Specifically, the HIOM discloses that the hybrid system is an “Integrated Motor Assist (IMA) [design, which means Case IPR2020-00453 Patent Owner’s Preliminary Response Claims 1-21

The IMA system uses the engine as its main source of power and the motor as a supplemental source of power.” (Id.) Neither the HIOM or HISM disclose a diagnostic strategy for preventing activation of a low oil pressure indicator for an internal combustion engine (ICE) of a hybrid electric vehicle (HEV) when the ICE is not running but the electric motor is running.

A POSA would not consider combining the HIOM or the HISM with Kubota, and/or Lang because the HIOM and HISM are directed to an IMA HEV, while Kubota and Lang are directed to engine oil pressure monitoring for ICE-only vehicles, and even if the references were combined, they would still lack a diagnostic strategy for preventing activation a low oil pressure indicator of an HEV when the ICE is not running but the electric motor is running.

(Id.) In sharp contrast, claim 1 of the ’157 patent is directed to a “diagnostic system for controlling an engine low oil pressure indicator in a hybrid electric vehicle,” in which the controller is configured to prevent the low oil pressure indicator from being erroneously activated when the internal combustion engine is turned off and the electric traction motor is turned on.

However, the HIOM and HISM references are directed to a Honda Insight vehicle that features an internal combustion engine with an integrated electric motor assist system.
