`Trademark Attorney refuses registration under Section 2(a) and
`
`2(d).

`On the other,

`the last paragraph states that "A Search
`
`of the office records fails to show that the mark .
`

`
`resembles any registered mark as to be likely to cause
`
`confusion, or to cause mistake, or to deceive.’ Although it
`
`appears that the Trademark Attorney initially intended,
`
`perhaps,
`
`to refuse registration under Section 2(a) and 2(d),
`
`the existence of the search clause also appears to negate the
`
`intent. Until Applicant receives definite clarification,
`
`Applicant provides only a preliminary comment:
`
`In order to refuse registration under 2(a),
`
`there must be
`
`essentially the same likelihood of confusion as could occur in
`
`a Section 2(d) situation, plus an actual or
`
`implied intent on
`
`Applicant's part.
`
`TMEP Section l202.03(c). Applicant has no
`
`intent to suggest a false connection.
`
`The Trademark Attorney
`
`should note that the signatory's name is Robert B. Dodge, and
`
`that Applicant's product is sold exclusively at Applicant's
`
`retail grocery stores under the name "Dodge's Store" for
`
`immediate consumption.

`The term "DODGER" was derived from the founder's
`
`name. Furthermore,
`
`the term tDODGER", at least to some persons
`
`located in the Southern United States, is short for a
`
`'corndodger".
`
`"Corndodger“,
`
`in turn,
`
`is defined as a ‘corn
`
`cake either baked, pan—fried or broiled". Accordingly,
`
`the
`
`necessary intent is clearly absent
`
`to sustain a refusal under
`
`Section 2(a).
`
`
`
`
`

`Similarly,
`
`there also is no likelihood of confusion with
`
`the presumed citations of record. Applicant's mark,
`
`'DODGER
`
`DOG", when considered in its entirety, differs in sound, sight
`
`and meaning.
`
`A person who enters a "Dodge's Store" is unlikely
`
`to associate the 'DODGER DOG" frankfurter with the Los Angeles
`
`Dodgers‘ baseball team; rather,
`
`they are likely to associate
`
`the mark directly with Applicant.
`
`The fact Applicant's
`
`products are served and sold hot for immediate consumption
`
`further reinforces the connection with Applicant and obviates
`
`confusion. Additionally, Registration No. 839,324 and
`
`Registration No. 839,323 cover the mark "DODGERS" for
`
`entertainment services; such services are sufficiently remote.
`
`from the sale of a food product for immediate consumption.
`
`Finally, Registration No. 1,029,881 covers the mark "Dodgers +
`
`Design‘ for a variety of collateral products.
`
`The design of a
`
`baseball reinforces the connection with the baseball
`
`team.
`
`In
`
`contrast, as noted from the specimens, Applicant's mark is used
`
`in connection with the terms "Dodge's Store“. This reinforces
`
`the association with Applicant.
`
`In View of the above, further action is respectfully
`
