`
`OFFICE ACTION
`
`(cid:160)T
`
`O AVOID ABANDONMENT, THE OFFICE MUST RECEIVE A PROPER RESPONSE TO THIS OFFICE ACTION WITHIN 6 MONTHS
`OF THE ISSUE/MAILING DATE.
`
`(cid:160)I
`
`SSUE/MAILING DATE: 12/27/2009
`
`This Office action is in response to applicant’s communication filed on December 1, 2009.
`
`(cid:160)A
`
`pplicant’s claim of ownership of prior registrations is accepted.
`
`(cid:160)A
`
`pplicant’s proposed amendments to the identification of services are still unacceptable. (cid:160) Applicant has proposed wording that refers to services
`that are classified in multiple international classes.(cid:160) The multiple-class requirements are discussed below.
`
`(cid:160)I
`
`dentification of Services—Maintained and Continued
`
`(cid:160)T
`
`he wording “call center services” in the identification of services is indefinite and must be clarified because it usually refers to the operation of
`telephone call centers for others and it does not appear that applicant provides such services for others.(cid:160) Instead, it appears that applicant
`provides a technical support service in conjunction with its own maintenance or repair services.(cid:160) See TMEP §1402.01.(cid:160) Applicant must amend
`this wording to specify the common commercial or generic name for the services.(cid:160) If there is no common commercial or generic name for the
`
`services, then applicant must describe the nature of the services as well as their main purpose, channels of trade, and the intended consumer(s).(cid:160)(cid:160)
`
`The wording “the coordination of vendors and performance of” in the identification of services needs clarification because it is too broad and
`could include services classified in other international classes, namely, Classes 35 and 37.(cid:160) See TMEP §§1402.01, 1402.03.
`
`(cid:160)V
`
`endor management services and the coordination of vendors for others is a business service in Class 35, while the rendering of repair and
`maintenance services is in Class 37.
`
`(cid:160)A
`
`dditionally, the wording, “repair, improvement and maintenance services related to carpentry, janitorial, heating, ventilation and air
`
`(cid:160)
`
`
`conditioning (HVAC), plumbing, electrical, fire and life Safety, painting, construction, maintenance, asphalt, paving, masonry, landscaping,
`locksmiths, roofing, glass, dock lift and scissor lift repairs” requires further clarification because it includes services in other classes as well. (cid:160)
`Applicant should note that “landscaping” is indefinite and includes landscape gardening in Class 44. (cid:160) When an applicant has submitted an
`unacceptable identification of goods and/or services, it is Office practice to suggest acceptable substitute wording.(cid:160) In this case, however, the
`trademark examining attorney is unable to suggest substitute wording for “landscaping” because the nature of the services is unclear from the
`application record.(cid:160) TMEP §1402.01(e).
`
`(cid:160)T
`
`he wording, “locksmiths” is indefinite and includes services in Class 40 and Class 45. (cid:160) Applicant must specify whether it means “lock repair
`services.”
`
`(cid:160)A
`
`pplicant may adopt the following identification of services, if accurate.(cid:160) See TMEP §1402.01.(cid:160) Please note that the suggested wording is in bold,
`underlined font.
`
`Class 35(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`vendor management services and the coordination of vendors for commercial and industrial facilities
`
`call center services in the nature of responding to calls for assistance concerning the repair and maintenance of building
`interior and exterior surfaces, HVAC systems, plumbing systems, electrical systems, fire and safety alarm systems,
`building locks, roofs, and windows; providing repair, improvement and maintenance services in the areas of carpentry,
`janitorial services, heating, ventilation and air conditioning systems (HVAC), plumbing, electrical systems, fire and life safety
`alarm systems, painting, construction, building maintenance, asphalt paving, road paving, masonry, lock repair, roofing, plate
`glass repair, and repairs of dock lift and scissor lift

`or assistance with identifying and classifying goods and/or services in trademark applications, please see the online searchable Manual of
`Acceptable Identifications of Goods and Services at http://tess2.uspto.gov/netahtml/tidm.html.
`
`(cid:160)I
`
`dentifications of services can be amended only to clarify or limit the services; adding to or broadening the scope of the services is not permitted.(cid:160)
`37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.(cid:160) Therefore, applicant may not amend the identification to include services that are not
`within the scope of the services set forth in the present identification.
`
`(cid:160)M
`
`ultiple-Class Application and Requirements
`
`(cid:160)T
`
`he application identifies services that are classified in at least two classes; however, the fees submitted are sufficient for only one class.(cid:160) In a
`multiple-class application, a fee for each class is required.(cid:160) 37 C.F.R. §2.86(a)(2); TMEP §§810.01, 1403.01.
`
`(cid:160)T
`
`herefore, applicant must either (1) restrict the application to the number of classes covered by the fee(s) already paid, or (2) submit the fees for
`
`the additional class(es).(cid:160)(cid:160)
`
`The filing fee for adding classes to an application is as follows:
`
`(1)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`$325 per class, when the fees are submitted with a response filed online via the Trademark Electronic Application System
`(TEAS) at http://www.uspto.gov/teas/index.html; or
`
`(2)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`$375 per class, when the fees are submitted with a paper response.
`
`(cid:160)3
`
`7 C.F.R. §2.6(a)(1)(i)-(a)(1)(ii); TMEP §§810, 1403.02(c).
`
`(cid:160)I
`
`f applicant prosecutes this application as a combined, or multiple-class application, then applicant must comply with each of the requirements
`below for those services based on actual use in commerce under Trademark Act Section 1(a):
`
`(1)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Applicant must list the goods/services by international class;
`
`(2)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Applicant must submit a filing fee for each international class of goods and/or services not covered by the fee already paid (current
`fee information should be confirmed at http://www.uspto.gov); and
`
`(3)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`For each additional international class of goods and/or services, applicant must submit:
`
`(a)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Dates of first use of the mark anywhere and dates of first use of the mark in commerce, or a statement that the dates of use in the

`specimens for goods are tags, labels, instruction manuals, containers, photographs that show the mark on the goods or packaging,
`or displays associated with the goods at their point of sale.(cid:160) TMEP §§904.03 et seq.(cid:160) Examples of specimens for services are
`signs, photographs, brochures, website printouts or advertisements that show the mark used in the sale or advertising of the
`services.(cid:160) TMEP §§1301.04 et seq.;
`
`The following statement:(cid:160) “ The specimen was in use in commerce on or in connection with the goods and/or services
`listed in the application at least as early as the filing date of the application.”; and

`Verification is not required where (1) the dates of use for the added class are stated to be the same as the dates of use specified in
`the initial application, and (2) the original specimens are acceptable for the added class(es).
