`
`his is a PROVISIONAL FULL REFUSAL of the trademark and/or service mark in the above-referenced U.S. application.(cid:160) See 15 U.S.C.
`§1141h(c).
`
`(cid:160)W
`
`HO IS PERMITTED TO RESPOND TO THIS PROVISIONAL FULL REFUSAL:
`
`(cid:160)A
`
`(cid:160) However,
`pplicant may respond directly to this provisional refusal Office action, or applicant’s attorney may respond on applicant’s behalf.
`the only attorneys who can practice before the United States Patent and Trademark Office (USPTO) in trademark matters are as follows:
`
`(1)(cid:160) Attorneys in good standing with a bar of the highest court of any U.S. state, the District of Columbia, Puerto Rico, and other
`federal territories and possessions of the U.S.; and
`
`(2)(cid:160) Canadian attorneys who represent applicants residing in Canada and who have applied for and received reciprocal recognition
`by the USPTO under 37 C.F.R. §10.14(c).(cid:160)(cid:160)
`37 C.F.R. §10.14; TMEP §602.(cid:160)(cid:160)
`
`Other than duly authorized Canadian attorneys, foreign attorneys cannot sign responses or otherwise represent applicants before the USPTO.(cid:160) See
`TMEP §602.06(b). (cid:160) Preparing a paper, authorizing an amendment to an application, or submitting legal arguments in response to a requirement
`or refusal constitutes representation of a party in a trademark matter.(cid:160) A response signed by an unauthorized foreign attorney is considered an
`incomplete response.(cid:160) TMEP §§602, 602.03, 603.04, 605.05(a).
`
`(cid:160)T
`
`HE APPLICATION HAS BEEN PROVISIONALLY REFUSED AS FOLLOWS:
`
`(cid:160)T
`
`he assigned trademark examining attorney has reviewed the referenced application and has determined the following:
`Search Results
`The Office records have been searched and no similar registered mark has been found that would bar registration under Trademark Act Section
`2(d), 15 U.S.C. §1052(d).(cid:160) TMEP §704.02.(cid:160) However, please be advised that potentially conflicting marks in prior-filed pending applications may
`present a bar to registration.(cid:160)
`Information regarding pending Application Serial Nos. 78815740 for the mark MAMMOTH, 78777202 for the mark MAMMOTH, and
`
`(cid:160)
`(cid:160)
`(cid:160)
`
`
`78922042 for the mark MAMMOET is enclosed.(cid:160) The filing dates of the referenced applications precede applicant’s filing date.(cid:160) There may be a
`likelihood of confusion under Trademark Act Section 2(d) between applicant’s mark and the referenced marks.(cid:160) If one or more of the referenced
`applications registers, registration may be refused in this case under Section 2(d).(cid:160) 37 C.F.R. §2.83; TMEP §§1208 et seq.(cid:160) Therefore, upon entry
`of a response to this Office action, action on this case may be suspended pending final disposition of the earlier-filed applications.
`(cid:160)If applicant believes that there is no potential conflict between this application and the earlier-filed applications, then applicant may present
`arguments relevant to the issue in a response to this Office action.(cid:160) The election not to submit arguments at this time in no way limits applicant’s
`right to address this issue at a later point.
`IDENTIFICATION OF GOODS
`Applicant applied to register the following:
`Metal articles for climbers, in particular snap-hooks in International Class 006.
`Protective helmets in International Class 009.
`Rucksacks in International Class 018.
`Sleeping bags; fire blankets in International Class 020.
`Ropes, strings, cords, nets, tents; tapes, straps and bags (included in this class) in International Class 022.
`Clothes, headwear, footwear in International Class 025.
`The identification of goods and/or services contains parentheses.(cid:160) Generally, parentheses and brackets should not be used in identifications.(cid:160)
`Parenthetical information is permitted in identifications only if it serves to explain or translate the matter immediately preceding the parenthetical
`phrase in such a way that it does not affect the clarity of the identification, e.g., “obi (Japanese sash).”(cid:160) TMEP §1402.12.(cid:160) Therefore, applicant
`must remove the parentheses from the identification of goods and/or services and incorporate the parenthetical information into the description.(cid:160)
`The identification of goods is indefinite and must be clarified because it includes the open-ended wording “including.”(cid:160) TMEP §§1402.01 and
`1402.03(a).(cid:160) The identification must be specific and all-inclusive.(cid:160) Therefore, this wording should be deleted and replaced with “namely.”(cid:160)
`Applicant may amend the identification to list only those items that are within the scope of the goods set forth in the application or within the
`scope of a previously accepted amendment to the identification.(cid:160) 37 C.F.R. §2.71(a); TMEP §§1402.01 and 1402.03(a).(cid:160)
`The goods, fire blankets, are classified incorrectly.(cid:160) Applicant must amend the application to classify the goods in International Class 009.(cid:160) 37
`C.F.R. §§2.32(a)(7) and 2.85; TMEP §§1401.02(a) and 1401.03(b).
`The wording “nets” in the identification of goods is indefinite and must be clarified because applicant has not identified the type of nets. (cid:160) TMEP
`§1402.01.(cid:160) Applicant may substitute the following wording, if accurate:(cid:160) “ Commercial nets.”
`The wording “straps” in the identification of goods is indefinite and must be clarified because the type of strap has not been specified. (cid:160) TMEP
`§1402.01.(cid:160) Applicant may substitute the following wording, if accurate:(cid:160) “ All purpose straps.”
`(cid:160) TMEP
`(cid:160)The wording “bags” in the identification of goods is indefinite and must be clarified because the type of bag has not been specified.
`§1402.01.(cid:160) Applicant may substitute the following wording, if accurate:(cid:160) “ {indicate specific Class 022 type of bag i.e. laundry} bags.”
`
`(cid:160)T
`
`he wording “clothes” in the identification of goods is indefinite and must be clarified because applicant has not identified the specific type of
`clothing.(cid:160) TMEP §1402.01.(cid:160) Applicant may substitute the following wording, if accurate:(cid:160) “Clothes, namely, [indicate item by common
`commercial name, e.g., jackets, sweaters, trousers, etc.].”
`The international classification of goods and/or services in applications filed under Trademark Act Section 66(a) cannot be changed from the
`classification given to the goods and/or services by the International Bureau of the World Intellectual Property Organization in the corresponding
`international registration.(cid:160) TMEP §§1401.03(d), 1401.04 and 1904.02(b). Thus, applicant must amend the indefinite wording in Classes 6, 9, 18,
`20, 22, and 25 and provide an acceptable identification of goods in these classes.
`Thus, applicant can adopt the following identification of goods:
`Metal articles for mountain climbers, namely, snap-hooks in International Class 006
`Protective helmets; fire blankets in International Class 009
`Rucksacks in International Class 018.
`Sleeping bags in International class 020.
`Ropes, strings, cords, commercial nets, tents; tapes, All purpose straps and indicate specific Class 022 type of bag i.e. laundry} bags in
`International Class 022
`Clothes, namely, [indicate item by common commercial name, e.g., jackets, sweaters, trousers, etc.], headwear, footwear in International
`Class 025.
`Please note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of
`the goods is not permitted.(cid:160) 37 C.F.R. §2.71(a); TMEP §1402.06.(cid:160) Therefore, applicant may not amend the identification to include goods that are
`not within the scope of the goods set forth in the present identification.(cid:160)
`For assistance with identifying and classifying goods and/or services in trademark applications, please see the online searchable Manual of
`Acceptable Identifications of Goods and Services at http://tess2.uspto.gov/netahtml/tidm.html.
`ENTITY (LEGAL NATURE) AND COUNTRY OF ORGANIZATION OMITTED
`The application does not include applicant’s “Legal Nature” and “Legal Nature:(cid:160) Place Incorporated.”(cid:160) Applicant must specify its entity type
`(“Legal Nature”) and citizenship (“Place Incorporated”).(cid:160) 37 C.F.R. §2.32(a)(3)(ii)-(iii); TMEP §§803.01, 803.03 and 803.04.(cid:160)
`Acceptable entity types include an individual, a partnership, a corporation or a joint venture.(cid:160) 37 C.F.R. §2.32(a)(3); TMEP §§803.03 et seq.(cid:160) (cid:160)
`If applicant’s entity type is an individual, applicant must indicate his or her national citizenship for the record.(cid:160) 37 C.F.R. §2.32(a)(3)(i).(cid:160) If
`applicant’s entity type is a partnership or joint venture, applicant must list the names and the national citizenship or the country of organization
`or incorporation of all the general partners or joint venturers, as well as specify the country under whose laws the partnership or joint venture is
`organized.(cid:160) 37 C.F.R. §§2.32(a)(3)(ii) and (iii).(cid:160) If applicant’s entity type is a corporation or association, applicant must set forth the country
`
`
`
`under whose laws applicant is organized.(cid:160) 37 C.F.R. §2.32(a)(3)(ii).(cid:160) (cid:160)
`TRANSLATION OF MARK
`
`Applicant must submit an English translation of the mark.(cid:160) 37 C.F.R. §2.61(b); TMEP §809.(cid:160) The following translation statement is suggested:(cid:160)
`“The English translation of MAMMUT is mammoth.”
