On October 7, 2014, Petitioner filed a Petition for inter partes review of U.S. Patent No. 7,959,296.
As required by 37 C.F.R. § 42.15(a), Petitioner deposited $24,200.00 with the USPTO at the time of filing the Petition to cover associated fees.
On April 22, 2015, the Board issued an Order denying institution.
(Paper 16) Accordingly, Petitioner requests a refund of the post-institution fees paid to the USPTO in connection with this proceeding, totaling $15,200.00, to be paid to de- posit account number 03-3975.

The obviousness analysis “should be made explicit” and it “can be important to identify a reason that would have prompted a person of ordinary skill in the relevant field to combine the elements in the way the claimed new invention does.” KSR, 550 U.S. at 418.
“An inference of nonobviousness is especially strong where the prior art’s teachings undermine the very reason being proffered as to why a person of ordinary skill would have combined the known elements.” DePuy Spine, Inc. v. Medtronic Sofamor Danek, Inc., 567 F.3d 1314, 1326 (Fed. Cir. 2009).
Indeed, the Petition refers to Takanashi at 1:13-16, which states that “large screen image projectors utilizing a light modulators [sic] of twisted nematic type liquid crystals are becoming popular.
DePuy Spine, 567 F.3d at 1326 (stating, “[a]n inference of nonobviousness is especially strong where the prior art’s teachings undermine the very reason being proffered as to why a person of ordinary skill would have combined the known elements.”).
Please see the arguments present above with respect to the first and second “polarizing splitting element[s]” of independent claim 1 for why this subject matter is not taught or suggested by Kim and Takanashi, whether considered alone or in combination.
