`A PROPER RESPONSE TO THIS PORTION OF THE OFFICE ACTION MUST
`BE RECEIVED WITHIN 6 MONTHS FROM THE DATE OF THIS ACTION IN
`ORDER TO AVOID ABANDONMENT. For your convenience and to ensure proper
`handling of your response, a label has been enclosed. Please attach it to the upper
`right comer of your response. If the label is not enclosed, print or type the Trademark
`Law Otfice No., Serial No. , and Mark in the upper right corner ofyour response.

`The examining attorney has reviewed the applicant's response filed on September 18,
`1995. As discussed, the following requirements are continued and made FINAL. 37
`C.F.R. 2.64. If the applicant amends the application to comply with the requirements
`listed below within two months of the above mailing date, the examining attorney will
`give priority to the handling of the amended application. The six-month final deadline
`for filing a response specified above, or, in the alternative, for filing an appeal to the
`Trademark Trial and Appeal Board remains in effect. 37 C.F.R. 2.64(a).

`Specimens for Class 42 Services
`
`The specimens are unacceptable as evidence of actual service mark use because they do
`not refer or mention health maintenance organization services.. The applicant must
`submit three specimens showing the mark as it is used in commerce. 37 C.F.R Section
`2.58.
`Examples of acceptable specimens are signs, photographs, brochures or
`advertisements that show the mark used in the sale or advertising of the services.
`TMEP section 1301.04. The applicant must verify, with an affidavit or a declaration
`under 37 C.F.R. Section 2.20, that the substitute specimens were in use in commerce
`at least as early as the filing date of the application. 37 C.F.R. Section 2.59(a); TMEP
`section 905.10.
`
`Division of File Advisory
`
`The stated requirement above refers to Class 42 only and does not bar registration in
`the other classes. TMEP section 1113.05.
`Please note, however,
`that failure to
`respond to a refusal which pertains to fewer than all classes in an application will result
`in abandonment of the combined application in its entirety.
`
`The applicant may respond to the stated refusal by doing one of the following:
`
`(1) amending the application to delete the class to which the refusal pertains;
`
`(2) traversing the refusal of the combined application as a whole; or
`
`(3) filing a request to divide the application, so that the mark may be published
`for opposition in the classes to which the’ requirement does not pertain (37
`C.F.R. Section 2.87; TMEP sections 1105.06 and 1113.03).
