Thus, one of ordinary skill in the art would have combined Schofield PCT with Saneyoshi based upon the rationale of “applying a known technique to a known device ready for improvement to yield predictable results.” (See MPEP § 2143(I)(D); Dann v. Johnston, 425 U.S. 219, 189 USPQ 257 (1976); see also 1012 at ¶ 53).
Distance calculation is not specifically discussed in Schofield PCT, but is an improvement where “additional discrimination between oncoming headlights and leading taillights may be accomplished by taking into account the relative location of the source of light within the scene.” (1006-014 at 3-6).
One of ordinary skill in the art would have recognized that Saneyoshi’s disclosure to “judge[] what a detected object is from dimensions or running speeds” (1007-041 at 31:35-36)(emphasis added) could have been expanded to specifically discern oncoming from leading vehicles based on Shigematsu.
Next, one of ordinary skill in the art would have found it obvious to utilize such distance and relative speed to identify and classify the object from other sources of light in Saneyoshi’s road/object detecting apparatus (indicated by red box above).
