In an email to the Board on May 10, 2021, Petitioner stated: Natera filed its Preliminary Response (POPR) in IPR2021-00282 on April 27, 2021.
Moreover, Natera’s POPR advances new arguments regarding the Lo reference and its voluminous corresponding prosecution history (including an interference proceeding and a Federal Circuit decision) that are at odds with the corresponding record.
Consistent with the PTAB’s trial practice guide and to maximize efficiency for the Board and for the parties, Petitioner (Progenity) seeks Board authorization to submit the petitioner pre-institution reply materials from IPR2021-00266, as previously filed, together with a new 3-page brief directed specifically to the POPR filed in this case.
Patent Owner’s Preliminary Response focuses its arguments on factual allegations based on testimony presented in the Declaration of John Quackenbush, Ph.D. (Ex. 2001, “Quackenbush Declaration”), which itself makes assertions of facts.
Thus, we authorize Petitioner to file a 10-page Reply, limited to addressing Patent Owner’s arguments and evidence relating to the testimony
