`applicant in connection with such goods, the trademark being applied by labels afiixed to

`containers of goods and in diverse other ways, and requests that the same be registered in
`
`the United States Patent and Trademark Office on the Principal Register in accordance
`
`with the Act of July 5, 1946.

`The trademark was first used in connection with goods as early as December
`
`2006, and first used in Interstate commerce which may be lawfully regulated by Congress
