`It is respectfirlly requested that based thereon the Examining Attorney withdraw

`the objections based on the pending applications. In this regard, it is noted that the Court
`
`of Appeals for the Federal Circuit has stated on numerous occasions that the Examining
`
`Attorney is required to accord due deference to letters of consent. This is based on the
`
`fact that if the registrant and applicant believe that confusion is unlikely, the Examiner
`
`should respect the parties’ business acumen.

`177 USPQ 563, 568, the Court of Customs and Patent Appeals stated:

`The United States Patent and Trademark Office has issued a potential refiisal to register The

`MAW/IUT Marks in _Class 25 in View of Application No. 78/815740 for MAMMOTH owned by

`KS Lax Inc., (“KS”).

`Mammufs claimed first use date of The MAIVHVIUT Marks in commerce is prior to the
`
`filing date of Application No. 78/815740.
`
`For the reasons set forth below, the parties believe that The MAMMUT Marks are capable
`
`
`
`of coexisting without confusion with the trademark MA}/Bv£OTH owned by KS. Specifically, the
`
`parties note:

`i The MAMMUT Marks evoke a commercial impression distinctly different from
`
`IVIAMMOTH,
`

`MAMMUT and MAMMOTH are visually and verbally different.
`
`KS uses its MAMMOTH mark solely in connectionrwith lacrosse and products and
`
`services ancillary thereto. Mamrnufs products are not used in connection with, sold in connection

`with or ancillary to or related to lacrosse.

`As a result of the differences in appearance, sound, and connotation between the
`
`marks and the differences in the products in connection with which each parties’ marks are used,
`
`purchasers are unlikely to believe that the goods of the respective parties emanate firorn the same or

`To the best of the parties’ knowledge there have been no instances of actual
`
`confusion.

`6.
`
`The parties will take reasonable steps to ensure against confusion should it occur.

`Based thereon, KS hereby consents to the use and registration of The MAMMUT Marks for

`the goods shown in Schedule A and will agree to execute additional Letters of Consent to aid in the
