`In the Office Action of February 19, 1986,
`
`the Trademark
`
`Attorney initially rejected the application for registration on
`
`the ground that the mark, when applied to the applicant's goods,
`
`so resembles the mark of U.S. Registration No. 717,303, as to be
`
`likely to cause confusion, or to cause mistake, or to deceive.
`
`Applicant has carefully considered the remarks of the
`
`Trademark Attorney, and has examined the file and investigated
`
`the use of the mark in cited Registration No. 717,303, and
`
`respectfully requests the Trademark Attorney to reconsider and
`
`withdraw the rejection on the basis of the evidence and arguments
`
`set forth below.
`
`The cited registration, No. 717,303,
`
`is of the mark "BIG
`
`BOSS," for "wax remover and high potency cleaner."
`
`The
`
`identification of the goods indicates that the goods of the cited
`
`mark are not
`
`intended or suitable for human personal care use,
`
`but rather consist of a floor cleaner.
`
`An examination of the
`
`registration file,
`
`including specimens, confirms that the goods
`
`of the registered mark are described as a "cleaner for safe and
`
`efficient removal of wax build-up and heavy soil from:
`
`rubber,
`
`asphalt, vinyl tile, linoleum, cork, finished wood, marble,
`
`terrazo, cement, magnesite, and other floors."
`

`
`support of App. Ser. No. 103,679; copy attached as Exhibit A.)

`Specimens filed by registrant in support of a Section 8 and 15
`
`affidavit in 1966 and an Application for Renewal
`
`in 1981 do not
`
`reveal any material change in the nature of the goods of the
`
`cited registration, and applicant's investigation has not
`
`revealed any such change.
`
`The Trademark Attorney has indicated that where the marks
`
`are the same or almost so, it is only necessary that there be a
`
`viable relationship between the goods or services in order to
`support a holding of likelihood of confusion, citing In re
`
`Concordia Int'l Forwarding Corp., 222 U.S.P.Q. 355 (TTAB 1983).
`
`Unlike Concordia, wherein applicant apparently conceded that
`
`the marks involved were each dominated by the word portion
`
`CONCORDIA, 222 U.S.P.Q. at 355,
`
`in this case the marks are
`
`specifically different.
`
`The word "BOSS" does not dominate the
`
`mark "BIG BOSS“ of the cited registration.
`
`The word "BIG"
`
`precedes "BOSS" and is of equal size to the word "BOSS"
`
`in Reg.
`
`No. 717,303.
`
`The word "BIG" has not been disclaimed from the
`
`cited registration. Moreover,
`
`the cited mark "BIG BOSS" conveys
`
`to reasonably prudent purchasers an impression of a powerful or
`
`strong authority figure, whereas the mark "BOSS" does not convey
`
`the same meaning but may connote products which are "first-rate“
`
`or "top-notch." American Heritage Dictionary of the English
`
`Language (1969), pg. 130, 154. Confusion as to source is not
`
`likely to occur merely because of the presence in both marks of
`
`the word "boss." Lever Bros. Co. v. Barcolene Co., 174 U.S.B.Q.
`392,393 (CCPA, 1972)
`(no likelihood of confusion,
`"ALL" household
`
`cleansing products vs.
`
`"ALL CLEAR!" household cleaner).
`

`"Applicant respectfully submits for those reasons that its mark is
`
`not the same as nor is almost the same as the cited mark.
`
`Moreover,
`
`in Concordia the record demonstrated that "both
`
`parties are engaged in the movement of goods of others to a final
`
`destination"
`
`(222 U.S.P.Q. at 356), specifically air freight
`
`forwarding services and transportation of goods by ship.
`
`The
`
`Trademark Trial and Appeal Board observed in that case that both
`
`services may be encountered by the same persons in the same
`
`situations, i.e. persons seeking to ship goods, and that some
`
`persons might assume that "these two services identified by
`
`highly similar marks are performed by the same organization,
`
`the
`
`choice being only whether the mode is by air or by sea“ (222
`
`U.S.P.Q. at 356-357).
`
`Unlike Concordia,
`
`the goods of this application -- being
`
`human personal care products -- are not competitive with or
`
`related to the floor cleaners of the cited registration.
`
`The
`
`function or purpose of the goods is not analogous or
`
`comparable.
`
`It is axiomatic that no reasonably prudent person
`
`would ever apply a floor wax remover and high potency cleaner to
`
`the face, hair, eyes or mouth; nor would such a person attempt to
`
`remove floor wax or clean a floor with perfumes, after shave
`
`lotion, mouthwash or any of applicant's other recited goods.
`
`Moreover,
`
`the goods would not be used by the same person in
`
`performing the same activities or at the same time. There is no
`
`practicable or actual relationship between the goods known to
`
`applicant. Unlike Concordia,
`
`there is no common ground or viable
`
`relationship between applicant's goods and those of the cited
`

`registration.
`
`Moreover,
`
`the Patent and Trademark Office previously has
`
`allowed concurrent registrations to apparently different
`
`registrants of marks having one word in common where the goods do
`
`not appear from their identifications to he obviously viably
`
`related.
`
`For example, published sources report the following in
`
`Class 3:
`
`HEART, U.S. Reg. No. 922,514, which was published on
`August 3, 1971, of The Gillette Co. d/b/a The Toni
`Company for hair shampoo;
`
`HEART OF MOISTURE, U.S. Reg. No. 1,146,003, which was
`issued on January 20, 1981,
`to Chesebrough-Pond's Inc.
`for lip gloss; and
`

`for all purpose cleaner, glass cleaner, floor polish,
`laundry soap and other goods.

`LEADER and Design, U.S. Reg. No. 1,312,862, which was
`issued on January 8, 1985 to LSP Leader Sport Products,
`Inc. for goods including swimmer's shampoo; and
`
`LEADER, U.S. Reg. No. 1,341,875, which was issued on
`June 18, 1985 to Diversey Wyandotte Corp. for a low
`temperature laundry detergent primarily for industrial
`use.
`
`A persusal of registrations in Class 3 suggest that the
`
`class is quite broad and includes a wide variety of goods which
`
`often are not viably related.
`
`In such instances,
`
`the Office has
`
`allowed concurrent registrations of the same or substantially
`
`similar marks.
`
`For any of the reasons set forth above, applicant
`
`respectfully requests that the Trademark Attorney withdraw the
`
`refusal based upon U.S. Reg. No. 717,303.
