ln the regular perfonnance of my job functions, I am familiar with business records maintained by Plaintiff for the purpose of tracking assessment charges.
Plainfiff, acting on behalf of all Homeowners of Coventry Manor, was and still is a homeowners association existing by vinue of the laws of the State of New York and pursuant to a Declaration of Covenants, Conditions, Restrictions, Easements, Charges and Liens recorded in the Office of the Suffolk County Clerk on July 16, 1973 inLiber 7442, Page 328 (the ((Declaration"), with a principal place of business located at c/o Alexander Wolf & Company, Inc.; One Dupont Street, Plainview, NY I1803.
As a result of Defendant Bostic's failure to pay the assessment charges in connection with the ownership of the Premises, on December 20,2023, a Notice of Lien for Unpaid Assessments in the amount of Three Thousand Seven Hundred Ninety and 00/100 ($3,790.00) Dollars (the "Lien Amount") was filed with the Clerk of Suffolk County in Sequence # LMIS00023128, pursuant to $ 339-z of the RealProperty Law of the State of New York.
In further breach of the Goveming Documents of Coventry Manor, Defendant Bostic has failed to remit assessment charges and related fees allocated to and due upon the subject Premises from and including the date of the last zero balance, to date, plus interest thereon, totaling Nine Thousand Six Hundred Ninety-four and 53/100 ($9,694.53) Dollars, together with attorneys' fees permitted pursuant to the Coverning Doculnents of Coventry Manor.
A copy of the Accounts Receivable History is annexed hereto as Exhibit I. WHEREFORE, it is respectfully requested that the Court grant Plaintiffls requested relief and direct an Order: (i) pursuant to CPLR $3215, granting a default judgment against the non-answering and/or non-appearing Defendants; (ii) striking "John Doe #1" through "John Doe #10" as unnecessary parties to this action; (iii) appointing a referee to compute the amount due pursuant to CPLR $431 l, or in the alternative, for the appointment of a Referee to compute and report the amount due to Plaintiff pursuant to RPAPL $ 1321, CPLR $43 I I and $43 I 7; and (iv) for such other and further relief as this Court deems just and proper.
