`
`OFFICE ACTION
`
`(cid:160)T
`
`O AVOID ABANDONMENT, THE OFFICE MUST RECEIVE A PROPER RESPONSE TO THIS OFFICE ACTION WITHIN 6 MONTHS
`OF THE ISSUE/MAILING DATE.
`
`(cid:160)I
`
`SSUE/MAILING DATE: 2/22/2010
`
`This Office action is in response to applicant’s communication filed on January 27, 2010.
`
`Applicant must address the fee requirement raised below.(cid:160) The examining attorney apologizes for any inconvenience the delay in raising this
`issue has caused applicant.
`
`(cid:160)I
`
`n addition, the examining attorney has determined that further clarification is required with regard to the identification of Class 37 services.(cid:160)
`The applicant’s amendment to the Class 35 services is accepted. (cid:160) The requirement as to Class 37 is discussed below.
`
`(cid:160)I
`
`nsufficient Fee for Amendment to Allege Use
`
`(cid:160)T
`
`he application specifies two classes; however, the fees submitted with the amendment to allege use are sufficient for only one class.(cid:160) In a
`multiple-class application, a fee of $100 per class is required for an amendment to allege use.(cid:160) 37 C.F.R. §§2.6(a)(2), 2.76(b)(3); see TMEP
`
`§1104.09(g).(cid:160)(cid:160)
`
`Therefore, applicant must either (1) submit the fee for each class not covered by the amount already paid, or (2) amend the application to delete
`
`the class(es) for which the required fee has not been paid.(cid:160)(cid:160)
`
`If applicant cannot satisfy one of the above requirements, applicant may withdraw the amendment to allege use and assert use at a later date.(cid:160)
`Fees submitted with the amendment to allege use will not be refunded.(cid:160) 37 C.F.R. §2.76(h); TMEP §1104.10.(cid:160) However, if applicant withdraws
`the amendment to allege use, registration will not be granted until applicant files an acceptable amendment to allege use or statement of use.(cid:160) See
`15 U.S.C. §1051(c)-(d); 37 C.F.R. §§2.76, 2.88; TMEP §1103.
`
`(cid:160)
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`(cid:160)
`
`
`Identification of Class 37 Services
`
`(cid:160)A
`
`pplicant must clarify the identification of services by further specifying that the repair, improvement, and maintenance services as well as the
`related call center services concerning repair and maintenance are “for commercial and industrial facilities.” (cid:160) See TMEP §1402.01.(cid:160) In providing
`wording suggestions to the applicant in the previous Office action, the examining attorney inadvertently omitted this clarifying language that
`was specified in the applicant’s original identification of services. (cid:160) The omission of this clarifying language would unacceptably broaden the
`scope of the services as set forth in the application at the time of filing.
`
`(cid:160)A
`
`pplicant may adopt the following identification of services, if accurate.(cid:160) See TMEP §1402.01.
`
`Class 37(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Call center services in the nature of responding to calls for assistance concerning the repair and maintenance, for commercial
`and industrial facilities, of building interior and exterior surfaces, HVAC systems, plumbing systems, electrical systems, fire and
`safety alarm systems, building locks, roofs, and windows; providing repair, improvement and maintenance services for
`commercial and industrial facilities in the areas of carpentry, janitorial services, heating, ventilation and air conditioning
`systems (HVAC), plumbing, electrical systems, fire and life safety alarm systems, painting, construction, building maintenance,
`asphalt paving, road paving, masonry, lock repair, roofing, plate glass repair, and repairs of dock lift and scissor lift
`
`(cid:160)I
`
`dentifications of services can be amended only to clarify or limit the services; adding to or broadening the scope of the services is not permitted.(cid:160)
`37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.(cid:160) Therefore, applicant may not amend the identification to include services that are not
`within the scope of the services set forth in the present identification.
