IPR2021-00099, No. 2011-34 Exhibit - Defendants Responsive Claim Construction Brief (P.T.A.B. Jul. 15, 2021)
Triller should be limited based 011 prosecution disclaimer to a construction that excludes any “video take" that involved pausing/stopping and restarting a recording.
Defendants are not pressing their defense that this term renders the claim invalid for indefrrriteness.
Aylus Networks, Inc. v. Apple Inc., 856 F. 3d 1353, 1362 (Fed. Cir. 2017) (“[W]e hold that statements made by a patent owner during an IPR proceeding, whether before or after an institution decision, can be considered for claim construction and relied upon to support a finding of prosecution disclaimer.”).
While attempting to distinguish the prior art based on this same “video take” claim limitation, Triller argued that, unlike the claimed video take, “a ‘video clip’ can be comprised of segments from multiple video takes concatenated together.” Ex. 2, (IPR2021-00099) Patent Owner Preliminary Response at 16.
Thus, Triller should be held to its statements that clearly disclaimed any scope covering a “video take” being comprised of segments from multiple video takes concatenated together.

IPR2021-00099, No. 2012-35 Exhibit - Defendants Sur Reply Claim Construction Brief (P.T.A.B. Jul. 15, 2021)
“the extracted portions forming the subset of the plurality of video takes” ................ 9 VIII.
“determining an amount of time of the selected audio track to be used” ................... 10
Triller should be precluded, based on its prosecution disclaimer, from reading the “video take” limitation on video content created either (1) by pausing/stopping and restarting; or (2) as a result of multiple video recordings concatenated together.
Triller’s statements in IPR are binding as a matter of well-settled Federal Circuit law.
“playing, from a first beginning, the selected audio track” ... “a second beginning of capturing each video take of the plurality of video takes” ... “playing, from a first beginning, the selected audio track at substantially the same time as a second
