`Responsive to the trademark attorney's request for

`a description of the mark, applicant states as follows:

`The mark consists of the Color Green used on the
`granules of fertilizers.
`The dotted outline
`around the granules of fertilizers is intended to
`show placement of the Color Green and is not
`claimed as part of the mark.
`
`The trademark attorney has refused registration of
`
`the Color Green for fertilizers on the grounds that
`
`applicant has not established that :he Color Green has
`
`acquired distinctiveness for fertilizers. Applicant
`
`respectively submits that the Color Green is distinctive of
`
`applicant's goods due to,
`
`inter alia,
`
`the arbitrary nature
`
`of the mark and applicant's long, continuous and
`
`substantially exclusive use of the Color Green for
`
`fertilizers for over almost
`
`twenty years as set forth in the
`
`application. This is prima facie evidence of acquired
`
`distinctiveness under Section 2(f) of the Trademark Act.

`Responsive to the trademark attorney's requirement
`
`for additional information, applicant states as follows:

`The identified Color Green trademark does not serve any
`
`other purpose as used on the goods other than as a
`
`trademark and,
`
`therefore,
`
`the Color Green trademark is
`
`not functional.

`of the manufacturing process for the goods.

`Green is added as an additional step in the

`Attached hereto as Exhibits 1 through 4 are advertising

`material for the Color Green fertilizer.

`The Color

`Green trademark is used with applicant's related
`
`company's registered trademark NUTRALEN3.
`
`Applicant uses the Color Green as a trademark to
`
`identify a source of origin of applicant's goods.
`
`Applicant uses other colors as trademarks f

`its
`
`goods.
`
`For example, applicant's related company is the
`
`owner of Registration Nos. 2,551,388 and 2,554,423,
`
`copies attached hereto as Exhibits 5 and 6, cited by
`
`the trademark attorney and discussed hereafter.
`
`Applicant also uses other colors to identify and
`
`distinguish its goods,
`
`including as referenced in
`
`applicant's pending Application Serial Nos. 77/295,286;
`
`77/295,316; 77/357,676; and 77/357,703, also pending
`
`before the trademark attorney and discussed with the
`
`trademark attorney during the telephone interview.
`
`Applicant is not aware of any competitors manufacturing
`
`fertilizers using applicant's trademark. Any such use
`

`applicant polices its trademarks.

`Attached hereto as Exhibits 7 and 8 are advertisements

`of third party manufacturers of fertilizers.

`The Color Green is not needed by others for

`fertilizers.
`
`Notwithstanding the above and while not believed
`
`to be necessary, applicant is also in the process of
`
`compiling additional evidence to illustrate the
`
`distinctiveness of applicant‘s trademark for fertilizers.
`
`The undersigned advised the trademark attorney of
`
`applicant's intention during the referenced telephone
`in:erview.
`
`The trademark attorney has initially refused
`
`registration under Section 2(d) of the Trademark Act based
`
`on Registration Nos. 2,551,388 and 2,554,423. Applicant
`
`respectfully requests that the trademark attorney reconsider
`
`and withdraw the refusal to register on the grounds that the
`
`cited registrations are owned by applicant's related company

`NUTRALENE® PRODUCT OVERVIEW
`
`NUTRALENE is a slow-release nitrogen fertilizer wifli a
`guaranteed analysis of 40-0-0 available in these
`sizes- Superfine SGN 75-90, Chip SGN 115-130,
`Midsize SGN 145-155 and Granular SGN 210-225.
`
`Turf and horticulture professionals know that the most
`important factor in growing thick turf or healthy nursery
`stock is a continuous supply of nitrogen throughout the
`growing season; but it has to be the right amount.
`Insufficient nitrogen can reduce plant color and vigor, which may lead to other problems,
`including disease, weeds and poor plant performance. Excessive nitrogen can over-stimulate
`growth, and might lead to stresses on turf with extra mowing and heavy clippings and
`nursery crops with excess growth that may need pruning. NUTRALENE s|ow—release nitrogen
`provides just the right amount of "spoon-feeding" for turf and ornamentals.
`
`Homogenous Granules Contain Three Nitrogen Sources
`
`This reacted methylene~urea polymer nitrogen has a unique Triple-Action Release for quick,
`intermediate and long—lasting results. Through a combination of hydrolysis and microbial
`activity, nitrogen is evenly released over a 12 to 16 week period under a broad range of
`environmental conditions. It enriches the soil microbiology and feeds the plants at the same
`time. The Triple-Action mechanical release of NUTRALENE gives you a three—fold advantage.
`
`1. For immediate response during the first four weeks after application, 15% of the product
`releases as urea.
`
`From about the third week after application through the tenth week, approximately 50%
`of the product releases from short—chain methylene urea (MU) polymers, providing the
`sustained feeding.
`
`After the tenth week, the remaining 35% of the product releases nitrogen from long—
`chain methylene urea polymers, sustaining the release for an extended feeding period up
`to sixteen weeks.
`
`The nitrogen supply in NUTRALENE does not depend solely on moisture or soil temperature
`for its release. NUTRALENE provides an excellent supply in cooler temperatures and over
`winter. A low salt index means this advanced nitrogen source will not burn. You can count
`on uniform, sustained feeding, even with hot weather and heavy rains.
`
`in addition, the nitrogen release rate of NUTRALENE is not related to coating or particle size.
`Other fertilizers may release nitrogen too quickly due to breakage during packaging or
`spreading. NUTRALENE, however, is formulated in homogenous granules that provide
`predictable and dependable results. Continual use of NUTRALENE assists in the buildup of
`soil beneficial microbes, which will continually release nitrogen to the plants. Regular
`applications of NUTRALENE will ensure consistent release of nitrogen when other sources will
`have been depleted.
