Case IPR2014-01366 U.S. Patent No. 6,108,704 Pursuant to 37 C.F.R. § 42.53, Patent Owner Straight Path IP Group, Inc. (“Straight Path”), by and through its attorneys, will conduct examination by deposition of Dr. Henry Houh.
Dr. Houh’s deposition will take place commencing at 9:00 AM (local time) on May 26, 2015, and continuing day-to-day until complete, at the office of DLA Piper, 33 Arch Street, Boston, Massachusetts 02110-1447.
The deposition will be taken before a Notary Public or other officer authorized by law to administer oaths and will be recorded by video and using audiotape and/or stenographic means.
The parties have agreed to the date and time of the deposition and the availability of the witness.

Although not necessary, Straight Path also identifies such motions and preserves its right to file them.

AWH Corp., 415 F.3d 1303 (Fed. Cir. 2005).
Petitioner asserted alternative grounds based in part of Pitkin in case the Board applied a more narrow construction.
Because the Decision expressly stated it would consider more narrow constructions, instituting the grounds based in part on Pitkin will not result in any significant additional burden on the parties or on the Board.
Under its construction for “connected to the computer network” and “on-line status,” Patent Owner contends that Microsoft Manual, in view of NetBIOS, does not disclose this limitation.
As mentioned above, claim constructions identified by the Board are conditional and subject to change, and thus Palmer may become relevant if this limitation is construed in such a manner that overcomes grounds based on Microsoft Manual and NetBIOS.
