`
`RESPONSE TO NOVEMBER 14, 2002 OFFICE ACTION FROM LAW OFFIC
`
`Dear Sirs,
`
`This is in response to a November 14, 2002 Office Action regarding
`the above noted application.
`In that Office Action,
`the Examining Attorney
`noted Lnat he has searched the Office records and found no similar
`registered or pending marks which would bar registration under Trademark Act
`Section 2(d). However,
`the Examining Attorney requested further
`clarification on a number of goods listed in the application. Applicant
`hereby provides the requested clarification and amendments, where necessary,
`to the lists of goods claimed in the Application.
`
`A. Va full line of computer software for business, home, education, and
`developer use"
`
`The Examining Attorney has requested Applicant amend the above noted
`idenzification to specify the purpose or function of the software, or
`alternatively,
`if the purposes and functions of the software are too
`numerous to list,
`the Examining Attorney indicates that Applicant may keep
`the _anguage as currently reflected in the application. Applicant would
`respectfully like to keep the current
`language as is.
`As
`the Examining
`Attorney is likely aware, Applicant is a multi—billion dollar producer of
`computer hardware and software.
`In order to meet
`the wide ranging demands
`of the business, home, education and developer communities that use
`Applicant's hardware, Applicant produces a wide range of computer software
`programs and utilities. While Applicant has made an attempt
`to list some of
`the purposes and functions of its software in the above noted application,
`1
`
`
`
`. W
`
`to list ALL of the purpos,; and functions of said software.would be
`extremely cumbersome. Applicant therefore believes that this is one of
`those rare occasions where the "full line of" language is appropriate.
`Applicant attaches to this email a printout of one of Applicant's web sites
`describing some of Applicants software. While this printout displays a
`large number of software titles offered by Applicant under the applied for
`mark,
`the page displays only a fraction of Applicant's total software
`offerings. Applicant invites the Examining Attorney to review applicants
`website at www.apple.com for further information if necessary.
`
`B. "paging software"
`
`The Examining Attorney has found "paging software" to be indefinite.
`Applicant would like to adopt the Exa '
`'ng Attorney's suggested amendment
`so that th
`ecitation will now read ':elecommunications software, namely
`for pagingiij
`C. "computer fonts,
`
`type designs and symbols"
`
`typefaces,
`
`type designs
`typefaces,
`The Examining Attorney has found "computer fonts,
`and symbols" to be indefinite. Applicant would like to thank the Examining
`Attorney
`his recommendation, and would like to amend the recitation to
`now read fonts,
`typefaces,
`type designs and symbols recorded on magnetic
`media".
`
`D. "Chips, discs and tapes bearing computer programs and software and other
`digital media."
`
`discs and tapes bearing computer
`The Examining Attorney has found ۤhips,
`,programs and software and other digital media} to be indefinite. Applicant
`would like delete this recitation as it is merely duplicative of "blank
`computer storage media", which is covered elsewhere in the application.
`
`E. "Children's educational software"
`
`The Examining Attorney has objected to "Children's educational software" and
`has requests that Applicant clarify the subject matter of the software.
`Applicant respectfully disagrees as it believes the recitation is
`L//sufficiently specific, and notes that the exact recitation appears in the
`Acceptable Identification of Goods and Services Manual. Further,
`the
`language has been accepted in other applications,
`for instance, SO KIDS CAN
`SHINE (Reg. No. 2lO6502)(see attached).
`
`As Applicant believes it has addressed all the issues presented in the above
`noted Office Action, Applicant believes the Application is now in condition
`for publication, and hereby requests such action.
`
`Respectfully submitted,
`
