
`or assistance with identifying and classifying goods and/or services in trademark applications, please see the USPTO’s online searchable U.S.
`Acceptable Identification of Goods and Services Manual at http://tess2.uspto.gov/netahtml/tidm.html. (cid:160) See TMEP §1402.04.
`
`Response To Final Action And Partial Abandonment Advisory
`
`Applicant must respond within six months of the date of issuance of this final Office action or the following goods to which the final refusal(s)
`and/or requirement(s) apply will be deleted from the application by Examiner’s Amendment: (cid:160) dress handkerchiefs of textile in International
`Class 25 and the duplicate wording “belt buckles and bands and cords for clothing, namely” in International Class 26. (cid:160) 37 C.F.R. §2.65(a); see
`15 U.S.C. §1062(b).
`
`(cid:160) T
`
`he application will then proceed for the following goods: Clothing for men, women and children, namely, hats, socks, pajamas, bathing suits,
`beachwear, blouses, body suits, bras, bustiers, coats, cummerbunds and sashes, dresses, exercise suits, foundation garments, gowns, infant wear,
`jackets, jeans, hosiery, lingerie, loungewear, neckwear, pants, rainwear, robes, shirts, shorts, skirts, sleepwear, slips, suits, sweaters, sweatsuits,

`leather; shawls; accessories, namely headscarves, neck scarves, shoulder scarves; ties; gloves; shoes and boots in International Class 25; Lace
`and embroidery, ribbons and braid; buttons, hooks and eyes, pins, namely sewing pins and marking pins and needles; artificial flowers; badges

`
`(cid:160)(cid:160)
`(cid:160)(cid:160)
`(cid:160)(cid:160)
`
`
`identified goods in International Class 18.(cid:160)(cid:160)
`
`Applicant may respond by providing one or both of the following:
`
`(1)(cid:160) A response that fully satisfies all outstanding requirements;
`
`(2)(cid:160) An appeal to the Trademark Trial and Appeal Board, with the appeal fee of $100 per class.

`
`n certain rare circumstances, an applicant may respond by filing a petition to the Director pursuant to 37 C.F.R. §2.63(b)(2) to review
`procedural issues.(cid:160) 37 C.F.R. §2.64(a); TMEP §714.04; see 37 C.F.R. §2.146(b); TBMP §1201.05; TMEP §1704 (explaining petitionable
`matters).(cid:160) The petition fee is $100.(cid:160) 37 C.F.R. §2.6(a)(15).
`
`If applicant has questions regarding this Office action, please telephone or e-mail the assigned trademark examining attorney.(cid:160) All relevant e-
`mail communications will be placed in the official application record; however, an e-mail communication will not be accepted as a response to
`this Office action and will not extend the deadline for filing a proper response.(cid:160) See 37 C.F.R. §2.191; TMEP §§304.01-.02, 709.04-.05.(cid:160) Further,
`although the trademark examining attorney may provide additional explanation pertaining to the refusal(s) and/or requirement(s) in this Office
`action, the trademark examining attorney may not provide legal advice or statements about applicant’s rights. (cid:160) See TMEP §§705.02, 709.06.
