`
`OFFICE ACTION
`
`(cid:160)(cid:160)(cid:160)
`
`
`The Office has reassigned this application to the undersigned examining attorney.(cid:160) The examining attorney acknowledges the applicant’s correspondence of June 24,
`2004, and the subsequent assignment of the application to Future Publishing Ltd. recorded October 25, 2004 at Reel 2965 / Frame 0742.
`
`(cid:160)O
`
`n November 13, 2000, action on this application was suspended pending the disposition of Application Serial Nos. 74-617005, 75-029556, 75-038079, 75-038099,
`and 75-038144.(cid:160) Application Serial Nos. 74-617005, 75-038079, and 75-038099 have been abandoned and no longer pose potential bars to registration. Application
`Serial Nos. 75-029556 and 75-038144 have matured into a registration.(cid:160) The newly assigned examining attorney has also completed a new search of the Office
`records and determined that several other registrations have matured that pose a likelihood of confusion based on the present identification of goods.(cid:160) Therefore,
`registration is refused as follows.
`
`LIKELIHOOD OF CONFUSION
`
`(cid:160)T
`
`he examining attorney refuses registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d), because the applicant’s mark, when used on or in connection
`with the identified goods, so resembles the mark in U.S. Registration Nos. 1,518,900, 2,209,319, 2,382,429 2,711,579,(cid:160) 2,855,432 and 2,920,266 as to be likely to
`cause confusion, or to cause mistake, or to deceive.(cid:160) TMEP §§1207.01 et seq.(cid:160) See the enclosed registrations.
`
`(cid:160)T
`
`he previously issued refusal based upon U.S. Registration Nos. 1,557,689, 1,648,669, and 1,935,090(cid:160) is maintained and CONTINUED. Please see the attached
`copies of these registrations.(cid:160) The refusal based upon previously cited Registration Nos. 1,670,630, 1,732,587 and 1,975,963 are withdrawn as the prior registrations
`have been cancelled.(cid:160) The refusal based upon previously cited Registration No. 1,957,448 is also withdrawn.
`
`(cid:160)S
`
`ection 2(d) of the Trademark Act bars registration where a mark so resembles a registered mark, that it is likely, when applied to the goods, to cause confusion, or to
`cause mistake or to deceive. TMEP §1207.01.(cid:160) The Court in(cid:160) In re E. I. DuPont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973), listed the
`principal factors to consider in determining whether there is a likelihood of confusion.(cid:160) Among these factors are the similarity of the marks as to appearance, sound,
`meaning and commercial impression and the similarity of the goods and services.(cid:160) The overriding concern is to prevent buyer confusion as to the source of the goods
`and services.(cid:160) Miss Universe, Inc. v. Miss Teen U.S.A., Inc., 209(cid:160)USPQ 698 (N.D. Ga. 1980). (cid:160) Therefore, any doubt as to the existence of a likelihood of confusion
`
`must be resolved in favor of the registrant.(cid:160) Lone Star Mfg. Co. v. Bill Beasley, Inc., 498 F.2d 906, 182 USPQ 368 (C.C.P.A. 1974).(cid:160)(cid:160)
`
`In each case, the applicant’s mark “THE EDGE” is identical to the mark “THE EDGE” of Registration No. 2,209,319, and is practically identical to the registered
`marks “EDGE” in every registration. (cid:160) The addition of the article “THE” to the term “EDGE” does not obviate the similarities in sound, appearance and meaning to
`the registered marks.(cid:160) If the marks of the respective parties are identical or highly similar, the examining attorney must consider the commercial relationship between
`the goods or services of the respective parties carefully to determine whether there is a likelihood of confusion.(cid:160) In re Concordia International Forwarding Corp.,
`
`222 USPQ 355 (TTAB 1983).(cid:160) TMEP §1207.01(a).(cid:160)(cid:160)
`Registration No. 1,518,900 – “EDGE”
`
`(cid:160)T
`
`he registrant uses its mark “EDGE” on a “magazine for company employees published periodically.” (cid:160) The applicant identifies goods in the nature of(cid:160)
`“magazines.” (cid:160) Without any further identification of the subject matter of the applicant’s magazines, it must be presumed that the goods include magazines for
`company employees published periodically.(cid:160) The goods are presumed to be identical.
`
`(cid:160)R
`
`egistration No. 2,209,319 – “THE EDGE”
`
`(cid:160)T
`
`he registrant, Stuart Hall Company, Inc., uses its mark “THE EDGE” on “school notebooks, folders, portfolios, memo books, legal pads and stenographer's
`notebooks.” (cid:160) The applicant indicates use of its mark on “note paper, note cards, . . . pencils, ball point pens, ink pens, stationary [sic] folders.” (cid:160) The goods are all
`paper office requisites that are likely to be found in the same channels of trade.(cid:160) Use of the identical mark on such goods is likely to cause confusion as to the source
`of such goods.
`
`(cid:160)R
`
`egistration No. 2,382,429 – “EDGE”
`
`(cid:160)T
`
`he registrant uses its mark on “computer software, namely computer programs use to analyze and predict the creditworthiness of individuals.” (cid:160) The applicant
`identifies “computers, computer accessories and computer peripherals” as goods on which it uses the mark. (cid:160) The Trademark Trial and Appeal Board has held that
`computer hardware products are so related to computer software products that their marketing under the same or similar marks may be likely to cause source
`confusion under Trademark Act Section 2(d), 15 U.S.C. §1052(d).(cid:160) In re Emulex Corporation, 6 USPQ2d 1312 (TTAB 1987) (JAVELIN for computer peripheral
`software storage unit held likely to be confused with JAVELIN for “prerecorded computer programs in machine readable form”); In re ITE/Communications, Inc., 5
`USPQ2d 1457 (TTAB 1987) (likelihood of confusion found for DATA STAR used in connection with both registrant’s “computer programs recorded on magnetic
`media” and applicant’s “voice/data communications terminals and parts thereof”);
`In re Digital Research Inc., 4 USPQ2d 1242 (TTAB 1987) (likelihood of
`confusion found in connection with CONCURRENT PC-DOS and CONCURRENT TECHNOLOGIES CORPORATION for “printed electronic circuit boards”);
`In re Epic Systems Corp., 228 USPQ 213 (TTAB 1985) (likelihood of confusion between EPIC for computer software for use in health care facilities and EPIC
`DATA for “electronic data collection terminals and electronic data collection units”); In re Graphics Technology Corp., 222 USPQ 179 (TTAB 1984) (AGILE for
`computer programs held likely to be confused with AGILE for computer data terminals); In re Compagnie Internationale Pour L’Informatique-Cii Honeywell Bull,
`223 USPQ 363 (TTAB 1984) (QUESTAR for computer hardware held likely to be confused with QUESTAN for computer programs); In re Teradata Corp., 223
`USPQ 361, 362 (TTAB 1984) (Y NET for computer hardware found likely to be confused with XYNET for computer software when channels of trade are unlimited
`by identification of goods in both application and registration); Alpha Industries, Inc. v. Alpha Microsystems, 220 USPQ 67 (TTAB 1983) (ALPHA MICRO for
`digital computer equipment and programs held likely to be confused with ALPHA MICROWAVE for microwave components and sub assemblies); See Octocom
`Systems Inc. v. Houston Computer Services, Inc., 918 F.2d 937, 16 USPQ2d 1783 (Fed. Cir. 1990) (affirming TTAB decision on summary judgment that found
`computer modems and computer programs highly related); Cf. In re Quadram Corp., 228 USPQ 863, 865 (TTAB 1985) (there is no “per se” rule for determining
`likelihood of confusion of marks in connection with software and hardware).
`
`(cid:160)
`(cid:160)(cid:160)
`
`
`Registration No. 2,711,579- “EDGE”
`
`(cid:160)T
`
`he fourth registrant uses its mark “EDGE” on “computer motion control hardware and software for use in the metal cutting and forming industries.” (cid:160) The
`examining attorney must determine whether there is a likelihood of confusion on the basis of the goods identified in the application and registration.(cid:160) If the
`application describes the “computer, computer accessories, [and] computer peripherals” broadly and there are no limitations as to their nature, type, channels of trade
`or classes of purchasers, it is presumed that the application encompasses all goods of the type described, that they move in all normal channels of trade, and that they
`
`are available to all potential customers.(cid:160) TMEP §1207.01(a)(iii).(cid:160)(cid:160)
`Registration Nos. 2,855,432 and 2,920,266 – “EDGE”
`
`(cid:160)T
`
`he final registrant uses its marks on goods in the nature of “computer software for office automation” and in connection with services identified as “computer
`systems and software design for others working in an office environment; computer consultation, namely, provide assistance to customers in the selection of
`computer systems and computer software for use in office automation; maintenance of office computer software.” (cid:160) The applicant’s computers, computer accessories
`and computer peripherals are broad enough to include technology that is sufficiently related to the goods and services of the registrant.(cid:160) The Court of Appeals for the
`Federal Circuit and the Trademark Trial and Appeal Board have held that various electronic goods are sufficiently related to technology related services that a
`likelihood of confusion exists under Trademark Act Section 2(d), 15 U.S.C. §1052(d) when the marks at issue are otherwise identical or highly similar.(cid:160) See Hewlett-
`Packard Co. v. Packard Press Inc., 281 F.3d 1261, 62 USPQ2d 1001 (Fed. Cir. 2002) (“electronic transmission of data and documents via electronic terminals”
`found to be “very similar” to registrations covering facsimile machines, computers, and computer software; “conversion from one media form to another media”
`found to be similar to registrations covering programs for information manipulation and apparatus for data acquisition and processing); MSI Data Corp. v.
`Microprocessor Systems, Inc., 220 USPQ 655, 658 (TTAB 1983) (“computer hardware manufacturing services to the order of or specification of others” held likely
`to be confused with “electronic ordering systems for gathering and transmitting source data comprising a recorder-transmitter and data receiver” used in connection
`with identical mark); See Communications Satellite Corp. v. Comcet, Inc., 429 F.2d 1245, 166 USPQ 353 (4th Cir. 1970), cert. denied, 400 U.S. 942 (1970)
`(COMSAT for satellite services and COMCET for computers held likely to be confused in that computers can be used to receive data transmitted by satellites).
`
`(cid:160)A
`
`s the marks of the parties are practically identical, and the goods and services of the parties are closely related if not presumably identical, there exists a likelihood of
`confusion as to the source of the identified goods, and registration is refused.
`
`(cid:160)A
`
`lthough the examining attorney has refused registration, the applicant may respond to the refusal to register by submitting evidence and arguments in support of
`registration.
`
`(cid:160)I
`
`f the applicant chooses to respond to the refusal to register, the applicant must also respond to the following continued informalities.
`
`(cid:160)I
`
`NSUFFICIENT FEE
`
`(cid:160)A
`
`pplicant must clarify the number of classes for which registration is sought.(cid:160) The submitted filing fees are insufficient to cover all the classes in the application.(cid:160)
`Specifically, the application identifies goods that are classified in at least six international classes, however applicant paid the fee for only one class.
`
`(cid:160)A
`
`pplicant must either: (1) restrict the application to the number of class(es) covered by the fee already paid, or (2) pay the required fee for each additional class(es).(cid:160)
`37 C.F.R. §2.86(a)(2); TMEP §§810.0l, 1401.04, 1401.04(b) and 1403.01.
`
`NOTICE:(cid:160) FEE CHANGE(cid:160)(cid:160)(cid:160) (cid:160)
`
`Effective January 31, 2005 and pursuant to the Consolidated Appropriations Act, 2005, Pub. L. 108-447, the following are the fees that will be charged for filing a
`trademark application:
`
`(1) $325 per international class if filed electronically using the Trademark Electronic Application System (TEAS); or(cid:160)(cid:160)
`
`(2)(cid:160)(cid:160) $375 per international class if filed on paper
`
`(cid:160)T
`
`hese fees will be charged not only when a new application is filed, but also when payments are made to add classes to an existing application. If such payments are
`submitted with a TEAS response, the fee will be(cid:160) $325 per class, and if such payments are made with a paper response, the fee will be $375 per class.
`
`(cid:160)T
`
`he new fee requirements will apply to any fees filed on or after January 31, 2005.
`
`(cid:160)I
`
`DENTIFICATION OF GOODS
`
`(cid:160)T
`
`he applicant was previously required to specifically identify the goods on which the applicant uses or has an intent to use the mark.(cid:160) The identification of goods

`
`(cid:160)C
`
`lass 9
`
`(cid:160)T
`
`he wording “computer accessories” in the identification of goods is too broad because it could include items classified in other classes. (cid:160) The applicant must amend
`the identification to list each item by its common commercial name.(cid:160) TMEP §§1401.04(b), 1402.01 and 1402.03.
`

`Class 9.”
`
`(cid:160)C
`
`lass 16
`
`(cid:160)T
`
`he wording “magazines” in the identification of goods is unacceptable as indefinite because it fails to identify the subject matter of the magazines. (cid:160) The applicant
`may amend this wording to “magazines, namely computer and video game magazines ,” if accurate. (cid:160) TMEP §1402.01.
`
`(cid:160)T
`
`he wording “collectors cards” in the identification of goods is unacceptable as indefinite. (cid:160) The applicant may amend this wording to “collectors’ trading cards,” if
`accurate.(cid:160) TMEP §1402.01.
`
`(cid:160)T
`
`he applicant must clarify the identification of goods by amending the term “stationary” to “stationery.” (cid:160) TMEP §1402.01.
`
`(cid:160)T
`
`he applicant may adopt the following identification of goods, if accurate:(cid:160)(cid:160)
`
`“magazines, namely computer and video game magazines, comic books, collectors’ trading cards, posters, note paper, note cards, bumper stickers, stickers, pencils,
`ball point pens, ink pens, stationery folders in International Class 16.”
`
`(cid:160)C
`
`lass 20
`
`(cid:160)I
`
`n the preliminary review of this application, this Office classified the goods identified as “video game consoles and video game accessories” incorrectly in
`International Class 20.(cid:160) The proper class for “video game machines for use with television and accessories therefor” is International Class 9. (cid:160) The correct
`classification for “stand alone video game machines” is International Class 28. (cid:160) The applicant must clarify the nature of these goods and classify them in the
`appropriate International Class.(cid:160) 37 C.F.R. §§2.32(a)(7) and 2.85; TMEP §§1401.04(b) and 1402.01.
`
`(cid:160)C
`
`lass 28
`
`(cid:160)T
`
`he wording “toys and playthings” in the identification of goods is unacceptable as indefinite. (cid:160) The applicant may amend this wording to “toys and playthings,
`namely,” if accurate. (cid:160) TMEP §1402.01.
`
`(cid:160)T
`
`he wording “video games” in the identification of goods is too broad because it could include items classified in other classes. (cid:160) The applicant must amend the
`identification to list each item by its common commercial name.(cid:160) TMEP §§1401.04(b), 1402.01 and 1402.03.(cid:160) The applicant may adopt the following wording, if
`accurate:(cid:160) “stand alone video game machines.”
`
`(cid:160)T
`
`he applicant may adopt the following identification of goods, if accurate:(cid:160)(cid:160)
`
`“toys and playthings, namely stand alone video game machines, handheld electronic games, computer game software, computer game software for use in location
`based entertainment centers in International Class 28.”
`
`(cid:160)T
`
`he goods are acceptable as identified in International Classes 21 and 25.
`
`(cid:160)P
`
`lease note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.(cid:160) 37 C.F.R. §2.71(a);
`TMEP §1402.06.(cid:160) Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.
`
`(cid:160)M
`
`ULTIPLE CLASS APPLICATION
`
`(cid:160)I
`
`f applicant prosecutes this application as a combined, or multiple‑class application, then applicant must comply with each of the requirements below for those goods
`based on actual use in commerce under Trademark Act Section 1(a):
`
`(1)(cid:160)(cid:160)(cid:160)(cid:160) Applicant must list the goods by international class with the classes listed in ascending numerical order;
`
`(2)(cid:160)(cid:160)(cid:160)(cid:160) Applicant must submit a filing fee for each international class of goods not covered by the fee already paid (current fee information should be confirmed at
`http://www.uspto.gov); and
`
`(3)(cid:160)(cid:160)(cid:160)(cid:160) For each additional class of goods, applicant must submit:

`
`lease note that the specimen of record is acceptable for class 9 only.
`
`(cid:160)P
`
`ending an adequate response to the above, registration is refused for International Classes 16, 20, 21, 25, and 28 because the specimen of record does not show use
`of the proposed mark as a trademark.(cid:160) Trademark Act Sections 1, 2 and 45, 15 U.S.C. §§1051, 1052 and 1127; TMEP §§904.11 and 1202 et seq.

`
`f the applicant cannot comply with the requirement for acceptable specimens of use of the mark for each class of goods for the Section 1(a) basis asserted, the
`applicant may substitute a different basis for filing if the applicant can meet the requirements for the new basis.(cid:160) See TMEP §§806.03 et seq.
`
`(cid:160)I
`
`n this case, the applicant may wish to amend the application to assert a bona fide intent to use the mark in commerce under Section 1(b), 15 U.S.C. Section 1051(b).
