“To qualify as a case fit for federal-court adjudication, an actual controversy must be extant at all stages of review, not merely at the time the complaint is filed.” Davis v. Fed. Election Comm’n, 554 U.S. 724, 732-33, (2008) (internal quotation marks omitted).
In the Ninth Circuit’s view, courts must “treat the voluntary cessation of challenged conduct by government officials with more solicitude ... than similar action by private parties.” Id. (internal citation and quotation marks omitted).
The court explained: “Voluntary cessation of the contested conduct makes litigation moot only if it is absolutely clear that the allegedly wrongful behavior could not reasonably be expected to recur.” Id. at 345 (internal citation and quotation marks omitted).
