`
`OFFICE ACTION
`
`STRICT DEADLINE TO RESPOND TO THIS LETTER(cid:160)
`TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE
`RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
`
`(cid:160)I
`
`SSUE/MAILING DATE: 8/19/2010
`
`(cid:160)T
`
`his action is in response to applicant’s letter, dated August 9 th, 2010, in which applicant submitted a new drawing of the mark.(cid:160) As discussed
`below, because the drawing is in color, and applicant has not submitted a color claim, an inconsistency now exists. In addition, the referenced
`pending application, Application Serial No. 77418368, has abandoned and is no longer a bar to the registration of applicant’s mark.
`
`(cid:160)C
`
`OLOR DRAWING WITHOUT COLOR CLAIM/COLOR DESCRIPTION
`
`(cid:160)A
`
`pplicant has submitted a color drawing but has not specified whether color is being claimed as a feature of the mark.(cid:160) Applications for marks
`depicted in color must include a complete list of all the colors that are claimed as a feature of the mark and a description of the literal and design
`elements in the mark that specifies where the colors appear in those elements.(cid:160) 37 C.F.R. §§2.37, 2.52(b)(1); see TMEP §807.07(a)-(a)(ii).(cid:160) In
`addition, the color claim and mark description must reference all the colors in the mark.(cid:160) See 37 C.F.R. §2.52(b)(1); TMEP §§807.07(a) et seq.(cid:160)
`Generic color names must be used to describe the colors in the mark, e.g., magenta, yellow, turquoise.(cid:160) TMEP §807.07(a)(i)-(a)(ii).
`
`(cid:160)T
`
`herefore, applicant must clarify whether color is claimed as a feature of the mark by satisfying one of the following:
`
`(1)(cid:160) If color is not a feature of the applied-for mark, applicant must submit a substitute black and white drawing of the mark to replace
`the color drawing of record.(cid:160) However, other amendments or changes to the mark will not be accepted if the changes would materially
`alter the mark.(cid:160) 37 C.F.R. §2.72; see TMEP §§807.07(a)(i), 807.14.; or
`
`(2)(cid:160) If color is a feature of the applied-for mark, applicant must submit both a statement listing all of the colors that are claimed as a
`feature of the mark and a statement describing the literal and design elements in the mark that specifies where the colors appear in those
`elements.(cid:160) 37 C.F.R. §§2.37, 2.52(b)(1); TMEP §807.07(a).(cid:160) If black is not being claimed as a color, applicant must also include a
`statement that the color black represents background, outlining, shading and/or transparent areas and are not part of the mark.(cid:160) TMEP
`
`(cid:160)
`(cid:160)
`(cid:160)
`
`
`§807.07(d).(cid:160) The following format is suggested:(cid:160) “ The colors gold and black are claimed as a feature of the mark.(cid:160) The mark
`consists of the wording ‘LUX’ in gold, with black shadowing.”
`
`(cid:160)S
`
`ee TMEP §807.07(b).
`
`(cid:160)P
`
`RIOR REGISTRATIONS CLAIM
`
`(cid:160)I
`
`f applicant is the owner of U.S. Registration Nos. 681254 and 3064930, then applicant must submit a claim of ownership.(cid:160) See 37 C.F.R. §2.36;
`TMEP §812.(cid:160) The following standard format is suggested:
`
`Applicant is the owner of U.S. Registration Nos. 681254 and 3064930.
