More specifically, Policy Integrity requested consent to file its amicus curiae brief by email sent to all counsel listed on the Court’s docket for Appellants and Appellees in all three consolidated cases (Nos. 23-15049, 23-15050, and 23-15051).
Policy Integrity’s email explained that its amicus curiae brief takes no position on the underlying merits of the parties’ dispute and instead addresses only the proper application of the major questions doctrine, which Intervenors-Appellants have invoked in support of their statutory authority arguments.
The “classic role of amicus curiae” before this Court is to “assist[] in a case of general public interest, ... supplement[] the efforts of counsel, and draw[] the court’s attention to law that might otherwise escape consideration.” Funbus Sys., Inc. v. State of Cal.
Policy Integrity is interested in this appeal because it is attentive to the sound development of administrative law, which includes the relatively nascent major questions doctrine.
