WHEREAS, Plaintiff commenced this action by filing a Summons and Complaint (“Complaint”) and a Notice of Pendency; (See, NYSCEF Nos. 1, 3 and 10) for foreclosure of the Premises located at 281 N. Broadway, Lindenhurst, NY 11757 (“Premises”) WHEREAS, Whyte and Mary have been appointed co-executors of the estate of the Anthony Healy a/k/a Anthony Joseph Healy; WHEREAS, each of Patricia and Michael have renounced their respective share, as heirs of the estate of Anthony Healy a/k/a Anthony Joseph Healy and filed such renunciation in the probate proceeding pending in the Suffolk County Surrogate’s Court; WHEREAS, Mary, Patricia and Michael are all citizens and residents of Ireland; NOW THEREFORE, the undersigned counsel agree as follows:
The time period for defendants Whyte and Mary to respond to the Complaint is hereby extended through and including July 17, 2023;
Michael Healy and Patricia Healy are hereby dismissed, with prejudice from this action, with each party to bear their own fees, costs and expenses, including attorneys’ fees and costs.
The Stipulation is without prejudice to any party to seek further extensions and/or adjournments.
This Stipulation may be executed by electronic/fax signatures and shall be deemed original for all purposes.
