`The basis for the requested extension of time is that the parties,

`Several drafts of settlement

`proposals have been exchanged between counsel for the parties. On October 4 the

`undersigned received a finalized draft of a settlement agreement. This draft is being
`
`reviewed for submission to the client. Both parties have already agreed to the basics of
`
`a settlement proposal. An additional sixty days is believed to be necessary to finalize
`
`the remaining details and arrange for signature of a formal settlement agreement.

`Applicant's attorneys have consented to the present request for an additional 60 days

`I have reviewed your letter dated May 12 which I
`received by fax on June 9, with Boss Manufacturing Company.
`Our response is as follows:

`Italian Trademark Registration - Enclosed is a

`copy of the Italian trademark registration along with
`correspondence from our Italian associate.
`The trademark
`was registered in France and Italy in l962 as a result of
`a French—Italian trademark treaty. Once that treaty terminated,
`individual registrations were recorded separately in each
`country.
`The Italian registration was effective on March
`10, 1986 under Registration No. 413,586.
`The registration
`will remain in force in Italy until November 30, 2002. We
`decline to submit further materials regarding the extent of
`advertising and use in Italy until such time as your client
`has agreed to purchase this registration at the price
`previously indicated. We would certainly be willing to
`condition the purchase of the Italian registration upon our
`providing evidence of current use of the mark in Italy.
`
`Rainwear - I was advised today that BMC sells
`b)
`industrial rainwear and rainwear for professional fishermen
`at prices which exceed $60. Thus, I would propose to revise
`the listing of rainwear set forth in category A as follows:
`"Ponchos, slickers and rainsuits".
`I do not believe the
`listing in category C needs to be revised.

`Jackets and socks - We would not agree to move

`these items from category D to category C.
`The net effect
`of your suggestion would be to preclude BMC from selling

`It would be appreciated if you would promptly discuss

`It is my feeling that BMC has exhausted the concessions which
`it is willing to make. We would like to see our discussions
`finalized one way or the other.

`have discussed your proposals to move various articles from
`one category to another and break them down according to
`price. Enclosed is a revised list of categories. You will
`note that I have removed garment bags from category C and
`placed this item in category D along with softsided luggage
`and expandable bags.
`It was pointed out to me that garment
`bags are in effect softsided luggage and are expandable bags.
`T-shirts, sweatshirts,
`jackets and socks have been removed from
`category D and placed in both categories A and C and differentiated
`by price.

`In the final settlement agreement we would want

`the various categories are expressed in 1989 dollars and will
