`In the office action dated August 2, 2006, the examining attorney required the applicant to amend the
`identification of goods, clarify its claim of acquired distinctiveness, and submit a disclaimer of
`“GAMER’S.”

`n its response, the applicant amended the identification, removed its 2(f) claim and submitted the required
`disclaimer.(cid:160) The disclaimer is accepted and added to the record.(cid:160) The amended identification remains

`goods is maintained and made FINAL.

`game interactive control floor pads and mats, and video game interactive remove control units;
`video game peripherals, namely external hard drives and other storage devices, and video

`§1402.01.(cid:160) Additionally, “memory sticks” is a registered trademark and cannot be used in an
`identification.(cid:160) Applicant must amend the identification of goods by deleting the wording “memory
`sticks” and substituting the common commercial or generic name for the goods. (cid:160) Registered marks are not
`to be used in the application to describe applicant's goods.(cid:160) TMEP §1402.09.
