`The Examiner cites Application No. 78815740 for MAMMOTH, 78777202 for MAMMOTH and Design and 78922042 for
`MAMMOET and Design as potentially blocking this application due to a likelihood of confusion.(cid:160) The MAMMOET application has been
`refused registration due to the fact that the applicant is the owner of U.S. Registration No. 2409826 for MAMMUT and Design.(cid:160) The applicant
`is also the owner of Registration No. 1176376 for MAMMUT.(cid:160) That registration claims a first use date of January 1, 1964.
`Clearly the applicant is the senior user of MAMMUT. It has been using MAMMUT as its trademark in the United States for more than
`40 years for mountain climbing equipment.(cid:160) Its MAMMUT logo (2409826) was in use long before the filing dates of all three applications
`cited by the Examiner.(cid:160) That registration covers a wide range of goods in classes 9, 18, 22, 25 and 28 for mountain climbers.(cid:160) The present
`application seeks merely a natural expansion of that product line.(cid:160) It actually duplicates its earlier registration in many respects.(cid:160) In essence, the
`applicant is seeking merely to register the word mark portion of its Reg. No. 2409826 for a slightly expanded listing of goods.
`Since the applicant is the senior user of MAMMUT, its applications to register that name should not be blocked by newcomers to the
`field.(cid:160) In fact, one of the main purposes of the Lanham Act is to promote commerce by protecting the natural expansion of trademarks.(cid:160) The
`Trademark Manual of Examining Procedure notes the Expansion of Trade Doctrine in Section 1207.01(a)(v):
`The examining attorney must consider any goods or services in the registrant’s normal fields of expansion to determine
`whether the registrant’s goods or services are related to the applicant’s identified goods or services under §2(d). In re
`General Motors Corp., 196 USPQ 574 (TTAB 1977). A trademark owner is entitled to protection against the registration of a
`similar mark on products that might reasonably be expected to be produced by him in the normal expansion of his business.
`The test is whether purchasers would believe the product or service is within the registrant’s logical zone of expansion. CPG

`Here, the applicant has been using the MAMMUT mark in the United States since 1964.(cid:160) Through this long period of time, the
`applicant’s mark has acquired distinctiveness and is strongly associated with the applicant. This is why even though its mark is similar to the
`mark in the applications cited by the Examiner, its mark is distinctive from them.
`From its earliest use, the goods have been aimed at mountain climbers. The applicant’s 2000 logo registration merely expanded that
`line of goods.(cid:160) The applicant’s current application seeks to register the word portion of its logo mark and add a few additional goods in the
`applicant’s normal field of expansion. Under the doctrine of Expansion of Trade, the applicant’s status as the senior user of the MAMMUT
`mark must be recognized.(cid:160)
`The courts have said “It is well-settled that one who adopts a mark similar to the mark of another for closely related goods acts at his
`peril and any doubt there must be resolved against him.” Carlisle Chem. Works, Inc. v. Hardmam & Holden, Ltd., 434 F.2d 1403, 168 USPQ
`110 (CCPA 1970) All of the marks cited by the Examiner were adopted long after the applicant began use and registered two forms of its
`MAMMUT mark. It would be a perversion of the Lanham Act that the senior user of a mark is now blocked from normal expansion by
`applicants who filed knowing clearly that the applicant was already using a similar mark and in fact had already registered it for similar goods.
`Therefore, this application should be permitted to proceed.
