`This Office action is in response to applicant’s communication filed on June 8, 2009. (cid:160) In the response,
`applicant presented arguments against the Section 2(d) refusals.(cid:160) The examining attorney carefully
`considered applicant’s arguments, and found them unpersuasive. (cid:160) Accordingly, the refusal to register is
`now FINAL for the reasons noted below.

`Section 2(d) Likelihood of Confusion- FINAL Refusal

`Registration of the applied-for mark is refused because of a likelihood of confusion with the mark in U.S.
`Registration Nos. 3462251 and 3058553.(cid:160) Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP
`§§1207.01 et seq.(cid:160) See the previously enclosed registrations.

`Trademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered mark
`that it is likely that a potential consumer would be confused or mistaken or deceived as to the source of the
`goods and/or services of the applicant and registrant.(cid:160) See 15 U.S.C. §1052(d).(cid:160) The court in In re E. I. du
`Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973) listed the principal factors to be

`considered when determining whether there is a likelihood of confusion under Section 2(d).(cid:160) See TMEP

`he registered mark KARMA GOLD is for “ Novelty body and/or facial sprays; cosmetics; skin care
`preparations, namely, hand creams, skin lotions, skin moisturizers, body soaps, face soaps, facial scrubs,
`and suntan lotions; personal deodorants; aromatherapy preparations, namely, fragrance aromatherapy oils,
`creams and lotions; massage oils; shower and bath preparations, namely, bubble baths, bath oils, bath gels,
`and foot scrubs; essential oils for personal use; shampoo; hair conditioner; hair mousse; and styling gel.”

`n this case, the following factors are the most relevant:(cid:160) similarity of the marks, similarity of the goods

`
`In a likelihood of confusion determination, the marks are compared for similarities in their appearance,
`sound, meaning or connotation and commercial impression.(cid:160) In re E. I. du Pont de Nemours & Co., 476
`F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973); TMEP §1207.01(b).(cid:160) Similarity in any one of
`these elements may be sufficient to find a likelihood of confusion.(cid:160) In re White Swan Ltd., 8 USPQ2d
`1534, 1535 (TTAB 1988); In re Lamson Oil Co., 6 USPQ2d 1041, 1043 (TTAB 1987); see TMEP
`
`§1207.01(b).(cid:160) (cid:160)
`
`Marks may be confusingly similar in appearance where there are similar terms or phrases or similar parts
`of terms or phrases appearing in both applicant’s and registrant’s mark.

`dominant term KARMA.(cid:160)(cid:160)
`
`Furthermore, applicant has merely “deleted” the terms PURE and GUARD from the registered marks,
`respectively.(cid:160) Courts have held that the mere deletion of wording from a registered mark may not be
`sufficient to overcome a likelihood of confusion.(cid:160) See In re Optical Int’l , 196 USPQ 775, 778 (TTAB
`
`
`
`1977); TMEP §1207.01(b)(ii)-(b)(iii).(cid:160) Applicant’s mark does not create a distinct commercial impression
`because it contains the same common wording as registrant’s mark, and there is no other wording to
`distinguish it from registrant’s mark.
`
`(cid:160)A
`
`pplicant argues that the proposed mark should be allowed in light of other “KARMA” marks on the
`Register.(cid:160) The examining attorney is not convinced by this argument as the referenced marks, e.g.
`KARMA IN A CAN for “novelty” spray water, have different impressions and/or contain other wording
`to distinguish them from the other “KARMA” marks.(cid:160) Again, applicant’s proposed mark contains only
`
`the term KARMA.(cid:160)(cid:160)
`
`Applicant also argues that the marks at issue are dissimilar in view of the marks’ different appearance,
`sound, meaning and commercial impression.(cid:160) To that end, applicant states that applicant’s mark is
`comprised of one term, KARMA, meaning “destiny or fate,” “the atmosphere radiated by a place,
`situation, person or object,” or “in Hindu and Buddhist philosophy, the quality of somebody’s current
`and future lives and determined by that person’s behavior in this and in previous lives.” (cid:160) Applicant states
`that the mark “creates the commercial impression of luck that is associated with and/or balanced with
`virtue.” (cid:160) By contrast, applicant’ argues, the mark KARMA GUARD creates the ultimate protection one
`can spray…to keep bad karma away.”(cid:160) With regard to PURE KARMA applicant’ argues that it creates the
`
`impression of the Buddhist philosophy regarding the Buddhist’s “three acts of merit.” (cid:160)(cid:160)
`
`The examining attorney is not convinced by applicant’s arguments regarding the purported impressions of
`the marks at issue.(cid:160) The question is not whether people will confuse the marks, but whether the marks will
`confuse people into believing that the goods they identify come from the same source.(cid:160) In re West Point-
`Pepperell, Inc., 468 F.2d 200, 201, 175 USPQ 558, 558-59 (C.C.P.A. 1972); TMEP §1207.01(b).(cid:160) For that
`reason, the test of likelihood of confusion is not whether the marks can be distinguished when subjected to
`a side-by-side comparison.(cid:160) The question is whether the marks create the same overall impression.(cid:160) See
`Recot, Inc. v. M.C. Becton, 214 F.2d 1322, 1329-30, 54 USPQ2d 1894, 1899 (Fed. Cir. 2000); Visual Info.
`Inst., Inc. v. Vicon Indus. Inc., 209 USPQ 179, 189 (TTAB 1980).(cid:160) The focus is on the recollection of the
`average purchaser who normally retains a general rather than specific impression of trademarks.(cid:160)
`Chemetron Corp. v. Morris Coupling & Clamp Co., 203 USPQ 537, 540-41 (TTAB 1979); Sealed Air
`Corp. v. Scott Paper Co., 190 USPQ 106, 108 (TTAB 1975); TMEP §1207.01(b).(cid:160) While an advanced
`analysis of the purported meanings of the marks may yield different meanings or impressions, the term
`KARMA nonetheless dominates the marks and is most likely to be recalled by a consumer, and most
`likely to make an impression on an average purchaser.(cid:160) Thus, as noted above, as the proposed mark no
`other wording to distinguish it from the registered marks, confusion among the marks is highly likely.
`

`omparison of Goods
`
`The goods of the parties need not be identical or directly competitive to find a likelihood of confusion.(cid:160)
`See Safety-Kleen Corp. v. Dresser Indus., Inc., 518 F.2d 1399, 1404, 186 USPQ 476, 480 (C.C.P.A.
`1975); TMEP §1207.01(a)(i).(cid:160) Rather, they need only be related in some manner, or the conditions
`surrounding their marketing are such that they would be encountered by the same purchasers under
`circumstances that would give rise to the mistaken belief that the goods come from a common source.(cid:160) In
`re Total Quality Group, Inc., 51 USPQ2d 1474, 1476 (TTAB 1999); TMEP §1207.01(a)(i); see, e.g., On-
`line Careline Inc. v. Am. Online Inc., 229 F.3d 1080, 1086-87, 56 USPQ2d 1471, 1475-76 (Fed. Cir.
`2000); In re Martin’s Famous Pastry Shoppe, Inc. , 748 F.2d 1565, 1566-68, 223 USPQ 1289, 1290 (Fed.
`Cir. 1984). Here, the goods at issue are highly related and in part identical.(cid:160) Moreover, the goods are all
`personal care products which are of a kind that regularly emanate from the same sources and travel in the
`
`
`
`same channels of trade such as the personal care section of general merchandise stores, or in cosmetic and
`beauty supply stores.
`

`egarding the goods identified in the KARMA GUARD registration, and applicant’s goods, both have
`identified the following: skin moisturizers, soaps, bath preparations such as bubble bath, bath oils and bath
`gels, and shampoos.
`
`Furthermore, attached are copies of printouts from the USPTO X-Search database, which show third-party
`registrations of marks used in connection with the same or similar goods as those of applicant and
`registrant in this case.(cid:160) These printouts have probative value to the extent that they serve to suggest that
`the goods listed therein, namely tannin preparations and indoor tanning preparations as well as
`moisturizers, skin creams, perfumes, and bath gels are of a kind that may emanate from a single source.(cid:160) In
`re Infinity Broad. Corp., 60 USPQ2d 1214, 1217-18 (TTAB 2001); In re Albert Trostel & Sons Co., 29
`USPQ2d 1783, 1785-86 (TTAB 1993); In re Mucky Duck Mustard Co., 6 USPQ2d 1467, 1470 n.6 (TTAB
`1988); TMEP §1207.01(d)(iii).(cid:160) Additionally, the examining attorney has attached screen shots from
`Neutrogena.com and Sephora.com showing that he goods at issue are of a kind that both emanate from the
`same source, and travel in the same channels of trade.(cid:160) It should be noted that the screen shots from
`Sephoa.com include both novelty cosmetic items and non novelty cosmetic items of widely varying price
`ranges.
`
`Applicant argues that the goods at issue do not travel in the same channels of trade.(cid:160) Specifically, applicant
`argues that the KARMA GUARD products “were made as a joke” and do not appear to be currently
`available in the market place, but were available online in 2006.(cid:160) As noted above, cosmetic novelties are
`found in the same channels as non-novelty cosmetics.(cid:160) Furthermore, the KARMA GUARD goods identify
`only one novelty item along with a list of other more standard cosmetic and personal care goods.(cid:160)
`Additionally, applicant should note that an evaluation under Section 2(d) is made on the basis of the face
`of the registrations.(cid:160) Thus, the goods are presumed to be for sale and the mark is presumed in use.(cid:160)(cid:160)
`Applicant also argues that its goods are sold only via its own brick and mortar stores and its own online
`site.(cid:160) To that end, the examining attorney reiterates that a Section 2(d) refusal is issued based on the facts
`as presented in the application and registrations at issue.(cid:160) It is well established that likelihood of confusion
`is determined on the basis of the goods as they are identified in the application and registration.(cid:160) Hewlett-
`Packard Co. v. Packard Press Inc., 281 F.3d 1261, 1267-68, 62 USPQ2d 1001, 1004-05 (Fed. Cir. 2002);
`In re Shell Oil Co., 992 F.2d 1204, 1207 n.4, 26 USPQ2d 1687, 1690 n.4 (Fed. Cir. 1993); TMEP
`§1207.01(a)(iii). Therefore, it is presumed that the goods at issue move in all normal channels of trade,
`and that they are available to all potential customers.(cid:160) See TMEP §1207.01(a)(iii); see, e.g., In re Americor
`Health Servs., 1 USPQ2d 1670, 1670-71 (TTAB 1986); In re Equitable Bancorporation, 229 USPQ 709,
`710 (TTAB 1986).(cid:160) Such channels would include retail shops, and online retail shops containing personal
`
`care items.(cid:160)(cid:160)
`
`Because the marks at issue share the identical dominant term KARMA, and the goods at issue are partially
`identical, and highly related personal care items which are of a kind that emanate from the same sources
`and travel in the same channels of trade, registration is refused per Section 2(d) of the Trademark Act.(cid:160)
`The refusal is now FINAL.
