`
`owever, in order to pursue registration, applicant must respond to the following.
`
`(cid:160)I
`
`dentification of Goods
`
`(cid:160)T
`
`he wording in the identification of goods needs clarification because some of the wording is too broad and could include goods classified in
`other international classes. In addition, some of the wording is unacceptable as indefinite.(cid:160) TMEP §§1402.01 and 1402.03.
`
`(cid:160)T
`
`he international classification of goods and/or services in applications filed under Trademark Act Section 66(a) cannot be changed from the
`classification the International Bureau of the World Intellectual Property Organization assigned to the goods and/or services in the corresponding
`
`international registration.(cid:160) TMEP §§1401.03(d) and 1904.02(b).(cid:160)(cid:160)
`
`Therefore, any modification to this wording must identify goods and/or services in International Class 005, 042 and 044 and, the classification
`
`specified in the application for these goods and/or services.(cid:160)(cid:160)
`
`Class 005
`
`(cid:160)T
`
`he wording “Pharmaceutical preparations” needs clarification because it is unacceptable as indefinite because it is not clear as to the type
`and/or use of the pharmaceutical preparations (e.g., for use in treating skin disorders, for use in dermatology, for use in treating wounds and
`burns).(cid:160) Applicant must state with specificity the type, use and purpose of the preparations it provides.
`
`(cid:160)T
`
`he following substitute wording is suggested, if appropriate:
`
`“Pharmaceutical preparations {SPECIFY, E..G, for use in treating skin disorders, for use in dermatology, for use in treating
`wounds and burns, etc.}.”
`
`Class 042
`
`(cid:160)T
`
`he wording “ services with regard to pharmaceutical, pharmacological and medical research and development as well as in the field of
`healthcare” is unacceptable as indefinite because it is overbroad. (cid:160) This wording could encompass any number of “services” and applicant must
`clarify this wording (e.g. Pharmaceutical product evaluation, Pharmaceutical research and development, Medical and scientific research in the
`field of {indicate field or subject matter of the research}).(cid:160) Furthermore, providing advice is classified according to the subject matter or field of
`the advice.(cid:160) So while consultancy on “medical research” and on “healthcare products” is in International Class 042, consultancy on
`“healthcare” would properly be classified in International Class 044. (cid:160) The wording “ distribution and production” must be deleted from
`International Class 042 because those services are indefinite and would be properly classified in International Class 035 or 039.(cid:160)
`The following substitute wording is suggested, if appropriate:
`
`“Consultancy and medical and scientific research and development services in the field of pharmaceutical, pharmacological and
`healthcare products; technical advice for others regarding research and development of pharmaceutical preparations as well as
`relating to planning and constructing of plants and factories for the production of pharmaceutical preparations; scientific
`research, namely in the pharmaceutical field as well as in the field of cosmetics.”
`
`Class 044
`The wording “healthcare” is acceptable; however, the wording “beauty care” is indefinite and must be clarified, {i.e., “providing beauty
`salons” or “making reservations and bookings for others at beauty salons.”} (cid:160) Additionally, “services in the field of wellness” is too broad and
`applicant must specify what the services are {i.e., “consulting services” or “providing a website featuring information in the field of
`wellness.”}.
`The following substitute wording is suggested, if appropriate:
`
`“Medical services; medical advice regarding rehabilitation, medical services in the field of rehabilitation; healthcare and beauty
`care, namely, providing beauty salons, for people; consulting services in the field of wellness; medical consultation and medical
`services in the pharmaceutical, pharmacological and medical field as well as in the field of healthcare.”
`
`(cid:160)F
`
`or assistance with identifying and classifying goods and/or services in trademark applications, please see the online searchable Manual of
`Acceptable Identifications of Goods and Services at http://tess2.uspto.gov/netahtml/tidm.html.
`
`(cid:160)P
`
`lease note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of
`the goods is not permitted.(cid:160) 37 C.F.R. §2.71(a); TMEP §1402.06.(cid:160) Therefore, applicant may not amend the identification to include goods that are
`not within the scope of the goods set forth in the present identification.

`Applicant must submit the following color claim and color description:(cid:160) (1) a statement that “the colors blue, green and white are claimed as a
`feature of the mark;” and (2) a separate description of the mark, i.e., “the mark consist of the word “SYGNIS” in blue.
`(cid:160) Above the last “S” is a
`circle in green with a triangle inside the circle in white.” 37 C.F.R. §2.52(b)(1); TMEP §807.07 et seq.(cid:160) Common color names should be used to
`describe the colors in the mark, e.g., red, yellow, blue.(cid:160) TMEP §807.07(a)(ii).
