`RESPONSE TO OFFICE ACTION

`On behalf of our client, The Smiley Company SPRL (“TSC”), we respectfully submit this
`
`response to the Examining Attomey’s Office Action dated October 29, 2009, in connection with
`
`the Petition to Revive.
`
`ARGUMENT
`
`In the Office Action, the Examining Attorney provisionally refused the registration of
`
`Ser. No. 79/073,546 (the “Application”) and identified five areas requiring Applicant’s attention
`
`and response, namely: (1) Section 2(d) refusal based on a likelihood of confusion; (2) the
`
`existence of prior pending applications; (3) clarification of entity information; (4) clarification of
`
`description of the Mark; and (5) identification of goods/services. We will address these areas in
`
`turn.
`
`
`
`No Likelihood of Confusion
`
`In the Office Action, the Examining Attorney cited to Serial No. 79/073,546 design mark
`
`(“Applicant’s Mark”) and noted that potential existed for a likelihood of confusion between
`
`Applicant’s Mark and Registration Nos. 3,700,178; 3,700,179; 3,788,245; 3,772,885; 3,710,457;
`
`3,687,360; 3,710,266; 3,710,262; 3,710,258 and 3,710,255. For the reasons set forth below, we
`
`respectfiilly disagree.
`
`As an initial matter, Applicant filed a Notice of Opposition for a strikingly similar
`
`Harvey Ball mark, No. 91/ 186,510 (“‘510 Opposition”), on September 17, 2008 that is currently
`
`pending before the Trademark Trial and Appeal Board (“TTAB”).1 The ‘510 Opposition was
`
`suspended on February 18, 2009 pending the outcome of Opposition No. 91/ 150,278 involving
`
`Applicant and Wal—Mart. That matter is currently on appeal before the United States District
`
`Court for the Northern District of Illinois, Eastern Division.
`
`Further, Applicant advises that it filed a Petition to Cancel for Registration Nos.
`
`3,700,178; 3,700,179; 3,788,245; 3,772,885; 3,710,457; 3,687,360; 3,710,266; 3,710,262;
`
`3,710,25 8 and 3,710,255 contemporaneously with this Office Action response based on
`
`Registrant’s ongoing acts of fraud and bad faith (ESTTA No. 360479). We believe that the
`
`Petition to Cancel will moot any concerns the Examining Attorney may have regarding a
`
`likelihood of confusion.
`
`Regardless of the Examining Attorney’s position vis-a-vis the Petition to Cancel, we
`
`believe the likelihood of confusion refilsal is improper. To evaluate likelihood of confusion,
`

`
`In that case, thirteen

`In the Office

`Action, the Examining Attorney only addressed two of the thirteen DuP0m‘ factors. Moreover,
`
`the Examining Attorney failed to delineate among the marks cited against Applicant which
`
`factors applied to which marks.
`
`II.
`
`Applicant’s Mark Has Priority Over Marks Cited by Examining Attorney
`
`The Examining Attorney cited eight marks that he alleges precede the Applicant’s filing
`
`date. We respectfully disagree, and will address each in turn.
`
`As an initial matter, we note that Applicant applied for its French trademark application
`
`(No. 05 3 352 819) which was registered on April 4, 2005 and published on September 30, 2005.
`
`A copy of the Applicant’s French registration with an English translation is attached hereto as
`
`Exhibit A. Applicant’s mark was registered internationally (No. 1015069) on January 6, 2009.
`
`A copy of Applicant’s registration pursuant to the Madrid Protocol and English translation is
`
`attached hereto as Exhibit B.
`
`A. Serial No. 77/632,762
`
`Harvey Ball filed its intent—to—use application with the United States Patent and
`
`Trademark Office (“USPTO”) on December 14, 2008. Applicant’s French trademark that it used
`
`to support its U.S. application was registered in France on April 4, 2005. Even if the USPTO
`
`was not convinced that Applicant’s French registration preceded Harvey Ball’s application,
`
`Applicant has superior rights to the mark. During the pendency of this Office Action, a Notice
`
`of Allowance for the mark was issued on April 6, 2010 and Harvey Ball filed its Statement of
`
`Use on July 2, 2010. Assuming the mark proceeds to registration, Applicant intends to file a
`
`Petition to Cancel based on fraudulent statements made to the USPTO in its response to the
`
`office action.
`

`
`B. Serial No. 77/631,722
`
`Applicant notes that the application was suspended on November 5, 2009 pending the
`
`disposition of TSC’s pending application for Ser. No. 75/302,439. In addition, the Examining
`
`Attorney continued and maintained his refusal concerning Reg. No. 2,832,142, as Harvey Ball’s
`
`arguments were not persuasive.
`
`C. Serial No. 77/610,625
`
`Harvey Ball filed its intent-to-use application with the USPTO on November 9, 2008.
`
`Applicant’s French trademark that was used to support its U.S. application was registered in
`
`France on April 4, 2005. Harvey Ball alleged a first use date in commerce of February 27, 2009
`
`and the mark was registered on November 10, 2009 as Reg. No. 3,710,258. Applicant is
`
`contemporaneously filing a Petition to Cancel (ESTTA No. 360479) based on fraudulent
`
`statements made by Registrant to the USPTO in connection with the filing of its application.
`
`D. Serial No. 77/632,778
`
`The application for this mark was filed on December 14, 2008 as an intent-to-use mark.
`
`Applicant notes that the application was suspended on November 24, 2009 pending the
`
`disposition of TSC’s opposition to Ser. No. 79/045,616 (Opp. No.91/ 186,510). The Examining
`
`Attorney also maintained his refusal to register the mark based on the mark’s failure to function
`
`as a trademark.
`

`
`Applicant notes that this application was suspended on November 19, 2009 pending
`
`disposition of TSC’s pending marks Ser. No. 75/302,439 and Ser. No. 75/977,376, and the
`
`pending opposition against Harvey Ball (Opp. No. 91/ 186,5 10) affecting Ser. No. 79/045,616.
`
`
`
`The Examining Attorney also maintained his refusal based on a likelihood of conf11sion and the
`
`marks failure to function as a trademark.

`F. Serial No. 77/634,669
`
`Applicant notes that during the pendency of this Office Action, this application was
`
`registered (Reg. No. 3,788,245). Applicant advises the Examining Attorney of its
`
`contemporaneous filing of a Petition to Cancel this mark based on Applicant’s prior use,
`
`Registrant’s fraud on the USPTO and bad faith.

`
`TSC’s predecessor filed a Notice of Opposition to the registration of this mark (Opp. No.
`
`91/ 186,510) on September 17, 2008, alleging that TSC’s use in the United States preceded
`
`Harvey Ball’s filing date of June 6, 2007. The opposition was suspended on February 18, 2009
`
`pending disposition of Consolidated Opposition No. 91/150,278, currently on appeal before the
`
`United States District Court for the Northern District of Illinois, Eastern Division.
`
`H. Serial No. 77/347,604
`
`TSC’s predecessor filed a Notice of Opposition to the registration of this mark (Opp. No.
`
`91/ 186,653) on September 24, 2008, alleging that TSC’s use in the United States preceded
`
`Harvey Ball’s filing date of December 9, 2007. The opposition was consolidated with Opp. No.
`
`91/ 186,510 on February 18, 2009. That same day, the opposition was suspended pending
`
`disposition of Consolidated Opposition No. 91/150,278, currently on appeal before the United
`
`States District Court for the Northern District of Illinois, Eastern Division.
`
`III.
`
`Clarification of Entity Information Requested by Examining Attorney
`
`In Section C of the Office Action, the Examining Attorney requested clarification of the
`
`Applicant’s entity information, specifically its legal nature and place of incorporation. The
`
`
`
`Smiley Company SPRL2 is a foreign private limited company organized and existing under the
`
`laws of Belgium with its principal place of business at 16 Rue des Trois Arbres, 1180, Brussels,
`
`Belgium.
`
`IV.
`
`Clarification of Description Requested by Examining Attorney
`
`In Section D of the Office Action, the Examining Attorney requested clarification of the
`
`description for the applied-for mark, and suggested that the description be changed to: “The
`
`mark consists of a stylized design of two eyes and a mouth in the shape of a smiling face.” The
`
`Applicant accepts this suggestion and hereby adopts this description.
`
`V.
`
`Information About Identification of Goods Requested by Examining Attorney
`
`In Section E of the Office Action, the Examining Attorney found that the identification of
`
`some goods in the application were indefinite or vague and requested clarification of goods in
`
`international classes 16, 18 and 25. Applicant incorporates the Examining Attorney’s
`
`suggestions and proposes the following identifications:
`
`Class 16: Printed matter namely, books, stationery, greeting cards, note cards, post cards,
`
`posters, newspapers, printed calendars, printed forms, printed invitations, photo albums,
`
`scrapbooks, photographs; bookbinding materials, namely bookbinding papers or cloth,
`
`bookbinding adhesive tape or glue; adhesive tapes for stationery or household purposes; artists’
`
`materials namely, artists’ paintbrushes, typeset printing blocks, printing type, art pads, art paper,

`headgear namely, hats, caps, berets; scarves; gloves as clothing; neckties; hosiery; underwear.

`CONCLUSION
